EXECUTIVE SUMMARY Recommendation to adopt resolutions approving the preliminary assessment rolls as the final assessment rolls and adopting same as the non-ad valorem assessment rolls for purposes of utilizing the uniform method of collection pursuant to Section 197.3632, Florida Statutes, for Solid Waste Municipal Service Benefit Units, Service District No. I and Service District No. II, Special Assessment levied against certain residential properties within the unincorporated area of Collier County, the City of Marco Island and the City of Everglades City, pursuant to Collier County Ordinance 2005-54. OBJECTIVE: Adopt two resolutions approving the preliminary assessment rolls as the final assessment rolls and adopting same as the non-ad valorem assessment rolls for purposes of utilizing the uniform method of collection pursuant to Section 197.3632, Florida Statutes, for Solid Waste Municipal Service Benefit Units, Service District No. I and Service District No. II Special Assessment levied against certain residential properties within the unincorporated area of Collier County,The City of Marco Island and City of Everglades City pursuant to Collier County Ordinance 2005-54. Monies collected through the annual assessment will fund the mandatory residential curbside solid waste collection and disposal program. CONSIDERATION: On July 8, 2014 (Agenda Item 16C1) the Board of County Commissioners adopted two five year (intent) resolutions: one resolution for Solid Waste • Municipal Service Benefit Units, Service District No. I and for Service District No. II to set the date, time and place for a public hearing to approve a not-to-exceed special assessment (non-ad valorem assessment) to be levied against properties within the above Districts for a five year period. The resolutions established a five-year assessment period beginning with FY2015 and ending with FY2019 and provided for a not-to-exceed price of $225.00 per year through FY2019. The adopted resolutions provided that annual rates would be adopted by resolutions to establish the rates for each of the five fiscal years. The annual assessment for residential trash collection services has been included on the non-ad valorem section of the tax bill for property owners in Collier County since 1996. Section 197.6362 of the Florida Statutes provides for this, and it is known as the "uniform method of collection."The current annual assessments of$173.49 (District I)and $165.28 (District II)have remained unchanged since 2011. Collier County currently provides some of the highest levels of waste collection and disposal services at one of the lowest assessment costs in the State of Florida. Services provided for the annual assessment include:. • twice weekly garbage collection • once weekly recycling collection • once weekly yard waste collection • on-demand collection of bulky items(tires, appliances,furniture,batteries,etc.) • on-demand collection of electronics The current cost for this level of service in the City of Naples is $248.10 annually. Nearby counties offer various levels of service that are lower than that offered in Collier County. Lee n Packet Page-3474- 9/9/2014 17.F. County, for example, offers once-per-week garbage collection and their annual assessment is $219.78. Adoption of the attached resolutions will accomplish the following: 1. Approve the preliminary FY2015 assessment rolls (on file with Minutes and Records, Clerk to the Board)assessing certain properties within identified areas of Collier County. 2. Approve using the preliminary rolls and any amendments thereto as the final rolls to be certified by the County Attorney as directed by prior Board action on December 19, 1995 (Agenda Item 12C4)before they are merged with the tax bills. 3. Approve using the preliminary rolls and any amendments thereto as the non ad-valorem assessment rolls for FY2015. Upon adoption of these resolutions, all assessments shall be collected pursuant to Section 197.3632, Florida Statutes, or any successor statutes authorizing the collection of such assessments on the same bill as ad valorem taxes. FISCAL IMPACT: The proposed FY2015 annual rate for Solid Waste Municipal Service Benefit Unit, Service District No. I will be$182.37 per equivalent residential unit,which equates to an increase of$8.88 per year, or $.17 per week. The proposed annual rate for Solid Waste Municipal Service Benefit Unit, Service District No. II will be$170.36 per equivalent residential unit, which equates to an increase of$5.05 per year, or $.09 per week. The rates were reviewed by the Board of County Commissioners during the FY2015 budget hearing on June 26, 2014. Funds will be deposited in Mandatory Trash Collection Fund (473) in the proposed amounts of $19,636,900 for Solid Waste Municipal Service Benefit Unit, Service District No. I and $1,083,700 for Solid Waste Municipal Service Benefit Unit, Service District No. II. Total anticipated revenues for FY2015 are$20,720,600. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board action. -JAB GROWTH MANAGEMENT IMPACT: There is no growth management impact for this item. I SPECIAL ASSESSMENT LEVIED AGAINST CERTAIN RESIDENTIAL PROPERTIES WITHIN THE UNINCORPORATED AREA OF COLLIER COUNTY PURSUANT TO COLLIER COUNTY ORDINANCE NO.2005-54. WHEREAS, The Board of County Commissioners of Collier County, Florida, (hereinafter referred to as COUNTY), adopted Collier County Ordinance No. 2005-54 creating two (2) Municipal Service Benefit Units in the unincorporated area of Collier County for the purpose of providing and regulating Solid Waste Collection and Disposal Services; and WHEREAS, The County intends to finance the Solid Waste Collection and Disposal Services through the levy of special assessments (non-ad valorem assessments) against residential units as defined in Collier County Ordinance No. 2005-54 that are benefited by the solid waste collection and disposal services. Said properties are located within the boundaries of Solid Waste Municipal Service Benefit Unit, Service District No. I as described herein and in Collier County Ordinance No. 2005-54; and WHEREAS, Section 197.3632, Florida Statutes, requires that a public hearing be held to adopt a non ad-valorem assessment roll for purposes of utilizing the uniform method of collection;and WHEREAS, Said public hearing was duly advertised and regularly held at the Board of County Commissioners' Boardroom, Third Floor, W. SECTION ONE: The Board, having met to receive and consider the written objections of the property owners and other interested persons appearing before the Board as to the propriety and advisability of confirming and adopting the Solid Waste Municipal Service Benefit Unit,Service District No. I Preliminary Assessment Roll, as to the amounts shown thereon to be assessed against the lots and parcels of land to be benefited and as to the equalization of such assessments on a basis of justice and right, does hereby confirm such