EXECUTIVE SUMMARY Recommendation to award the Invitation To Bid No. 14-6310 `Burial and Cremation Services"to Garfield Family Funeral&Cremation Services,Inc. Estimated annual fiscal impact is$27,500. OBJECTIVE: To provide cremation and burial services for the indigent community and the unclaimed deceased of Collier County. CONSIDERATIONS: Section 406.50, Florida Statutes requires all Florida counties to provide indigent burial and/or cremation services. On October 27, 2009, the Board adopted Resolution No. 2009-253, updating the administration of the disposition of deceased indigents and unclaimed deceased. Since 2010, one vendor has been providing these services under a Board approved Letter of Understanding that expires on September 14,2014. On July 2, 2014, the Purchasing Department posted the Invitation To Bid (1113). Notifications of this bidding opportunity were sent electronically to twenty qualified vendors. Thirteen vendors downloaded the bid packages,and five vendors submitted bids by the deadline of July 18, 2014. The bid award is based on various unit prices and estimated multipliers. The application of the various unit prices and estimated multipliers results in the following: Vendor Bid Total Garfield Funeral Care $27,500 Muller Thompson $40,455 Naples Funeral Home $43,090 Legacy Options,LLC $43,275 All Cremation Options $34,965 Staff recommends award to the lowest responsive bidder, Garfield Family Funeral&Cremation Services, Inc. Garfield Family Funeral agrees to charge Collier County $400 per adult cremation and no fee for infant and child cremations. The previous vendor charge was $695 per adult cremation and $395 for infant and child cremations. Historically the County spends approximately $49,600 per year for this service.Cremation services under agreement with the new vendor are estimated based on prior experience to save the County approximately $20,800 per year. Cremation services will be requested by a purchase order using the teens of the ITB. FISCAL IMPACT,: Funds for these services are budgeted in the Client Assistance cost center within Housing,Human and Veteran Services' General Fund(001)budget. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. Exhibit I: Scope of Work, Specifications and Response Format As requested by the Department of Housing, Human and Veterans Services Department (hereinafter, the "Division or Department"), the Collier County Board of County Commissioners Purchasing Department (hereinafter, "County") has issued this Invitation to Bid (hereinafter, "ITB")with the intent of obtaining bids from interested and qualified firms in accordance with the terms, conditions and specifications stated or attached. The Vendor, at a minimum, must achieve the requirements of the Scope of Work and specifications stated. The results of this solicitation may be used by other County departments once awarded according to the Board of County Commissioners Purchasing Policy. Brief Description of Purchase The purpose of this solicitation is to obtain a vendor (licensed funeral home pursuant to Florida Statutes 497.380) who will provide, on an annual basis, burial and cremation services, embalming, and other related services for indigents or unclaimed bodies as approved by the Collier County Department of Housing, Human and Veterans Services. Historically, County departments have spent approximately$48,000.00. Background Florida Statute 406 outlines the state's mandate that each county, through their Board of County commissioners, assume financial responsibility for the disposition of unclaimed or indigent bodies that die within the confines of their county. The Collier County Board of County - Commissioners has delegated administration of this function to the Collier County Department of Housing, Human and Veterans Services and in October of 2009 formalized the Policy of the program in Collier County Resolution#09-253. All work under this solicitation must be in accordance with Florida Statutes 406, 470 and Collier County Resolution 09-253. Detailed Scope of Work The awarded vendor shall be responsible for filing, with the appropriate agencies, all of the required documentation pertaining to the service performed, including the following (if needed); 1) Burial Transit Permit; 2) Death Certificate (Uncertified); 3) Cremation Authorization; 4) Social Security Form/Proof of Death; 5) Medical Examiner Authorization to Cremate Copies of all applicable documentation shall be furnished to the Collier County Department of Housing, Human and Veterans Services for each service performed. NOTE: It is the responsibility of the awarded vendor to obtain, file, and supply to Collier County all of the necessary documentation if required. The omission of an item from the above list does not relieve the vendor of this responsibility; further, vendors shall bring such an omission to the attention of the #14-6310 4 Burial&Cremation Services Packet Page-2065- 9/9/2014 16.D.21. Collier County Procurement Services and the Collier County Department of Housing, Human and Veterans Services in a timely fashion. Vendors shall be aware that no services detailed in this specification shall be performed without first receiving authorization from the Collier County Department of Housing, Human and Veterans Services. All Services provided under this quote must comply with all rules, laws, and practices of the State Board of Funeral Directors and Embalmers of Florida; as well as all applicable laws and ordinances of Collier County and the State of Florida. CREMATION SERVICES Collier County desires direct cremation (no viewing, no service). 1. All cremations performed under this solicitation shall be in accordance with Chapter 470 of the Florida Statutes. 2. The awarded vendor shall provide a temporary all-purpose urn, which is suitable for shipping. 3. For those cremations authorized by the Collier County Department of Housing, Human and Veterans Services, where no other legally authorized person can be found, the funeral home will retain a photo of the deceased for their file. The funeral home, after holding the cremated remains for 120 days per f.s.470.0255, and unless otherwise authorized by the Collier County Department of Housing, Human and Veterans Services, will arrange for the remains to be scattered at sea and retain for their file a r� suitable certificate indicating the name, date, and location, etc. of the scattering. FUNERAL HOME SERVICES 1. For the most part, Collier County only provides burial for those bodies the Medical Examiner determines should not be cremated (Fla Admin Code 11G-2.002(3). 2. If it is necessary for Collier County to bury a body locally, the awarded funeral home will coordinate burial at Lake Trafford Memorial Gardens in accordance with Collier County Resolution#09-253. 3. Collier County desires a direct burial (no viewing, no service). 