EXECUTIVE SUMMARY Recommendation to authorize a budget amendment in the amount of $2,800,000 to recognize funding from a litigated settlement agreement and appropriate these funds into designated, programmed public utility system capital projects. OBJECTIVE: Fund the design and construction of projects to remain in compliance and meet customer demand. CONSIDERATIONS: In 2013, $4,500,000 was received in a settlement agreement to recover damages incurred as a result of the raw water transmission pipeline failure at the South Reverse Osmosis Raw Water Wellfield. These funds were not included in the FY2014 budget and therefore, a budget amendment is needed to recognize a portion of the settlement and appropriate proceeds into designated capital project funds. Proposed distribution system work includes the design, construction, and inspection of replacement cast/ductile iron and asbestos concrete water mains and appurtenances to replace infrastructure reaching the end of its useful life. Areas of planned construction include Naples Manor, Bay Colony Shores, and Bay Villas. The proposed scope of work for Project No. 71010, "Distribution System Technical Support," is consistent with the 2010 Water Capital Improvement Project (CIP) Update, page 3 of 4, line 90, as identified in the 2011 User Fee Rate Study. Proposed treatment plant work includes design and construction to replacement existing piping and valving on the lime softening filters, and replacement of the motor and electrical controls on reactor tank No. 2. The proposed scope of work for Project No. 71065, "South County Water Treatment Plant Technical Support," is consistent with the 2010 Water Capital Improvement Project (CIP) Update, page 2 of 4, line 75, as identified in the 2011 User Fee Rate Study. Future procurement activities utilizing these funds will occur separately in accordance with the Purchasing Ordinance. FISCAL IMPACT: The source of these funds is the Water User Fee Fund (412). A budget amendment is needed to recognize a portion of the settlement into Project No. 71010, Distribution System Technical Support in the amount of $2,250,000 and $550,000 into Project No. 71065, South County Regional Water Treatment Plant Technical Support. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval. —SRT GROWTH MANAGEMENT IMPACT: These projects meet current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. RECOMMENDATION: That the Board of County Commissioners, Ex- officio the Governing Board of the Collier County Water -Sewer District, approve a budget amendment in the amount of $2,800,000 and appropriate revenue into Project No. 71010, "Distribution System Technical Support," and Project No. 71065, "South County Regional Water Treatment Plant Technical Support," in the amounts of $2,250,000 and $550,000, respectively.