preliminary assessment roll which excludes certain residential units that are included in a homeowner's association or property owner's association that pays the commercial fee for solid waste collection and disposal services for all such units. Further, the Board adopts the preliminary assessment roll and makes it final as the Solid Waste Municipal Service Benefit Unit, Service District No. I final assessment roll (non- ad valorem assessment roll)for the purpose of using the uniform method of collection. The total special assessments for the solid waste collection and disposal services for Solid Waste Municipal Service Benefit Unit, Service District No. I for FY 2015 is $182.37 per Residential Unit. The total assessments against the benefited properties are described and set forth in the preliminary assessment roll (non-ad valorem assessment roll) on file with Clerk to the Board, Minutes and Records. The Board hereby confirms the special assessments (non-ad valorem assessments) and the final assessment roll (non- ad valorem assessment roll), which is on file with Clerk to the Board Minutes and Records. SECTION THREE: Upon adoption of this Resolution all the special assessments (non-ad valorem assessments) and all special assessments in subsequent years for Solid Waste Collection and Disposal Services within Solid Waste Municipal Service Benefit Unit, Service District No. I shall be collected pursuant to Section 197.3632, Florida Statutes, or any successor statutes authorizing the collection of such non-ad valorem assessments on the same bill as ad valorem taxes shall be billed. SECTION FOUR: The assessments shall be fmal and conclusive as to each lot or parcel assessed and any objections against the making of any assessable improvements not so made shall be considered as waived, and if any objection shall be made and overruled or shall not be sustained, the adoption of this Resolution approving the final 3 S Packet Page-3481- 9/9/2014 17.F. assessments shall be at the final adjudication of the issues presented unless proper steps shall be taken in a court of competent jurisdiction to secure relief within twenty (20) days from the adoption of this Resolution. SECTION FIVE: All assessments shall constitute a lien upon the property so assessed from the date of confirmation of this Resolution of the same nature and to the same extent as the lien for general county taxes falling due in the same year or years in which such assessments fall due, and any assessment not paid when due shall be collected pursuant to Chapter 197,Florida Statutes, in the same manner as property taxes are collected. SECTION SIX: The Clerk is hereby directed to record this Resolution, not including the referenced roll, in the Official Records of Collier County. EXECUTIVE SUMMARY Recommendation to adopt a resolution to set the date, time and place for an advertised public hearing where the Board of County Commissioners will adopt special assessments to be collected on the non-ad valorem property tax bill for curbside solid waste collection and disposal services for Fiscal Year 2015 and approve the notification to customers. OBJECTIVE: Set the date, time and place for a public hearing to determine the fees for curbside trash collection services for Fiscal Year (FY) 2015. The Board of County Commissioners (Board) is being asked to approve a statutorily required notification of the hearing that must be mailed, using first class postage, to each property owner. CONSIDERATIONS: Ordinance 2005-54, as amended, established a mandatory program for the collection and disposal of solid waste generated by single and multi family residential units and commercial entities in the unincorporated areas of Collier County. Ordinance 2005-54 provides for the levy and collection of annual special assessments on the non-ad valorem section of the property tax bill for residential solid waste collection and disposal services. Collection of the annual fees on the property tax bill, mailed to property owners of record in November each year, is the most cost effective collection method available to the Board. Collection percentage is approximately 100 percent each year. To use the property tax bill as the collection vehicle, Section 197.3632, F.S. requires the Board to follow the specific process outlined below: • Adopt an intent resolution which sets the time, date and place of an advertised public hearing wherein affected property owners can comment on the fees and the process; • Provide notification of the advertised public hearing by first class mail to each affected property owner; • Conduct the advertised public hearing at the pre-determined time, date and place; • Adopt the fee or fees to be assessed on the tax bill; and, • Adopt a special assessment roll that identifies the rates and affected properties. This roll will be merged with the property tax roll for collection of the assessment at the time property taxes are collected. The attached resolutions and first class notifications (todays requested actions) identify a proposed or recommended fee for the FY2015 budget year and a proposed not-to-exceed fee for the next five years. The cost of the first class notification is approximately $81,228. By using a not-to-exceed rate over a five year period, the Board can potentially avoid the cost of first class notification in the second through fifth years. However, if there is a technological, regulatory or unusual event that would require the Board to establish a fee above the not-to-exceed amount in Fiscal years 2015 through 2019 inclusive, a new first class notification would be required. The MSBU's are identified as Service District I and Service District II. Each MSBU requires an individual resolution and notification. Shown below are the annual fees for trash collection for the past five years, along with the proposed fee for FY2015. This will give the Board a certain amount of flexibility if there is a need to increase landfill tipping fees over the period. FISCAL IMPACT: The fiscal impact of the recommended action is associated with the production and mailing of the first class notices and the legal advertising for the public hearing: Estimated cost of direct mailing $29,628 (Approximately 106,682 notices) Estimated cost of postage $41,600 (Approximately 106,682 notices) Legal advertising $10.000 $81,228 Funds are available in the Mandatory Trash Collection Fund(473). LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.—SRT GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item. RECOMMENDATION: That the Board of County Commissioners approve the resolutions setting the date, time and place for an advertised public hearing to approve a special assessment (non-ad valorem)to be levied against the properties in Solid Waste MSBU Service District I and Solid Waste MSBU Service District II for solid waste collection and disposal services; and approve the first class notice to be sent to all assessable units.
