EXECUTIVE SUMMARY
Recommendation to review the traffic analysis study and affirm staff's findings in response to a
public petition request heard on February 13, 2018, under Agenda Item 6A, requesting that a wall
or guardrail be installed on a section of Rattlesnake Hammock Road (just east of US41 on the north
side of the roadway) to prevent cars from leaving the road.
OBJECTIVE: To present the findings addressing the public petition made by Mark Hetzner for a
guardrail or wall installation at 4900 Biscayne Drive, Naples, Florida.
CONSIDERATIONS: On February 13, 2018 the Board of County Commissioners (Board) heard a
Public Petition from Mr. Hetzner requesting a wall or guardrail along Rattlesnake Hammock Rd.
Mr. Hetzner first contacted the County on March 12, 2017, requesting a wall installation along the
Biscayne Condominium property line that borders Rattlesnake Hammock Road. Engineering safety staff
performed a field investigation and conducted a traffic study which included crash data analysis. The
initial findings were that the roadway conditions and signage comply with current engineering standards
and practices, and the eight crashes occurring between 2012 and 2017 had not impacted the property’s
fence line. On March 16, 2017, staff provided a response (Exhibit 1) to Mr. Hetzner through the Agency
Incident Management System (AIMS, #6501) detailing the results of the engineering study and also
advising him that the County could only evaluate the benefits of a “wall assembly” during the design
stage of a capital improvement project. It was suggested that if the homeowners association wished to
construct the wall, it would need to seek the proper county permits and fund the wall construction.
Requests for construction of walls are received very frequently, but it has been our practice due to budget
and funding constraints to consider, when warranted, only those walls to be constructed as part of a
capital improvement project.
Mr. Hetzner sent a second request on April 12, 2017, asking for an explanation of why “county codes and
engineering” require “guardrails” at some locations and not others. He included a collection of photos
showing pedestrian and bicyclist pipe handrail installations along Rattlesnake Hammock Road, which he
concluded were “protecting property.” On April 13, 2017, in-house engineering design staff performed a
second site evaluation and a response (Exhibit 2) was sent to Mr. Hetzner on April 18, 2017. The second
evaluation supported the findings of the initial investigation and explained that a pedestrian and bicyclist
handrail did not meet the criteria to be a motor vehicle safety barriers. Furthermore, it pointed out that
according to accepted standards contained in FDOT Manual of Uniform Minimum Standards for Design,
Construction and Maintenance for Streets and Highways (MUMS) the fence line of the Biscayne
Condominium was outside of the zone which would require the installation of a protective barrier against
errant vehicles leaving the roadway.
A police report documented a single-vehicle crash that resulted in property damages, mentioned by Mr.
Hetzner in his petition, that occurred within the curvature of Rattlesnake Hammock Road on February 26,
2017. The report stated that the driver swerved to avoid an animal and his vehicle left the roadway, hitting
the fence line at the Biscayne Bay Condominiums. The cause of this crash in February 2017 was not
caused by roadway conditions.
Mr. Hetzner’s third request for further action was received on August 28, 2017 after an accident in the
vicinity of the condominiums. The police report showed that on August 22, 2017, a vehicle traveling at
excessive speed left the roadway and crashed into the fence line. Staff did an onsite evaluation and
verified that the roadway was continuing to conform to engineering standards. On August 31, 2017, staff
responded through AIMS 6730, (Exhibit 3) informing Mr. Hetzner of the findings.

Guardrail installation within the clear zone at this location would present a safety hazard for pedestrians.
In December 2017, the Traffic Operations Section installed chevron signs along the curve and posted an
advisory speed of 35 MPH to reinforce drivers’ attention to the roadway.
FISCAL IMPACT: There is no Fiscal Impact associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. Please note that there is an element of
subjectivity in when and where to place guardrails, with an improperly placed guardrail potentially
causing more harm than good. -JAK
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary.
RECOMMENDATION: to affirm staff's professional engineer's recommendation that no further
immediate action be taken at this time and direct staff to continue to observe the conditions and traffic
operations along this roadway.