4. Should it be necessary to bury a body outside of Collier County the awarded funeral home will submit the application and coordinate other necessary arrangements with that cemetery. 5. The funeral home service shall consist of preparing the deceased for burial. Embalming should be performed, if required. 6. A "flat-top" casket (pressed wood), meeting the minimum requirements set by area cemeteries, shall be used for all deceased persons processed under this solicitation. 7. An unsealed concrete grave liner is required for all indigent burials. (All "setting fees" shall be included in the quoted prices.) ,^ #14-6310 5 Burial&Cremation Services Packet Page-2066- 9/9/2014 16.D.21. EMBALMING FOR MEDICAL SCHOOLS/FACILITIES 1. Collier County may, on occasion, may authorize that the deceased be prepared for acceptance by a State Medical School or medical facility, i.e., the State Anatomical Board in Miami. 2. The preparation for a medical school or facility shall include embalming. All embalming shall be arterial only, and performed in accordance with Florida Statute 470 and the requirements of the medical school/facility. 3. If requested, it shall be the vendor's responsibility to contact the medical school/facility for its specific requirements. 4. Cost for these services shall be negotiated between the awarded vendor(s) and the school/facility. 5. Invoices for this service and transportation shall be made out to the specific school/facility requesting service. TRANSPORTATION— LOCAL The awarded vendor shall provide all needed local transportation for the deceased; i.e. transport from the hospital or Medical Examiner's office to funeral home and/or crematorium; transport to cemetery at no additional charge. VALUABLES/PERSONAL POSSESSIONS Vendors shall handle all valuables the deceased may have in their possession in the following manner: 1. Personal items (i.e.jewelry) shall be made available to the family of the deceased; if no family is available they are turned over to the Collier County Department of Housing, Human and Veterans Services. 2. Assets such as cash, bank account documents, etc. shall be made available to the Collier County Department of Housing, Human and Veterans Services for probate. DILIGENT SEARCH If the deceased has no known relatives, the Department of Housing, Human and Veterans Services will conduct a reasonable search for same prior to authorizing cremation or burial. The awarded vendor agrees to expedite submission of a free death notice to the local newspaper to assist in the search. SERVICE COORDINATION It shall be the responsibility of the awarded funeral home and/or crematorium vendor to coordinate any necessary arrangements with Lake Trafford Cemetery, other cemeteries, crematorium(s), etc. Award Criteria ITB award criteria is as follows: #14-6310 6 Burial&Cremation Services Packet Page-2067- 9/9/2014 16.D.21. • All questions on the Bid document shall be answered as to price(s), time requirements, and required document submissions. • Award shall be based upon the responses to all questions on the Bid Response Page(s). • Further consideration may include but not be limited to, references, completeness of bid response and past performances on other County bids/projects. • Prices will be read in public exactly as input on the electronic bid response form or written on the manually submitted Bid Response Page(s) at the time of the bid opening; however, should an error in calculations occur whenever unit pricing and price extensions are requested, the unit price shall prevail. Mathematical miscalculations may be corrected by the County to reflect the proper response. • The County's Purchasing Department reserves the right to clarify a vendor's proposal prior to the award of the solicitation. • It is the intent of Collier County to award to the lowest, qualified and responsive vendor(s) in accordance with the following methodology from Attachment 8: Bid Schedule: Vendor(s)with the lowest total from Line 7 "BID TOTAL" will be awarded. • Collier County reserves the right to select one, or more than one suppliers, however, it is the intent to select a primary and secondary vendor. • The contract will be in the form of a standard County Purchase Order. Exhibit II: General Bid Instructions 1. Purpose/Objective As requested by the Collier County departments or divisions identified in Exhibit 1, the Collier County Board of County Commissioners Purchasing Department (hereinafter, the County) has issued this Invitation to Bid (hereinafter, the "ITB", or"Bid")with the sole purpose and intent of obtaining bid responses from interested and qualified firms in accordance with the terms, conditions, and specifications stated and/or attached herein/hereto. The successful vendor will hereinafter be referred to as the "Vendor" All bids must be submitted on the Bid form furnished by the County noted in Attachments 2, 3, 4, 5, 6, and 7 of this ITB. No bid will be considered unless the Bid form is properly signed. Vendor is responsible to read and follow the instructions very carefully, as any misinterpretation or failure to comply with these instructions could lead to the bid submitted as being rejected as non-responsive. 2. Pricing Vendors must provide unit prices using the unit of measured specified by the County. All prices will remain firm for a period of one hundred and eighty (180) calendar days from date of bid opening. After award by the Board of County Commissioners, prices may only be adjusted as outlined in Exhibit I: Term of Contract. 3. Alternate Bid Pricing In the event that alternate pricing is requested, it is an expressed requirement of the bid to provide pricing for all alternates as listed. The omission of a response or a no-bid or lack of a submitted price will be the basis for the rejection of the submitted bid response. All bids responses received without pricing for all alternates as listed will be considered technically non-responsive and will not be considered for award. 4. Equal Product Manufacturer's name, brand name and/or model number are used in these specifications for the purpose of establishing minimum requirements of level of quality, standards of performance and/or design required, and is in no way intended to prohibit the bidding of other manufacturer's items of equal or similar material. An equal or similar product may be bid, provided that the product is found to be equal or similar in quality, standard of performance, design, etc. to the item specified. Where an equal or similar is bid, the Bid must be accompanied with two (2) complete sets of factory information sheets (specifications, brochures, etc.) and test results, if applicable, of unit bid as equal or similar. Equal product samples, if required for evaluation, and at no cost to the County, must be submitted with Bid. Unless otherwise directed in the solicitation, the bid will not be considered unless samples are delivered to specified address by bid due date. Discounts Any discounts or terms must be shown on the Bid form. Such discounts, if any, may be considered in the award of tie bids. In no instance should payment terms less than fifteen (15) calendar days be offered. 