EXECUTIVE SUMMARY Recommendation to award bid number 14-6318, Immokalee Road Chloramine Booster Station, in the amount of$595,127, to Mitchell & Stark Construction Company, Inc., and approve conveyance of Collier County-owned property to the Collier County Water-Sewer District at an estimated cost not to exceed $75 for a proposed Chloramine Booster Station,Project 70103. OBJECTIVE: Provide reliable, compliant, potable water service to Collier County Water-Sewer District (CCWSD)customers within the Northeast service area. CONSIDERATIONS: The proposed scope of work under Project No. 70103, "Northeast Service Area integration" is consistent with the Capital Improvement Program (CIP) contained in the Water, Wastewater, Irrigation Quality Water, and Bulk Potable Water User Rate Study approved by the Board of County Commissioners (Board) on June 10, 2014, as Agenda Item 11C. Funding for project 70103 is available in, and is consistent with,the FY2015 CIP Budget. In anticipation of serving future CCWSD water customers within the Northeast service area, and to not be an impediment to growth, the CCWSD plans to build a chloramine booster station adjacent to its 36-inch water main along Immokalee Road. This facility will benefit the Northeast service area by ensuring that potable water in the extremity of the CCWSD remains in compliance. The subject property is located near the intersection of Immokalee Road and 4th Street NE (see Attachment 1). The Transportation Department, the Public Utilities Division, and the County Attorney's Office reviewed and approved the Revocable Temporary License and Release of Deed Restrictions (see Attachments 2 and 3). On October 14, 2014, under Agenda Item 16C3, the Board approved a work order to Haskins Inc., to pressure test the existing 36-inch water transmission main along Immokalee Road from Quarry Drive to 39th Avenue NE. This main is proposed to provide water to the Northeast service area. Evaluations, based on water flow modeling and water age, have determined that water quality would benefit from rechlorination of the water in this pipeline. This project includes the installation of a cloramine (chlorine/ammonia) station to automatically increase the total chlorine and/or the free ammonia in the pipeline to respond to changing water quality and demand. The work includes installation of piping and related components; separate chemical containment rooms for liquid bleach and liquid ammonia; a dechlorination tank; flow metering and chemical injection facilities; an access driveway; and fencing to secure the area. Bid number 14-6318 was advertised on July 9, 2014, with 1,982 notices sent to vendors that provided the described services. Ninety-three prospective bidders downloaded plans and specifications. On August 15, 2014, sealed bids for the construction of this project were opened. The five bids received are summarized below. VENDOR BID Mitchell & Stark Construction Company, Inc. $595.127.00 Florida Design Drilling Corp. $612.612.00 Douglas N. Higgins,Inc. $656,680.00 Quality Enterprises USA, Inc. $665,782.10 D. B. Construction Services, Inc. $753,000.00 Staff and local engineering consultant, URS Corporation, determined the lowest bid to be fair and reasonable and recommends awarding the project to Mitchell & Stark Construction Company, Inc., the lowest, responsive and qualified vendor. The bid received was 16 percent less than the engineer's cost Packet Page-1526- 12/9/2014 16.C.3. opinion, including allowance. Mitchell and Stark Construction Company, Inc., has a satisfactory performance and warranty record on previous, similar water utility-related projects. The Purchasing Department concluded the bid was competitive and representative of market conditions. The bid tabulation, bid analysis chart, engineer's recommendation letter and contract are attached (Attachments 4, 5, 6, and 7, respectively). The bid specifications informed the bidders there may be unforeseen conditions associated with the project. The total project cost incorporates an allowance in the amount of$40,000 that includes, but is not limited to, unknown site conditions, additional support equipment, personnel time and/or replacement materials as determined by staff that may be required during construction. The price for any additional work shall be negotiated prior to commencement in accordance with the county's Purchasing Ordinance and the terms of the agreement. FISCAL IMPACT: Funding is available in, and is consistent with, the FY2015 Capital Budget approved by the Board on September 18, 2014. The source of funding is the Water User Fee Fund (412). Recording costs will not exceed $75. The table below reflects the operating budget impact of the completed project, based on an estimated useful life of 20 years. The operating funding source will be the Operating User Fee Fund (408). LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.—SRT GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. RECOMMENDATION: That the Board of County Commissioners, (1) acting as Trustee, approve the Release of Deed Restrictions; (2) approve the Revocable Temporary License, authorize the Chairman to execute said documents, and direct the County Manager or his designee to follow all closing procedures and record said documents in the Public Records of Collier County, Florida; and, (3) as Ex-officio the Governing Board of the Collier County Water-Sewer District, award Contract 14-6318 to Mitchell & Stark Construction Co. Inc., in the amount of$595,127, which includes an allowance in the amount of $40,000 for unforeseen conditions, and authorize the Chairman to sign the attached contract after final review by the County Attorney's Office. Grantee shall be solely responsible for all maintenance and risk of loss associated with the Chloramine Booster Station and associated telemetry equipment. The Grantee acknowledges Grantee's liability to the extent provided and allowed under Section 768.28, Florida Statutes. Grantee further agrees that, to the extent provided and allowed under Section 768.28, Florida Statutes, it shall, at the Grantee's cost, repair any damage caused to Grantors' property as a result of Grantee's exercise of its rights hereunder. The Chloramine Booster Station Area shall at no time be obstructed by any object which would in any manner, interfere with the purposes of this License. Grantee shall have the right, but not the obligation, to improve the Chloramine Booster Station Area as determined by Grantee in order to ensure the full enjoyment of the rights granted to Grantee herein. The following bids were received on August 15, 2014: Bidder Amount Mitchell & Stark Construction Co., Inc. $595,127.00 Florida Design Drilling Corporation $612,612.00 Douglas N. Higgins, Inc. $656,680.00 Quality Enterprises USA, Inc. $665,782.10 D. B. Construction Services, Inc. $753,000.00 The apparent low bidder is Mitchell and Stark with a bid of $595,127. A review of the information provided by the bidder indicates that they have successfully completed many similar projects throughout the area including projects with Collier County Utilities has specific experience with the Contractor. The bid package and subsequent addendum require that Mitchell and Stark employ and integrator that has specific experience with the Collier County system, including three specifically listed by Collier County. Mitchell and Start were contacted by Collier County and indicated that they would utilize "Rocha Controls", a firm that was specifically listed as acceptable. The Florida Department of Business and Professional Regulation's website was used to determine the status of the low bidder's license. Mitchell & Starks General Contractor license is current/active and no complaints are on file. Based on a review of the information provided, we recommend award to the apparent low bidder, Mitchell and Stark Construction Co., Inc., in the amount of $595,127.