I do have a concern regarding Public Safety. I own a condominium located near the corner of Rattlesnake Hammock Road and the East Trail.
The address of the condominium is 4900 Biscayne Drive. Our parking lot is located on the right side of Rattlesnake Hammock road ... just before you
get to the traffic light at 41 where the 7-11 is located.
Several years ago, when RHR was widened - the country purchased a few feet of our parking lot and we were paid for that by the county. Our
condo association used the money to put up a wooden fence along RHR. Since that time, two cars have run off of RHR and landed in our Parking
lot. The second accident was just last week. It has only
been by the grace of God that none of our residents were injured and only minor property damage occurred. One of the members of the Biscayne
Condo Board of directors told me this is an ongoing hazard and I agree with him that this is a legitimate public safely issue.
Would you be able to notify the Road Dept or the safety dept. and try to determine if a concrete wall could be built along RHR along the boundary
of our property up to the fence where there is an entrance to a church behind the 7-11 or at least a retention wall so that cars that misjudge the
curve coming up to the light will NOT wind up in our parking lot. This has happened twice already. Does it need to happen again before something
can be done ?
Please let me know if Collier County can do anything to make this area safer for our residents and for members of the public. It should also be
noted that this corner is less than 2 blocks from a CAT bus stop on Rattlesnake Hammock Road.

provided the following: Below is the excerpt from Mr.
McCleary's email to Mr. Hetzner where I indicated the
following: “However, staff did note the apparent steepness
of the slope behind the sidewalk. There are specific
locations that need further evaluation to determine if the
existing slope meets the design and the current standards
for Pedestrian and Bicyclist Railing. Staff will gather
topographic field data and compare against the design and
current standards. If the design or current standards are not
met in these locations, action will be taken to bring the
location into compliance.” I have completed the review of
the field conditions and apparent steepness, the as built
plans and current design standards. The slope is not steeper
than 2:1 and therefore meets the acceptable criterion when
the project was designed and as well as today’s design
standards. No further action is warranted regarding
placement of Pedestrian and Bicyclist Railing in this location
along Rattlesnake Hammock,

indicates a significant drop off behind the sidewalk to the
drainage swale. The Pedestrian and Bicyclist Railing was
installed to protect people from this drop off and not the

and Bicyclist Railings are not designed to, nor are they
sufficient to protect property. The purpose of a guardrail
according to various engineering sources is: A guardrail is,
first and foremost, a safety barrier intended to shield a
motorist from roadside hazards who has left the roadway.
The guardrail is designed to protect the motorist by creating
a barrier between a roadside obstacle (a fixed object that
cannot be moved or a body of water). Should a wayward
motorist come in contact with a roadside obstacle the
severity of harm to the motorist and others in the vehicle
could be very significant. The engineering guidelines for
guardrail placement come from multiple sources, including,
but not limited to the Collier County Land Development
Code (LDC), the “Florida Green Book”, the Florida
Department of Transportation (FDOT) Design Standards and
the FDOT Plans Preparation Manual. The engineering study
previously prepared by staff indicated that a guardrail was
not warranted in the location of the Biscayne
Condominiums. Based upon a site visit on April 13, 2017 and
review of the engineering guidelines for guardrail
placement, I concur with the prior conclusion provided by
staff. The minimum clear zone (obstacle free) is minimally
four feet from the face of curb. For this portion of
Rattlesnake Hammock Road the edge of sidewalk is actually
six feet which exceeds the clear zone requirement. Since the
four foot clear zone is obstacle free, no guardrail is required.
However, staff did note the apparent steepness of the slope
behind the sidewalk. There are specific locations that need
further evaluation to determine if the existing slope meets
the design and the current standards for Pedestrian and
Bicyclist Railing. Staff will gather topographic field data and
compare against the design and current standards. If the
design or current standards are not met in these locations,

Pedestrian and Bicyclist Railing are designed to protect the

Collier County right of way and is on private property. The

determining factor when designing guardrail. The County
previously indicated the process for permitting a “wall
assembly” privately since the fence is on private property
and the land owner has the right to apply for this type of