6. Exceptions Vendors taking exception to any part or section of these specifications shall indicate such exceptions on a separate sheet entitled "EXCEPTIONS TO SPECIFICATIONS." Failure to indicate any exceptions to the specifications shall be interpreted as the Vendors intent to fully comply with the specifications as written. The County, at its sole discretion, shall determine if the exceptions are material in nature, and if the Vendor's exceptions may be declared grounds for rejection of bid proposal. 7. Addenda The County reserves the right to formally amend and/or clarify the requirements of the bid specifications where it deems necessary. Any such addendum/clarification shall be in writing and shall be distributed electronically to all parties who received the original bid specifications prior to, the deadline for submission of Bids. All changes to this ITB will be conveyed electronically through a notice of addendum or questions and answers to all vendors registered under the applicable commodity code(s) at the time when the original ITB was released, as well as those vendors who downloaded the ITB document. Additionally, all addendums are posted on the Collier County Purchasing Department Online Bidding System website: www.colliergov.net/bid. Before submitting a bid response, please make sure that you have read all, understood clearly and complied completely with any changes stated in the addenda as failure to do so may result in the rejection of your submittal. 8. Bid Submission Collier County prefers bids to be submitted electronically. All electronic bids shall be submitted online via the Collier County Purchasing Department Online Bidding System: www.colliergov.net/bid. If you must submit a paper bid, all paper bids shall be submitted to the County Procurement Director, Collier County Government, Purchasing Department, 3327 Tamiami Trail E, Naples, FL 34112, by the date and time as stated in the Legal Notice. The County assumes no responsibility for bid responses received after the due date and time, or at any office or location other than that specified herein, whether due to mail delays, courier mistakes, mishandling, inclement weather or any other reason. Late bid responses shall be returned unopened, and shall not be considered for award. Paper submission must have one (1) paper copy clearly labeled "Master," and one (1) compact disks (CD's)with one copy of the proposal on each CD in Word, Excel or PDF. List the Solicitation Number and Title on the outside of the box or envelope. All bids sent by courier service must have the bid number and title on the outside of the courier packet. Vendors who wish to receive copies of bids after the bid opening may view and download same from the Collier County Purchasing Department Internet bid site. 9. If the vendor should be of the opinion that the meaning of any part of the Bid Document is �-. doubtful, obscure or contains errors or omissions it should report such opinion to the Procurement Strategist before the bid opening date. Vendors must clearly understand that the only official answer or position of the County will be the one stated on the Collier County Purchasing Department Online Bidding System website. For general questions, please call the referenced Procurement Strategist identified in the Public Notice. 10. Protests Any prospective vendor/proposer who desires to protest any aspect(s) or provision(s)of the solicitation (including the form of the solicitation documents or procedures) shall file their protest with the Procurement Director prior to the time of the bid opening strictly in accordance with the County's then current purchasing ordinance and policies. 11. Rejection and Waiver The County reserves the right to reject any and all bids, to waive defects in the form of bid, also to select the bid that best meets the requirements of the County. Vendors whose bids, past performance or current status do not reflect the capability, integrity or reliability to fully and in good faith perform the requirements denoted may be rejected as non- responsive. Bids that do not meet all necessary requirements of this solicitation or fail to provide all required information, documents or materials may be rejected as non-responsive. 12. Local Vendor Preference (LVP) The County is using the Competitive Sealed Quotation methodology of source selection for this procurement, as authorized by Ordinance Number 2013-69 establishing and adopting the Collier County Purchasing Ordinance. Local business means the vendor has a current Business Tax Receipt issued by the Collier County Tax Collector for at least one year prior to bid or proposal submission to do business within Collier County, and that identifies the business with a permanent physical business address located within the limits of Collier County from which the vendor's staff operates and performs business in an area zoned for the conduct of such business. A Post Office Box or a facility that receives mail, or a non-permanent structure such as a construction trailer, storage shed, or other non-permanent structure shall not be used for the purpose of establishing said physical address. In addition to the foregoing, a vendor shall not be considered a "local business" unless it contributes to the economic development and well-being of Collier County in a verifiable and measurable way. This may include, but not be limited to, the retention and expansion of employment opportunities, support and increase to the County's tax base, and residency of employees and principals of the business within Collier County. Vendors shall affirm in writing their compliance with the foregoing at the time of submitting their bid or proposal to be eligible for consideration as a "local business" under this section. A vendor who misrepresents the Local Preference status of its firm in a proposal or bid submitted to the County will lose the privilege to claim Local Preference status for a period of up to one year. Under this solicitation, bidders desiring to receive local preference will be invited and required to affirmatively state and provide documentation as set forth in the solicitation in support of their #14-6310 10 Burial&Cremation Services Packet Page-2071- 9/9/2014 16.D.21. status as a local business. Any bidder who fails to submit sufficient documentation with their bid offer shall not be granted local preference consideration for the purposes of that specific contract award. Except where federal or state law, or any other funding source, mandates to the contrary, Collier County