Agenda 09/23/2014 Item #16H 49/23/2014 16.H.4. EXECUTIVE SUMMARY Recommendation to appoint a member to the Collier County Coastal Advisory Committee. OBJECTIVE: To confirm one appointment by the City of Marco Island to fill a vacant seat on the Collier County Coastal Advisory Committee expiring on May 22, 2017. CONSIDERATIONS: The Collier County Coastal Advisory Committee has a vacancy for the City of Marco Island for a term expiring on May 22, 2017. This is due to Victor Rios having been deemed to have resigned from this committee as he is running for Marco Island City Council. This 9 member committee was created by Ordinance 2001 -03 to assist the Board of County Commissioners with its establishment of unified beach erosion control and inlet management programs within the unincorporated and incorporated areas of Collier County, and to advise the Board of County Commissioners and the Tourist Development Council of project priorities with respect to funding sources that are available to Collier County for restoration and protection of its shoreline. The committee is composed of 3 members from the unincorporated area of Collier County, 3 members from the City of Naples and 3 members from the City of Marco Island. Selection for membership on this committee will be based upon the applicant's familiarity with coastal processes, inlet dynamics, coastal management programs, or demonstrated interest in such programs; relevant education and experience; leadership and involvement in community affairs; and willingness to attend meetings and to undertake and complete assignments. RECOMMENDATION: That the Board of County Commissioners considers the recommendation for appointment of Mr. Koziar as a representative of the City of Marco Island, and directs the County Attorney to prepare a resolution confinning the appointment. The Marco Island representatives are Councilor Bob Brown, Ms. Debbie Roddy and Mr. Victor Rios. Mr. Rios is currently running for office on the Marco Island City Council. In accordance with Collier County Ordinance No. 2001 -55, Mr. Rios is deemed to have resigned from the CAC in order to pursue his candidacy for City Council. In order to fully participate in CAC deliberations and decisions, Council should now appoint another representative to complete the remainder of Mr. Rios' vacant term, which will expire on May 22, 2017. Tim Nance District 5 The City of Marco Island representative, Victor N. Rios, is currently running for office on the Marco Island City Council. Ordinance No. 2001 -55, as amended, states as follows: No member of any county board shall become a candidate for an elective political office and continue to serve on such board during his or her candidacy unless such board member /candidate is running unopposed for a non - remunerative elective position or an elective position receiving nominal remuneration, such as the Mosquito Control District Board or a fire district board. Should any county board member compete for an elective non- remunerative political office or a nominally- remunerative political office on the date applications for candidacy expire, such candidacy shall be deemed a tender of resignation from such board and the board shall immediately advise the commission in writing of said resignation. No board member shall be required to resign or deemed to have tendered his or her resignation unless such candidacy is being opposed. The commission shall deem the position vacant upon receipt of written notice of said resignation. The board member shall not serve at any meetings after his or her position becomes vacant pursuant to this ordinance. This provision shall not apply to candidates who currently serve in elected positions and who are seeking re- election. (emphasis added) If Mr. Rios were running un- opposed, there would not be a potential conflict. However, he is running opposed, and based on the above ordinance, is deemed to have resigned from the CCCAC. Mr. Rios may re -apply for any County advisory board after the election is final. Ordinance No. 2001 -03, as amended, provides that appointments to the CCCAC from the City of Naples and the City of Marco Island shall be appointed from a list containing one or more qualified applicants submitted by the respective governing bodies of those Cities.