Mr. Hetzner, Thank you for contacting Collier County
regarding your concerns. Traffic Operations staff performed
an engineering study along Rattlesnake Hammock Road
near your community’s property line . This study included a
review of the reported crashes at this location. Prior to the
incident that you cited, the review identified eight
additional reported crashes since 2012, of which five related
to “left turn” movements in the median, two were “side
swipe” in the same direction and a final incident that
occurred in the median. This review of the reported crashes
since 2012 did not indicate any further crashes that involved
the fence line. Staff further reviewed the site conditions and
verified that the engineering standards, road condition and
signage were all compliant with current engineering
practices. Driver behavior was also monitored and based on
this review, staff requested that the Collier County Sheriff’s
office provide targeted enforcement. Your email also
indicated an interest in a concrete barrier wall. Collier
County has a precedence to only evaluate the engineering
merits of “wall assemblies” during the design stage of
capital improvement projects and not after the fact. The
proximity of the parking lot in relation to the roadway was a
known and existing condition to the Community’s residents.
If your community continues to have interest in further
evaluation, exploration and funding of any “wall assembly”
privately, I urge you to follow the proper permitting process

existing slope meets the design and the current standards for Pedestrian and
Bicyclist Railing. Staff will gather topographic field data and compare against the
design and current standards. If the design or current standards are not met in
these locations, action will be taken to bring the location into compliance.
Pedestrian and Bicyclist Railing are designed to protect the pedestrian and
bicyclist (people) from going off a drop off. Guardrail is to protect the motorists
(people) from hitting a roadside obstacle within the clear zone. In laymen’s terms
Guardrail and Pedestrian and Bicyclists Railing are primarily designed to protect
people, not property.
The fence that has been previously damaged and reported is outside the Collier
County right of way and is on private property. The fence is definitely outside the
clear zone which is a determining factor when designing guardrail. The County
previously indicated the process for permitting a “wall assembly” privately since
the fence is on private property and the land owner has the right to apply for this
type of permit.

I know that the Road Dept. and the engineers have all done studies to show that Rattlesnake Hammock road does NOT need any Guard rails.....
but I think have a right to question the accuracy of their so-called studies and reports. Last week - yet another car flew off of Rattlesnake
Hammock road and into our Parking lot at 4900 Biscayne Dr.
Hitting our dumpster and knocking it across the parking lot
- damaging multiple vehicles that were parked there. I was told that the driver or a passenger in the car was taken by ambulance to the
hospital.
This is the 2nd car that flew into our parking lot in 3 months and about 4th or 5th car over the past 3 or 4 years.
Does the county plan to wait until a Driver or one of our residents is Killed before something is done about this ?
How much can a guard rail cost anyway ?
also - this creates a lot of extra work for our condo board...which is already over worked. I am a board member of Biscayne Condominiums and
I will have to contact the insurance company...somehow scan the police report and send that to them. Take photos of the damage. Call
several fence repair companies and send the bids to the insurance companies and then they will find a way to delay for 2 or 3 weeks and then
finally - they will pay us for the damages.
It is my opinion that the county is being negligent in addressing this problem which has been clearly identified and documented. I no longer
trust the accuracy of the engineering studies nor the reports from the county road dept. I think My reasons are obvious.
I would like you to do something about this continuing problem.

Dear Mr. Hetzner, Thank you for expressing your
concerns in your email dated August 28, 2017. In
light of the most recent accidents mentioned in the
email, an inquiry into two crash data systems and
correspondence with the Sheriff’s Office for this
general area noted seven (7) reported crashes from
2012 to present. Two of the reported crashes related
to the property in question and are noted below: 16
Aug ’17 Single vehicle crash on curve that hit palms.
No indication on the police report regarding damage
to the fence. Driver indicated that the fell asleep at
the wheel. 26 Feb ’17 The crash report noted that the
vehicle hit and damaged the fence line. The report
states that the driver swerved to avoid an animal in
the roadway. Both of these reported crashes were
related to the inability of the drivers to control their
vehicles. Staff conducted a site visit on the Aug. 31 to
again evaluate the roadway conditions. Recent
damage to the fence line was acknowledged. Staff
further reviewed our previous correspondence and
verified that the roadway in question continues to
conform to current engineering standards and that
all traffic control signage was compliant with current
local, state and federal mandates. With these factors
in mind and taking into account the two occurrences
of errant driver behavior, our professional opinion
remains that this situation cannot be remedied
though “engineering” and that “enforcement” and
“education” remain the most valid courses of action.