and its agencies and instrumentalities, will give preference to local businesses in the following manner. Competitive bid (local price match option). Each formal competitive bid solicitation shall clearly identify how the price order of the bids received will be evaluated and determined. When a qualified and responsive, non-local business submits the lowest price bid, and the bid submitted by one or more qualified and responsive local businesses is within ten percent of the price submitted by the non-local business, then the local business with the apparent lowest bid offer (i.e., the lowest local bidder) shall have the opportunity to submit an offer to match the price(s), less one (1) dollar, offered by the overall lowest, qualified and responsive bidder. In such instances, staff shall first verify if the lowest non-local bidder and the lowest local bidder are in fact qualified and responsive bidders. Next, the Purchasing Department shall determine if the lowest local bidder meets the requirements of Fla. Stat. Sec.287.087 (Preferences to businesses with drug-free workplace programs). If the lowest local bidder meets the requirements of Fla. Stat. Sec. 287.087, the Purchasing Department shall invite the lowest local bidder to submit a matching offer, less one (1) dollar, within five (5) business days thereafter. If the lowest local bidder submits an offer that fully matches the lowest bid, less one (1) dollar, from the lowest non-local bidder tendered previously, then award shall be made to the local bidder. If the lowest local bidder declines or is unable to match the lowest non-local bid price(s), then award will be made to the lowest overall qualified and responsive bidder. If the lowest local bidder does not meet the requirement of Fla. Stat. Sec 287.087, and the lowest non-local bidder does, award will be made to the bidder that meets the requirements of the reference state law. Bidder must complete and submit with their bid response the Affidavit for Claiming Status as a Local Business which is included as part of this solicitation. Failure on the part of a Bidder to submit this Affidavit with their bid response will preclude said Bidder from being considered for local preference on this solicitation. A Bidder who misrepresents the Local Preference status of its firm in a bid submitted to the County will lose the privilege to claim Local Preference status for a period of up to one (1)year. The County may, as it deems necessary, conduct discussions with responsible bidders determined to be in contention for being selected for award for the purpose of clarification to assure full understanding of, and responsiveness to solicitation requirements. 13. Immigration Affidavit Certification Statutes and executive orders require employers to abide by the immigration laws of the United States and to employ only individuals who are eligible to work in the United States. The Employment Eligibility Verification System (E-Verify) operated by the Department of Homeland Security (DHS) in partnership with the Social Security Administration (SSA), provides an Internet-based means of verifying employment eligibility of workers in the United States; it is not a substitute for any other employment eligibility verification requirements. Lobbying All firms are hereby placed on NOTICE that the County Commission does not wish to be lobbied either individually or collectively about a project for which a firm has submitted a bid. Firms and their agents are not to contact members of the County Commission for such purposes as meetings of introduction, luncheons, dinners, etc. During the bidding process, from bid opening to final Board approval, no firm or its agent shall contact any other employee of Collier County with the exception of the Purchasing Department. 15. Disclosure of any potential or actual conflict of interest is subject to County staff review and does not in and of itself disqualify a firm from consideration. These disclosures are intended to identify and or preclude conflict of interest situations during contract selection and execution. 3. Vendor Performance Evaluation Collier County has implemented a Vendor Performance Evaluation System for all contracts awarded in excess of$25,000. To this end, vendors will be evaluated on their performance upon completion/termination of agreement. 5. Use of Subcontractors Bidders on any service related project, including construction, must be qualified and directly responsible for 51% or more of the solicitation amount for said work. 6. Deductions for Non-Performance The County reserves the right to deduct a portion of any invoice for goods not delivered, or services not performed in accordance with requirements, including required timeframe. The County may also deduct, or chargeback the Vendor the costs necessary to correct the deficiencies directly related to the Vendor's non-performance. 7. Offer Extended to Other Governmental Entities Collier County encourages and agrees to the successful vendor extending the pricing, terms and conditions of this solicitation or resultant contract to other governmental entities at the discretion of the successful vendor. 8. Environmental Health and Safety All Vendors and Sub vendors performing service for Collier County are required and shall comply with all Occupational Safety and Health Administration (OSHA), State and County Safety and Occupational Health Standards and any other applicable rules and regulations. Vendors and Sub vendors shall be responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site. All firewall penetrations must be protected in order to meet Fire Codes. Collier County Government has authorized OSHA representatives to enter any Collier County facility, property and/or right-of-way for the purpose of inspection of any Vendor's work operations. All new electrical installations shall incorporate NFPA 70E Short Circuit Protective Device Coordination and Arc Flash Studies where relevant as determined by the engineer. Florida Wood Products The Vendor/Contractor agrees to comply with Florida Statute 255.20 to provide lumber, timber and other forest products produced and manufactured in the State of Florida as long as the price, fitness and quality are equal. 10. Public Records Compliance The Vendor/Contractor agrees to comply with the Florida Public Records Law Chapter 119 (including specifically those contractual requirements at F.S. § 119.0701(2) (a)-(d) and (3)), ordinances, codes, rules, regulations and requirements of any governmental agencies. 11. Standards of Conduct The Vendor shall employ people to work on County projects who are neat, clean, well-groomed and courteous. Subject to the American with Disabilities Act, Vendor shall supply competent employees who are physically capable of performing their employment duties. The County may require the Vendor to remove an employee it deems careless, incompetent, insubordinate or otherwise objectionable and whose continued employment on Collier County projects is not in the best interest of the County. 