Agenda 07/08/2014 Item #16K 97/8/2014 16.K.9. EXECUTIVE SUMMARY Recommendation to formally and expressly accept the conveyance of right -of -way for Collier Boulevard Extension. Fiscal Impact: None. OBJECTIVE: To formally and expressly accept the conveyance by warranty deed of right -of- way within which the Collier Boulevard northerly extension will be constructed. CONSIDERATIONS: It was recently discovered that there was never any express acceptance of that portion of the Collier Boulevard Extension right -of -way which was conveyed to Collier County via warranty deed recorded in OR Book 4413, Page 3834, and re- recorded in OR Book 5027, Page 1905. Approval of this recommendation will remedy that oversight. FISCAL IMPACT: There is no fiscal impact associated with this recommendation. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with the approval of this agenda item. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for approval. ERP RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida, formally and expressly accept the conveyance by warranty deed of right -of -way within which the Collier Boulevard northerly extension will be constructed. RESOLUTION NO. 2014- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, EXPRESSLY ACCEPTING THE ROAD RIGHT OF WAY REQUIRED FOR THE NORTHERLY EXTENSION OF COLLIER BOULEVARD NORTH OF IMMOKALEE ROAD (ALSO KNOWN AS "BROKEN BACK ROAD ") WHICH WAS CONVEYED TO THE COUNTY VIA WARRANTY DEED RECORDED IN THE OFFICIAL RECORDS OF COLLIER COUNTY RECORDED AT OR BOOK 5027, PAGE 1905, AND ACCEPTING MAINTENANCE RESPONSIBILITY FOR THE ROADWAY AND DRAINAGE IMPROVEMENTS. WHEREAS, the ordinances creating the Heritage Bay and Tree Farm PUDs both require the conveyance of right -of -way to Collier County to allow for construction of the Collier Boulevard extension north of Immokalee Road over the alignment historically known as "Broken Back Road;" and WHEREAS, a Warranty Deed for the right -of -way required from the Tree Farm PUD was recorded in the public records on December 16, 2008 in OR Book 4413, Page 3834, et seq., and later re- recorded in the public records on April 16, 2014, in OR Book 5027, Page 1905, et seq., with the Grantor being Timothy G. Hains, as Trustee under a trust agreement dated August 24, 2004, known as the Tree Farm Land Trust, and with the Grantee being Collier County, a political subdivision of the State of Florida; and WHEREAS, by adoption of this Resolution the Board wishes to formally and expressly accept the conveyance of the road right -of -way and the maintenance of the roadway and drainage improvements constructed therein. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the lands conveyed to Collier County for road right -of -way via Warranty Deed recorded in O.R. Book 5027, Page 1905, are hereby formally and expressly accepted, as are the maintenance responsibilities for the roadway and drainage improvements constructed therein.
