EXECUTIVE SUMMARY Recommendation to approve proposed revisions to the Right -of -Way Permit forms for temporary, special event directional signs, and to approve a resolution updating the Right -of -Way Permitting Fee Schedule Resolution to reflect the related $75 fee. OBJECTIVE: To obtain Board approval of proposed revisions to the Right -of -Way Permit Application and Permit, for temporary, special event directional signs, and to obtain Board approval of a related update to the Fee Schedule Resolution. CONSIDERATIONS: During the February 25, 2014 BCC meeting, the Board directed staff to address temporary event signage in the public rights -of -way. In response, Code Enforcement staff performed an intensive, County -wide sweep for illegal snipe signs. In addition, permitting staff reviewed the existing regulatory framework for issuance of permits for temporary signs in the public rights -of -way for special events. As a result of this review, staff is proposing several changes to the permit forms for these temporary signs. The proposed changes include the following: • Number /size: Under the proposed revisions, 2 large signs (max. 4' x 8') may be permitted in the ROW at the entrance to the event, and 6 additional smaller signs (max. 18" x 24 ") may be permitted for placement in the public right -of -way within a 5 -mile radius of the event. • Appearance: The proposed revisions require blue signs with white font (the existing permit forms "recommend" this color scheme). The existing prohibition on advertisements on these signs will stay in place. • . Enforcement language: We have updated the enforcement language on the application and permit forms to indicate that violations of a permit may subject the event sponsor to enforcement proceedings and related penalties. • Other notes: Other restrictions remain (e.g., signs cannot be too close together, cannot be in medians, cannot be too close to road, etc.); on -site signage for temporary use permits is unaffected. These proposed revisions were presented to the Development Services Advisory Committee (DSAC) on May 7, 2014. Following a discussion which included some individual concern over the changes, the DSAC voted unanimously to forward the proposed changes for Board approval. These proposed changes would be incorporated into future permits. In addition, a resolution of the Board is necessary to add the $75 fee for these permits into the Growth Management Division Right -of -Way Fee Schedule. A copy of the proposed resolution, with updated fee schedule, is included in the backup materials to this item. The proposed fee schedule update also contains some minor cosmetic changes to the "permit notes" section (located on the last page of the proposed fee schedule). RESOLUTION NO. 2014 - A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, SUPERSEDING RESOLUTION NO. 2007 -162 IN ORDER TO ESTABLISH A REVISED SCHEDULE OF FEES FOR RIGHT -OF -WAY PERMITS. WHEREAS, Collier County Resolution No. 2007 -162 established a Schedule of Fees for Right -of -Way Permits; and WHEREAS, as directed by the Board of County Commissioners (Board), County staff' reviewed the existing regulatory framework for issuance of permits for special event signs in public rights -of -way and, based on this review, is proposing changes to the permit forms for these temporary signs; and WHEREAS, staff is also proposing a revision to the current Schedule of Fees for Right - of -Way Permits so as to include a fee for a Temporary Directional Sign Permit for Public Event; and WHEREAS, new or increased fees for certain land development activities, including, but not Iimited to, permitting of special event directional signs for placement in the public rights -of. way, are reflective of the actual cost of processing, reviewing, and inspecting such permit work. No refunds of unused fees shall be allowed. 6. Lane use fees shall be calculated by Collier County and shall be due and payable at the time of permit application if a penult is issued If a Notice of Intent to Issue a permit is provided by the County in lieu of a permit, then the lane use fee shall be due and payable at the time of issuance of the actual permit. 7. If work continues beyond the originally estimated lane use period, then additional lane use fees shall be due and payable within two working days of notice to the Permittee of such additional fees. Failure to provide the additional fees to the County within three working days of such notice shall be cause for the project to be "red- tagged" and shut down. Lane use fees shall continue to accrue during any period of shutdown and shall be added to the additional lane use fees calculated by Collier County. 8. Any deviation from the above must be approved by the ROW Permitting and .Inspection manager or designee prior to implementation. 9.