12. Licenses The Vendor is required to possess the correct professional and other licenses, and any other authorizations necessary to perform the required work pursuant to all applicable Federal, State and Local Law, Statute, Ordinances, and rules and regulations of any kind. Additionally, copies of all the required licenses must be submitted with the bid response indicating that the entity bidding, as well as the team assigned to the County account, is properly licensed to perform the activities or work included in the ITB documents. Failure on the part of any vendor to supply this documentation with their bid response may be grounds for deeming vendor non-responsive. A Vendor with an office within Collier County is required to have an occupational license. All State Certified contractors who may need to pull Collier County permits or call in inspections must complete a Collier County Contractor License registration form and submit the required fee. After registering the license/registration will need to be renewed thereafter to remain "active" in Collier County. Protection of Property The Vendor shall ensure that the service is performed in such manner as to not damage any property. In the event damage occurs to any property as a direct result of the Vendor or their Sub vendor in the performance of the required service, the Vendor shall repair/replace, to the County's #14-6310 18 Burial&Cremation Services Packet Page-2079- 9/9/201416.D.21. satisfaction, damaged property at no additional cost to the County. If the damage caused by the Vendor or their Sub vendor has to be repaired/replaced by the County, the cost of such work will be deducted from the monies due the Vendor. 14. Prohibition of Gifts to County Employees No organization or individual shall offer or give, either directly or indirectly, any favor, gift, loan, fee, service or other item of value to any County employee, as set forth in Chapter 112, Part III, Florida Statutes, the current Collier County Ethics Ordinance and County Administrative Procedure 5311. Violation of this provision may result in one or more of the following consequences: a. Prohibition by the individual, firm, and/or any employee of the firm from contact with County staff for a specified period of time; b. Prohibition by the individual and/or firm from doing business with the County for a specified period of time, including but not limited to: submitting bids, RFP, and/or quotes; and, c. immediate termination of any contract held by the individual and/or firm for cause. 15. The County may not accept any additional surcharges (credit card transaction fees) as a result of using the County's credit card for transactions relating to this solicitation. The County will entertain bids clearly stating pricing for standard payment methods. An additional separate discounted price for traditional payments may be provided at the initial bid submittal if it is clearly marked as an "Additional Cash Discount." Upon execution of the Contract and completion of each month's work, payment requests may be submitted to the Project Manager on a monthly basis by the Contractor for services rendered for that prior month. Services beyond sixty (60) days from current monthly invoice will not be considered for payment without prior approval from the Project manager. Any untimely submission of invoices beyond the specified deadline period is subject to non-payment under the legal doctrine of"laches" as untimely submitted. Time shall be deemed of the essence with respect to the timely submission of invoices under this agreement. In instances where the successful contractor may owe debts (including, but not limited to taxes or other fees)to Collier County and the contractor has not satisfied nor made arrangement to satisfy these debts, the County reserves the right to off-set the amount owed to the County by applying the amount owed to the vendor or contractor for services performed of for materials delivered in association with a contract. Collier County reserves the right to withhold and/or reduce an appropriate amount of any payment for work not performed or for unsatisfactory performance of Contractual requirements. 16. Survivability Bids (ITBs/RFPs): The Consultant/ContractorNendor agrees that any Work Order/Purchase Order that extends beyond the expiration date of Solicitation 14-6310 resultant of this solicitation will survive and remain subject to the terms and conditions of that Agreement until the completion or termination of any Work Order/Purchase Order. 17. Insurance Requirements The Vendor shall at its own expense, carry and maintain insurance coverage from responsible companies duly authorized to do business in the State of Florida as set forth in Insurance and Bonding Requirements Attachment of this solicitation. The Vendor shall procure and maintain property insurance upon the entire project, if required, to the full insurable value of the scope of work. The County and the Vendor waive against each other and the County's separate Vendors, Contractors, Design Consultant, Subcontractors agents and employees of each and all of them, all damages covered by property insurance provided herein, except such rights as they may have to the proceeds of such insurance. The Vendor and County shall, where appropriate, require similar waivers of subrogation from the County's separate Vendors, Design Consultants and Subcontractors and shall require each of them to include similar waivers in their contracts. The Vendor shall also notify the County, in a like manner, within twenty-four(24) hours after receipt, of any notices of expiration, cancellation, non-renewal or material change in coverage or limits received by Vendor from its insurer and nothing contained herein shall relieve Vendor of this requirement to provide notice. In the event of a reduction in the aggregate limit of any policy to be provided by Vendor hereunder, Vendor shall immediately take steps to have the aggregate limit reinstated to the full extent permitted under such policy. Should at any time the Vendor not maintain the insurance coverage(s) required herein, the County may terminate the Agreement or at its sole discretion shall be authorized to purchase n such coverage(s) and charge the Vendor for such coverage(s) purchased. If Vendor fails to reimburse the County for such costs within thirty (30) days after demand, the County has the right to offset these costs from any amount due Vendor under this Agreement or any other agreement between the County and Vendor. The County shall be under no obligation to purchase such insurance, nor shall it be responsible for the coverage(s) purchased or the insurance company or