Agenda 09/09/2014 Item #16D14 9/9/201416.D.14. EXECUTIVE SUMMARY Recommendation to adopt a Resolution authorizing the County Manager or Designee to sign all documents necessary to report information on wetslips to the Florida Department of Environmental Protection and to take all actions necessary to ensure timely payment of invoices for related sovereignty submerged land lease fees. OBJECTIVE: To comply with the terms of submerged land leases with the Florida Department of Environmental Protection(FDEP)in an efficient and cost-effective manner. CONSIDERATIONS:FDEP requires a Sovereignty Submerged Land Lease Agreement for the public to use state owned submerged lands for docking facilities. The Board has approved Sovereignty Submerged Land Lease Agreement with the FDEP for Caxambas Pass Park, Goodland Park, and Cocohatchee River Park. Each Sovereignty Submerged Land Lease Agreement requires a set annual lease fee as well as a wet slip rental supplemental payment in accordance with the fee formula established by Rule 18-21.003, Florida Administrative Code. The following three documents are required to be submitted with the annual lease fee and supplemental lease fee: 1) Wet Slip Information Form; 2) Gross Income Reporting Form;and 3) Certification(requires signature). Historically, staff has presented invoices, completed forms and certifications to the Board. The process of receiving Board approval delays submittal of the required Reports and payments to the FDEP which subjects the County to a 12% late payment fee. Recently, the County was charged a 12% late payment fee for a late invoice. To avoid delays, this item requests Board adoption of a Resolution that will authorize the County Manager or designee to sign all documents necessary to report wet slip information to FDEP and take all actions necessary to ensure timely payment of invoices for lease fees. Lease amounts and typical annual supplemental payments are as follows: Name of Park Annual Lease Amount Typical Annual Lease Term Ends Supplemental Payment Caxambas $1,753.73 Varies- Approximately April 6,2018 $37 Goodland $8,642.53 Varies- Approximately May 5,2015 $2,300 Cocohatchee $3,460.63 Varies- Approximately June 24,2015 $260 Staff will continue to submit future Sovereignty Submerged Land Lease Agreements and renewals to the Board for approval.A sample invoice and reporting documents are attached as back-up to this item. /' FISCAL IMPACT:Funds are allocated annually within the operating budgets in General Fund(001). LEGAL CONSIDERATIONS: Section 125.74(2), Florida Statutes, grants the County Manager powers and duties which are administrative or ministerial powers. The proposed administrative process is consistent with Section 125.74(2). Accordingly, this item is approved as to form and legality and requires a majority vote for Board action.-JAB GROWTH MANAGEMENT IMPACT:No Growth Management Impact is associated with this action. RECOMMENDATION: That the Board of County Commissioners adopts a Resolution authorizing the County Manager or Designee to sign all documents necessary to report wet slip information to FDEP and take all actions necessary to ensure timely payment of invoices for sovereignty submerged lands lease fees.
