Agenda 03/27/2018 Item #16A 203/27/2018 EXECUTIVE SUMMARY Recommendation to adopt a Resolution accepting and assuming ownership and maintenance of the bridge at Logan Boulevard & Immokalee Road over the Cocohatchee Canal for the perpetual use by the public (This is a companion to Agenda Item 16.A.1). OBJECTIVE: For the County to accept ownership and maintenance of the bridge at Logan Boulevard & Immokalee Road over the Cocohatchee Canal, hereinafter referred to as the “Bridge,” to ensure safe passage by vehicles traveling on Logan Boulevard. CONSIDERATIONS: The Growth Management Department has recently completed construction of the Collier County portion of Logan Boulevard, which at its completion will connect to Bonita Beach Road. GL Homes, the developer of the Parklands Development of Regional Impact and Planned Unit Development (PUD) is required to finish the construction of Logan Boulevard from the Collier/Lee County line to Bonita Beach Road. Once the connection is made, the roadway will accommodate travel between Bonita Beach Road and Immokalee Road and serve more than just the adjacent private developments. The Bridge is a reinforced concrete arch structure that was built in the late 1990’s to serve the Olde Cypress PUD. The bridge owner is Stock Development, LLC. The County owns the right-of- way immediately north and south of the Bridge as well as the right-of-way underneath the Bridge, but never formally accepted the Bridge for maintenance. Stock Development has requested that the County take over ownership and maintenance of the Bridge since it serves the public, not just the individual development. County staff initiated a bridge inspection and load rating report. The inspection included an above and below water inspection, which resulted in a recommendation that the structure is overall in good condition with no major defects. The load rating results noted that no weight posting is necessary. Staff is recommending that the Board of County Commissioners (Board) adopt the attached Resolution accepting and assuming ownership and maintenance obligations for the Bridge. FISCAL IMPACT: The regular maintenance will become a part of the committed annual funding that is included as part of the Road and Bridge Maintenance Fund (101) budget. No immediate repair or maintenance costs are anticipated due to the satisfactory inspection recently completed. GROWTH MANAGEMENT IMPACT: Acceptance of this facility into the County system is consistent with the Transportation Element of the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - ERP RECOMMENDATION: To adopt a Resolution accepting and assuming ownership and maintenance of the Bridge over the Cocohatchee Canal at Logan Boulevard & Immokalee Road, as depicted on the attached map, for the perpetual use by the public. A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, ACCEPTING FOR OWNERSHIP AND ALL FUTURE TVIAINTENANCE, REPLACEMENT, AND REPAIR, THE BRIDGE LOCATED ON THE NORTH SIDE OF THE LOGAN BOULEVARD AND IMMOKALEE ROAD INTERSECTION OVER THE COCOHATCHEE CANAL FOR THE PERPETUAL USE BY THE PUBLIC IN GENERAL. WHEREAS, in conjunction with the development of the Olde Cypress subdivision in 1999, Olde Cypress Developmenl, Ltd, constructed the bridge canal crossing improvemenls locatcd at the intersection of Immokalee Road and Logan Boulevard ("Bridge"), the location of which is depicted in the attached Exhibit "A"; and WHEREAS, Stock Development, LLC, as the sole general partner of Olde Cypress Development, Ltd., has requested that the County accept ownership of the Bridge; and WHEREAS, Collier County owns the right-of-way upon which the Bridge is located, has acquired the right-of-way immediately north of the Bridge, and has entered into Development Agreements for the exlension of Logan Boulevard to the Collier County/Lee County line tbr potential connection to Bonita Beach Road; and WHEREAS, since the Bridge's construction, ovcr 3.000 additional residential units have been constructed along Logan Boulevard which utilize the Bridge for acce ss to their communities; and WHEREAS, County staffihas inspected the Bridge and determined it to be in overall good condition with no major def-ects; and WHEREAS, the Board of County Commissioners may establish and locate new public roads by resolution pursuant to Section 336.08, Florida Statutes; and WHEREAS, the Board finds it in the best interest of the residents of Collier County for the County to assume ownership and maintenance responsibilities of the Bridge, especially in light of tuture plans to conncct Logan Boulevard to Bonita Beach Road in Lee County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Collier County hereby accepts and assumes ownership and all future maintenance, replacement and repair obligations of the Bridge, as depicted in Exhibit "A," to be held for the perpetual use by the public in general. As you are aware, these improvements were initially permitted and constructed by Olde Cypress Development, Ltd. in 1999 in connection with the Olde Cypress subdivision. Based on a review of our files, these improvements were inspected and signed off, but never formally conveyed to Collier County. We hereby request that Collier County accepts ownership and maintenance of these improvements, as they now serve over 3,000 residential units, including the Riverstone and StoneCreek communities.