companies used. The decision of the County to purchase such insurance coverage(s) shall in no way be construed to be a waiver of any of its rights under the Contract Documents. If the initial or any subsequently issued Certificate of Insurance expires prior to the completion of the scope of work, the Vendor shall furnish to the County renewal or replacement Certificate(s)of Insurance not later than ten (10) calendar days after the expiration date on the certificate. Security and Background Checks If required, Vendor/ Contractor/ Proposer shall be responsible for the costs of providing background checks by the Collier County Facilities Management Department, and drug testing for all employees that shall provide services to the County under this Agreement. This may include, but not be limited to, checking federal, state and local law enforcement records, including a state and FBI fingerprint check, credit reports, education, residence and employment verifications and other related records. Contractor shall be required to maintain records on each employee and make them available to the County for at least four(4)years. 19. For all projects that are conducted within a Collier County Right-of-Way, the Vendor shall provide and erect Traffic Control Devices as prescribed in the current edition of the Manual On Uniform Traffic Control Devices (MUTCD), where applicable on local roadways and as prescribed in the Florida Department of Transportation's Design Standards (DS) on state roadways. These projects shall also comply with Collier County's Maintenance of Traffic Policy, #5807, incorporated herein by reference. Copies are available through the Risk Management and/or Purchasing Departments and are available on-line at colliergov.net/purchasing. The Vendor will be responsible for obtaining copies of all required manuals, MUTCD, FDOT Roadway&Traffic Design Standards Indexes, or other related documents, so to become familiar with their requirements. Strict adherence to the requirements of the Maintenance of Traffic ("MOT") policy will be enforced under this Contract. Debris Vendor shall be responsible for the removal and disposal of all debris from the site and the cleaning of the affected areas. The Vendor shall leave all affected areas as they were prior to beginning work. 21. Direct Material Purchase The County reserves the right to require Vendor to assign some or all of its agreements with material suppliers directly to the County. Any such goods and/or materials purchased by the County pursuant to such an assignment of a material supply agreement shall be referred to as "County Furnished Materials" and the responsibilities of both the County and the Vendor relating to said materials shall be governed by the terms and conditions of this solicitation. Additionally, the County at its sole option may choose to purchase some or all of the goods and/or materials from other suppliers. The need exists to provide a separate, revised policy for the operation of the Gardens to more clearly define the rules and regulations regarding the establishment of a cremation only policy for unclaimed and indigent deceased, which govern the administration and development of Lake Trafford Memorial Gardens. SECTION TWO: Establishment of Rules and Regulations to Govern Administration and Maintenance of Lake Trafford Memorial Gardens A. Lake Trafford Memorial Gardens, a cemetery acquired and maintained by Collier County for the public benefit under authority of Chapter 63-1243, Special Acts of the Florida State Legislature, and as recorded in Plat Book 8, Page 32 through 40 of the Public Records of Collier County, Florida, is subject to the following Rules and Regulations prescribed for the protection of owners' interment rights therein and for the administration, maintenance and development of the"Gardens." B. Rescission of previous Rules and Regulations — All previous Rules and Regulations for Lake Trafford Memorial Gardens are hereby rescinded. SECTION THREE: Scope of Responsibility The Administrative Services Division Administrator or designee shall be responsible for sale of lots, cremation of unclaimed indigent persons, maintenance, monitoring of burial and cremation procedures to ensure compliance with the Rules and Regulations established herein, and general administration and keeping of records concerning Lake Trafford Memorial Gardens. SECTION FOUR: Regulations Pertaining to Interment A. Lots or grave spaces shall be used only for burial of human dead. Only one interment shall be made in a grave(with the exception of interment of mother and infant,or two children in one casket.) 1 Packet Page-2098- 9/9/2014 16.D.21 . 16E4 B. Purchase of lot or grave space shall convey only the right of burial therein, subject to such regulations as may be in force at the time of burial. C. Burials in aboveground vaults shall be prohibited. D. Sites shall be located and staked by Real Property Management or by contract with a private individual, firm or organization if the Administrative Services Division Administrator gives such approval. E. Burial Casket and Liner Requirements: (1) Burial in the Adult Section of the Gardens shall require, at a minimum, a manufactured,cloth covered casket and a metal or concrete liner. (2) Burial of decomposed bodies shall require, at a minimum, a metal, sealed casket similar to the brand name Ziegler and a metal or concrete liner. (3) Burial in the Infant Section of the Gardens shall require, at a minimum, a vault-casket combination, dome-sealed, polyfoam fiber plastic, weather proofed casket; a vault casket combination shall not require an additional liner for interment. (4) All caskets and liners shall be approved by the Administrative Services Division Administrator or designee and no burials other than with approved caskets and liners shall be permitted. (5) Failure to meet these required burial casket and liner requirements will result in having any and all interment procedures delayed until these requirements are satisfied. F. Notice of scheduled funerals must be given to, and an authorization to bury must be obtained from the Administrative Services Division Administrator or designee no less than twenty-four(24)hours before the announced time of the funeral. SECTION FIVE: Indigent Cremation and Burial A. ELIGIBILITY: Any person who expires within the confines of Collier County,whether resident or non- resident, is potentially eligible for cremation or burial. Collier County shall employ the method of cremation for any unclaimed indigent deceased. B. DEFINITIONS: 2 Packet Page-2099- 9/9/2014 16.D.21. 