EXECUTIVE SUMMARY
Recommendation to approve a Mediated Settlement Agreement and Stipulated Final
Judgment in the amount of $129,278.63 for the acquisition of Parcel 206DAME in the
lawsuit styled Collier County, Florida v. John D. Lawrence, et al., Case No. 11- 3207 -CA
(Outfalls 3 and 4/LASIP Project 951101). (Fiscal Impact: $122,328.63)
OBJECTIVE: That the Board approves a Mediated Settlement Agreement and Stipulated Final
Judgment for full and final compensation to be paid for the acquisition of Parce1206DAME in
the Lawsuit styled Collier County, Florida v. John D. Lawrence, et al., Case No. 12 -CA -1828
(Outfalls 3 and 4/LASIP Project #51101).
CONSIDERATIONS: The County acquired the subject property by entry of an Order of Taking
on March 3, 2012 and subsequently depositing the amount of $8,300.00 into the Court Registry.
The taking of Parcel 206DAME was acquired from Myrtle Chase, LLC. Going into mediation,
Respondent was claiming $317,600.00, which included 20% damage ($290,000.00) to the
remainder resulting from the establishing of a County maintenance road bisecting Respondent's
parent tract. The County and Respondent negotiated a mediated settlement of $85,000.00 for full
compensation including statutory interest, all claims related to real estate and business damages.
The parties agreed to the statutory attorney's fees and expert fees totaling $44,278.63.
In addition, the County agreed to mitigate some concerns that the access road invited trespassers
by constructing a chain link fence and gate at the entrance of the maintenance road and has
agreed to allow the property owner to replace the chain link fence over the bridge with a
guardrail at the time they wish to develop the property. The estimated cost for the gate and a
pennitis $1,350.
Attached are the Mediated Settlement Agreement and Stipulated Final Judgment providing for
the above - stated funds.
FISCAL IMPACT: Funds in the amount of $122,328.63 are available in the Stormwater US 41
Ditch/Naples Manor Canal/LASIP Project ( 451101). Source of funds is ad valorem. There is no
incremental maintenance cost associated with this action.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. - ERP
RECOMMENDATION: That the Board of County Commissioners approves the Mediated
Settlement Agreement and Stipulated Final Judgment, and approves the expenditure and
disbursement of funds as stated.

THIS CAUSE. having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent,
MYRnE CHASE, LLC, by and through its undersigned counsel, for entry of a Final Judgment
as to Parcel 206DAME for Project 68056, and it appearing to the Court that the parties are
authorized to make such Motion, the Court finding that the compensation to be paid by Petitioner
is the full compensation due the Respondent, MYRTLE CHASE, LLC and. the Court being fully
advised in the-premises thereof, it is thereupon
ORDERED AND ADJUDGED that:
1. Respondent, MYRTLE CHASE, LLC have and recover from Petitioner,
COLLIER COUNTY, FLORIDA, the total sum,ofEighty -Five Thousand Dollars and No /100
{$85,000,00} for Parcel 206DAIv11, as full cotnpensation;. including severance damages, cost to
cure., statutory interest, business damages, and for all other damages in connection with the
taking ofsaid`parcels and the construction of the,proposed :improvements by Petitioner,

excluding attorney's fees, expert fees and costs.
2. Petitioner, COLLIER COUNTY,. FLORIDA, is entitled to a credit in the amount
of Eight Thousand Three Hundred Dollars and No /100 ($8,.300.00) for good faith estimate of
value previously deposited into the Court Registry ,pursuant to the Order of Taking dated March
22, 2012.
3. Within thirty (30) days hereof, Petitioner, COLLIER COUNTY, FLORIDA, shall
pay an additional Seventy -Six Thousand Seven Hundred Dollars and No/100 ($76,700:00) to
Roetzel and Andress Trust Account, c/o Kenneth A. Jones, Esquire, 2320 First Street, Suite
1000, Fort Myers, Florida 3390.1.
4. Within thirty (30) days hereof, Petitiamer, COLLIER COUNTY, FLORIDA, shall
pay. Forty-Four Thousand Two Hundred Seventy -Eight and 63 /100 Dollars (544478:63) to
Roetzel and Andress Trust Account, c/o Kenneth A. Jones, Esquire, 2320 First Street, Suite
1000, Fort Myers, Florida 33901, for all attorney's. fees and costs and all expert fees and costs
associated with the taking of these parcels.
5. County agrees to install, at .its expense, a gate at the location depicted .in pink on
Exhibit "A" attached hereto and incorporated herein, by reference. Said gate and fence shall be
installed to a width and in a manner which will. prevent access by trespassers. Upon developing
the parent tract, as a part of that development, Owner shall be entitled to remove the chain link
fence depicted in green on, Exhibit "A ".
6. County agrees that upon redevelopment of the property that the chain link fence
spanning the existing bridge over the canal may be replaced with a handrail or decorative wall so
long as it comports with existing County standards.

7. Title to Parcels 206DAMF. being fully described in Exhibit "B" attached hereto
and incorporated herein, which vested in Petitioner pursuant to the Order of Taking dated March
3, 2012, and the. deposit of money heretofore made is approved, ratified, and confirmed.
8. The Notice of Lis Pendens filed .in the above - styled cause and recorded in Official
Record. Book 4723, Page 2122, .et sect., of the Public Records of Collier County, Florida is
dismissed as to Parcels.206DAME.
9. There is no other or further compensation, damages, attorney's fees and costs or
experts' fees and costs due from the Petitioner to the Respondents associated with this matter.
10. The Court reserves jurisdiction to enforce the terms of this Final Judgment.
11. 'Phis Final Judgment is to be recorded in the Official Records of Collier County,
Florida.
IT IS THEREFORE DONE AND ORDERED in. Chaurbers at Naples,. Collier .County,
