EXECUTIVE SUMMARY Recommendation to approve a Stipulated Order of Taking and Final Judgment in the amount of $5,300 for Parcel 156TCE in the lawsuit styled Collier County, Florida v. Robert E. Williams, Tr., et al., Case No. 14 -CA -816 for the Collier Boulevard expansion (Project No. 68056). (Fiscal Impact $5,470) OBJECTIVE: That the Board of County Commissioners approves a Stipulated Order of Taking and Final Judgment for payment of full compensation in the amount of $4,625, for the taking of Parcel 156TCE in the lawsuit styled Collier County, Florida v. Robert E. Williams, Tr., et al., Case No. 14 -CA -816 for the Collier Boulevard expansion (Project No. 68056). CONSIDERATIONS: Collier County is seeking to condemn 3,301 square feet for a temporary construction easement from property owner Robert E. Williams, Tr. The County's appraisal dated May 13, 2014, valued the taking at $1,140. The parties agreed to a total of $4,300 for the taking, which includes negotiated compensation for the County's temporary use of Mr. Williams' property for the storage of construction equipment, and $1,000 in attorney's fees. If approved, the County will be responsible for the following costs: Full Compensation: $4,300 Attorney's fees and costs: $1,000 Clerk's fees: $ 170 TOTAL $5,470 Considering the cost of trial, the County Attorney's Office and Staff are recommending this settlement as the best possible outcome. Once approved by the Board, the Stipulated Order of Taking and Final Judgment will be presented to the Judge at an Order of Taking to be held June 27, 2014. Upon deposit of the funds as stated, the property will then vest in the County. FISCAL IMPACT: Funds in the amount of $5,470 are available in impact fees and /or gas taxes. Project: Collier Boulevard Expansion. The acquisition of this right -of -way will not add any cost to the annual operating and maintenance budget as the easement area will not be maintained before the Project is constructed. Operating and maintenance costs will be considered when the construction contract is brought before the Board for approval. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority vote for approval- ERP RECOMMENDATION: That the Board of County Commissioners approves a Stipulated Order of Taking and Final Judgment as to 156TCE and authorize payment of the funds as stated. The Court has jurisdiction of this cause, the parties hereto and the subject matter hereof. 2. The pleadings in this cause are sufficient and the Petitioner is properly exercising its delegated authority. 3. The Declaration of Taking and Estimate of Value filed in this cause by the Petitioner was made in good faith and based on a valid appraisal. 5. Respondent, ROBERT E. WILLIAMS, TR., shall recover from Petitioner, COLLIER COUNTY, FLORIDA the total sum of Four Thousand Three Hundred and No /100 Dollars ($4,300.00) inclusive of full compensation, including damages and statutory interests, in connection with said parcel, except for attorney's fees and costs. 6. The sum mentioned in Paragraph 5 above shall also be full compensation for the e �.- r temporary use of Owner's lands adjacent to Immokalee Road in Section 27, Township 47 South, Range 27 East, Collier County, Florida, and Respondent hereby waives all current and future claims for compensation for such use by the County. 7. Respondent, ROBERT E. WILLIAMS, TR., shall receive as a reasonable attorney's fee, expert fees, expert witness fees and costs, the sum of One Thousand and No /100 ($1,000.00). No other attorney's fees, expert witness fees and costs shall be awarded in connection with this cause as it relates to Parcel 156TCE. 8. Within twenty (20) days from the date of this Order, Petitioner shall deposit into the Court Registry the aggregate sum of Four Thousand Three Hundred and No /100 Dollars ($4,300.00). Upon the payment of deposit into the Registry of this Court, the right, title and interest described in Exhibit "A," attached hereto and made a part hereof by reference shall vest in Petitioner. 9. Upon deposit, as set forth above, and without further notice of this Court, the Petitioner shall be entitled to possession of the property described in Exhibit "A" which possession shall commence on January 1, 2015 and terminate on January 1, 2017. 10.