16E4 (I) Unclaimed. A body is considered unclaimed when: (a) The body is unidentified. (b) The body has been identified but no legally authorized person(as defined in FS 406.50)can be found to participate in the fmal disposition of the body. (c) One or more legally authorized persons,having been contacted,will either not claim the body for burial, or will not authorize cremation. (2) Indigent. A deceased is considered indigent when, at the time of death,he or she meets one hundred percent(100%) of the federal poverty level recognized by the Federal Income Guidelines produced by the United States Department of Health and Human Services. C. POLICY: The policy for disposing of bodies at Collier County's expense will be: (1) UNCLAIMED: (a) Veteran. Collier County will provide burial or inurnment at a national cemetery for an eligible veteran in accordance with Florida Statute 406.50,406.51 and C.F.R. 38. (b) If suitable, Collier County will transfer the body to the Anatomical Board or research facility as designated in Florida Statute 406.50. (c) If the body is ineligible for either of the above, and the Medical Examiner's office has not requested otherwise, the Collier County Director of Housing and Human Services, or his/her designee,will authorize cremation. (d) The remains will be held for one hundred-twenty(120)days and, if not claimed by a legally authorized person,will be disposed of by the funeral home in compliance with Florida Statute 497.607(2). (2) INDIGENT CREMATION AND BURIAL: (a) The Administrative Services Division Administrator or designee shall assign burial spaces for those persons based on the policy guidelines set forth in Section C. Those spaces will be made available at the request of the Collier County Housing and Human Services Director or designee. The selection of such spaces by the County shall be final. 3 Packet Page-2100- 9/9/2014 16.D.21. 16E4 (b) The Administrative Services Division Administrator or designee shall be responsible for the opening and closing of gravesites for indigent burials and indigent veteran burials. The burials of indigent and indigent veterans will be in accordance with the request of the Collier County Social Services Director or designee. (c ) A Request for Deed Certificate to Right of Interment form shall be made out for each lot used for burial of an indigent person. The first copy of the Request shall be filed by the Human Services Director, and the second copy with Real Property Management. No Deed Certificate shall be made out with respect to the burial of an indigent person. (d) Veteran. A legally authorized person may request burial or inumment at a national cemetery for an eligible veteran in accordance with Florida Statute 406.50 and C.F.R. 38. Collier County will not provide burial or inurnment locally if eligible for a national cemetery. (e) A legally authorized person may request transfer to the Anatomical Board or research facility as designated in Florida Statute 406.50. (0 A legally authorized person may authorize direct(no viewing, no service) cremation through the County's contracted funeral home(s),and may receive the cremated remains in accordance with Florida Statute. (g) A legally authorized person may claim the body for burial. Collier County will pay only the current contracted amount for cremation toward a direct(no viewing,no service)burial with the contracted funeral home(s). No payments will be made to any party other than the County contracted funeral home(s). (h) Collier County will not provide a funeral service or financial assistance toward a funeral service. Upgrades to the County's arrangements with the contracted funeral home(s)are not permitted. (i) A legally authorized person or next of kin may claim the remains through Collier County's contracted funeral home(s), within one hundred-twenty(120)days and, if not claimed by a legally authorized person or next of kin,the remains will be disposed of by the funeral home in compliance with Florida Statute 497.607 (2). D. PROCEDURES: The Collier County Department of Housing and Human Services(HHS)will be responsible for the implementation of the Indigent Cremation and Burial Program. Procedures detailing the implementation of the program are the responsibility of the HHS Department. (1) Collier County will make all reasonable efforts to gather pertinent information, including name, date of birth, Social Security number, date of death, cause of death,next 4 Packet Page-2101- 9/9/2014 16.D.21. 1bE of kin,financial information,veteran status,willingness of relatives to donate body for research for education and preference for burial or cremation based on the policies as set forth in Sections C(1)and C(2)above. In the matter of Indigent cremation, a family member must be willing to sign an authorization for cremation and disposition for the funeral home(s). (2) Upgrades for caskets,cremation urns, vaults,cemetery plots,or additional funeral services such as viewing and graveside services will not be permitted at County expense. (3) If identification of a body has not been established,cremation shall be delayed a minimum of ten(10)days from the official date of death. If identification of the body has been established and the next of kin has not been found,the body will held for ten (l 0)days from the official date of death and until reasonable efforts to locate next of kin have been exhausted. (4) Burial of Indigent persons will be authorized and performed once next of kin has provided payment to Collier County for the difference of the current cremation fee schedule and the fee schedule for burial services. Collier County Housing and Human Services Department or his/her designee will be responsible for authorizing Indigent Cremation and Burial service. (a) Collier County Housing and Human Services shall coordinate with Real Property Management all interment services at Lake Trafford Memorial Gardens Cemetery required for either the Cremation or Burial of Unclaimed or Indigent deceased. Furthermore,Real Property Management shall confirm burial/disposition arrangements with the contracted funeral home,and/or associated vendors. (5) After disposition of the Unclaimed and Indigent deceased,an itemized statement requesting payment shall be presented to Collier County Housing and Human Services Department by the funeral home providing the service. Collier County shall provide payment to the contracted funeral home according to the rates in effect at the time services were rendered, and included herein,and may be amended from time to time by Resolution of the Board of County Commissioners. SECTION SIX: Veteran Section All veteran gravesites in Lake Trafford Memorial Gardens shall have flat bronze or marble grave markers. These markers will be fastened into a concrete slab the size of 27"x 15" x 4"and securely set flush with turf The maintenance for the Veteran Section will be in accordance to the Maintenance Procedures further explained in Section Nine. SECTION SEVEN: Sale of Lots 5 Packet Page-2102- 9/9/2014 16.D.21. 