EXECUTIVE SUMMARY Recommendation to approve and authorize payment to Florida Power & Light Company in the amount of $7,782 for a non refundable Engineering Deposit required for design plans for Phase IV of the Vanderbilt Beach Municipal Service Taxing Unit Aerial to Underground Conversion Project. OBJECTIVE: To obtain design plans from the Florida Power & Light Company ( "FPL ") for the final phase of the electrical conversion project to complete hurricane hardening and area beautification within the Vanderbilt Beach Municipal Service Taxing Unit (the "MSTU "). CONSIDERATIONS: The MSTU completed Phase I of its FPL Aerial to Underground Conversion Project, consisting of properties along Gulf Shore Drive and its adjacent streets, in September 2013 (the "Conversion Project "). On July 8, 2014, the Board approved entering into an Underground Facilities Conversion Agreement (UFCA) with FPL, which provides for the payment of $830,238 to FPL for material, as received, for Phases II and III of the Conversion Project. The County issued a competitive solicitation to obtain a vendor to provide excavation and installation services for the conduit for all utilities to be relocated for Phase II and III; with the intent to commence this part of the Conversion Project in the October 2014 timeframe. It is anticipated that Construction will take approximately eighteen months. The Board's approval of the payment for the non - refundable Engineering Deposit will allow for the completion of the design and planning of Phase IV so that construction can begin immediately following the conclusion of Phase II and I11. The Engineering Deposit is non- refundable but will be used as a credit under the UFCA for Phase IV per FPL Tariff 12.2.3 Non - Refundable Deposits. On October 2, 2014, the MSTU Advisory Board voted 3 -0 to approve the payment of the non- refundable deposit. FISCAL IMPACT: Funds in the amount of $7,782 are available in the Vanderbilt MSTU, Fund 143. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.— SRT GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. FPL Tariff 12.2.3 12.2.3 Non - Refundable Deposits The non - refundable deposit for a binding cost estimate for conversion to a direct buried cable in conduit underground electric distribution system shall be determined by multiplying the number of pole line feet of existing overhead electric distribution facilities to be converted by $1.20. The deposit must be paid to FPL to initiate the estimating process. The deposit will not be refundable, however, it will be applied in the calculation of the CIAC required for the installation of underground distribution facilities. The deposit and the preparation- of a binding cost estimate are a prerequisite to the execution of either an Underground Facilities Conversion Agreement or an Underground Facilities Conversion Agreement - Governmental Adjustment Factor Waiver. If the request for underground electric distribution facilities involves the conversion of less than 250 pole line feet of existing overhead facilities, then no deposit will be required for a binding cost estimate, provided, however, that all other requirements of this tariff shall still apply. 60 Packet Page -1450-
