EXECUTIVE SUMMARY Recommendation to approve a substantial amendment to the U.S. Department of Housing and Urban Development Community Development Block Grant FY2010 -2011 HUD Annual Action Plan, as amended, to redirect funds to the Immokalee CRA First Street Plaza (aka Zocalo) project in the amount of $34,000. OBJECTIVE: To expend the County's entitlement allocation for community amenity projects. CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) program funds locally defined needs for programming and infrastructure. The Board approved the County's CDBG FY2010 -2011 Annual Action Plan on April 27, 2010. Since then the Annual Action Plan has been amended by the Board numerous times. Housing, Human and Veteran Services (HHVS) staff has identified $34,000 in unspent funds from previous years. The unspent funds were a result of numerous factors, such as projects completed under budget, projects not started, and unused administration funds, etc. The reallocation of unspent funds requires a substantial amendment for the three year Action Plan. HUD regulations and the Five -Year HUD Consolidated Plan require citizen participation whenever a substantial plan amendment is proposed. The required notice was published in the Naples Daily News on May 21, 2014. The advertisement identified a thirty-day public comment period from May 21, 2014 to June 20, 2014. As of the agenda publication, no comments regarding the substantial amendment were received. The following substantial amendment change is to the FY2010 -2011 HUD Annual Action Plan, as amended: Collier County Community Redevelopment Agency - Immokalee — CDBG — First Street Plaza ( Zocalo) Public Facilities — Increasing funding amount by $34,000 to $994,000 and revising the project scope to read: Land Acquisition, Design and Construction activities /items /services may include but not be limited to: closing costs, impact fees, pre- design/design, earthwork, stormwater, electric, irrigation, water lines, permitting, pedestrian walkway sidewalk, roof structure; the columns, fencing, landscaping and hardscaping (pavers), and decorative water drinking water fountain and bike racks. Project earthwork will include site grading, a stonmwater conveyance system, and the installation of utilities (Irrigation, potable waterlines and electric). The detailed project scope will be contained in the schedule of values awarded the project's construction contract. The project construction contract will include details sufficient to document the number, amount, and costs associated with all activities. Additional funds will go towards costs associated with the added wage determination classification costs, securitylighting/wiring, handrails and other minor adi ustments. Typically, HHVS staff brings the substantial amendment to the Action Plan and the amendment to the subrecipient agreement together for Board's approval. However, in this instance, the existing subrecipient agreement would have expired during the required thirty-day public comment period for the substantial amendment. As a result these changes are being brought forward as separate actions. HHVS staff brought an amendment to the existing contract to the Board on May 27, 2014 to extend the timeframe to July 31, Packet Page -1465- 6/24/2014 16.D.14. 2014 (Agenda item #16D13). The subrecipient agreement states that if, for any reason, the substantial amendment is not approved by the Board or HUD, the project would only be reimbursed up to $960,000. FISCAL IMPACT: The original grant award was $960,000. The budget is being increased by $34,000, for a total new grant award of $994,000. The funding source for the grant award is the Community Development Block Grant (CDBG). The funds for this project are budgeted in the Housing Grants Fund (121) for Project No. 34510, Grants Fund (705) for Project No. 33088, 33176, and 33236. GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this substantial amendment will further the Goals, Objectives, and Policies of the Growth Management Plan.