16E4 - A. Purchase of interment rights shall be from Collier County only. No sales shall be made other than to natural persons, except to funeral homes for immediate use. No resale or transfer of interment rights other than by involuntary operation of law shall be permitted, except that the County shall repurchase by quit claim deed any unused right upon request from the owner thereof for the original price, less recording or other fees, and any other actual determinable expenses. No lot owner shall accept remuneration for the use of his/her lot. No single buyer shall be permitted to purchase lots in number beyond his reasonable anticipated requirements as determined by the County. These provisions are expressly for the provision of any speculation in interment rights. B. Procedures for sale of lots— The Administrative Services Division Administrator or designee shall: (1)Take calls from prospective purchasers. (2) Execute Request for Deed Certificate to Right of Interment and collect purchase price: (a) First copy of Request for Deed Certificate to Right of Interment shall be given to purchaser as a receipt. (b) Second copy of Request for Deed Certificate to Right of Interment shall be retained in Real Property Management's Lake Trafford Cemetery files. (c) Upon execution of a Request for Deed Certificate to Right of Interment by the Administrative Services Division Administrator or designee, a Deed Certificate shall be completed and sent to the Board of County Commissioners' office for execution by the Chairman. Upon execution,the Deed Certificate will be delivered to the Clerk of the Courts for recording. After recording, the Deed Certificate will be mailed by the Administrative Services Division Administrator or designee to the purchaser as soon as practical. A copy of the recorded Deed Certificate will be filed by Real Property Management in the Lake Trafford Cemetery files. (c) When a burial takes place, the date relating to the deceased will be entered into the "Record of Interment" section of the Request for Deed Certificate to Right of Interment. Cross-index cards by deceased names and Deed Certificate numbers will be completed and filed. (d) Arrangement for burials on privately-owned lots would be made through funeral homes, which provide the site preparation crews. 6 Packet Page-2103- 9/9/201416.D.21. 16E4 .1 C. Proceeds from Sale of Lots (1) Sales price of lots shall be as determined by resolution of the Board of County Commissioners. (2)Full payment for grave spaces shall be made in cash or by check. (3) Proceeds from sale shall be transmitted to the Finance Department, and a receipt therefore shall be obtained for the Real Property Management's Lake Trafford Cemetery files. (4) The owner of interment rights in any unused lot or group of unused lots may make application to the Administrative Services Division Administrator or designee for a return of the purchase price for such lot or lots, less recording fees and any other determinable actual cost. Upon receipt of such a request, the Administrative Services Division Administrator or designee shall have the owner execute a quit claim deed for the lot or lots in favor of Collier County, and give the owners in exchange thereof a receipt specifying the amount of refund to be payable upon acceptance of the quit claim deed. Real Property Management will secure a refund check from Collier County's Finance Department and mail to the owner at the address shown on the quit claim deed. (5) The proceeds from the sale of interment spaces shall be used to help defray expenses of development, administration and maintenance of the Gardens. All such funds received over and above such expenses may be deposited in a trust fund on a yearly basis. Such trust fund, when it shall become large enough that there is sufficient income for the purpose, shall constitute a perpetual care fund for further development and maintenance of the Gardens. D. Approved Documentary Forms - the forms listed below are approved for use by the Administrative Services Division Administrator or designee in accordance with this policy. (I) Request for Deed Certificate for Right of Interment with Rules &Regulations on reverse side. (2) Deed Certificate. (3) Florida Department of Revenue, Return for Transfers of Interest in Florida Real Property. SECTION EIGHT: Grave Markers 7 Packet Page-2104- 9/9/2014 16.D.21. 16E4 A. In order to preserve uniformity, grave markers shall be approved by the Administrative Services Division Administrator or designee. The Administrative Services Division Administrator shall have the right to change gravesite requirements when deemed necessary. B. Grave memorials shall be set on the allocated grave space only. No memorial may be set to embrace two or more grave spaces unless first approved in writing by the Administrative Services Division Administrator. C. Only flat bronze or marble tablets, set flush with the turf, may be used as grave markers. The Administrative Services Division Administrator, prior to the delivery of the markers to the Gardens,must approve any other grave marker types. D. The Administrative Services Division Administrator or designee shall have the right to remove any and all grave markers, grave memorials or personal property placed on a grave space that is not in accordance with this governing policy. SECTION NINE: Maintenance Procedures A. Grass shall be mowed and shrubs and bushes trimmed as needed. B. Grounds shall be policed and trash removed when accumulations become noticeable. C. Graves shall be tended and dressed as required; fill shall be added to maintain ground level. D. Seed and fertilizer shall be used as needed to maintain grounds. E. Gardens may be maintained(to include duties of caretaker)by Collier County's Parks & Recreation Department or Facilities Management Department, or by contract with a private individual, firm, or organization if the Administrative Services Division Administrator gives such approval. F. The cost of work done at the Gardens shall be budgeted as a separate section of the budget. SECTION TEN: Other Appurtenances A. Enclosures of any nature, such as fences, arches, hedge or ditch around a lot or group of lots are prohibited. Grave mounds are also strictly prohibited. B. No trees, plants or shrubs shall be planted, pruned or removed except with the prior written approval of the Administrative Services Division Administrator, or designee. 8 Packet Page-2105- 9/9/2014 16.D.21. 16E4 SECTION ELEVEN: Conduct Any activities within the confines of the Gardens, which are conducted in disregard of its solemnity, including but not limited to, drunkenness, hunting, picnicking, or the disposition of trash or litter thereon, are strictly prohibited, and offenders shall not be permitted on the premises and may be subject to prosecution. SECTION TWELVE: Reservation of Authority This Policy shall be amended or rescinded only by the authority of the Board of County Commissioners.
