OBJECTIVE: To obtain the Board of County Commissioners (Board) approval of the proposed 2014 Land Development Code (LDC) Amendments Cycle 1 — Level 1 in order to serve the best interest of the public. Packet Page -72- 6/24/2014 9.A. CONSIDERATIONS: The Board of County Commissioners approved a prioritized list of amendments for the 2014 LDC Amendment Cycle 1 during the fall of 2013. The prioritized list identified three levels of amendments to be completed within a fourteen month period. The Level 1 amendments prepared and vetted for adoption cover several main areas including: 1. Amendments which seek to provide for additional flexibility within zoning district's use categories and within temporary use sections. 2. An amendment which seeks to provide flexibility in design standards, in particular to allow more vibrant colors within the Bayshore Gateway Community Redevelopment Area. 3. An amendment which proposes to codify common PUD deviation requests for signage. 4. Amendments which aim to improve the efficiency of procedures identified in the LDC. 5. To update the Zoning Atlas and implement the Growth Management Plan. 6. Amendments to codify staff clarifications which aim to identify how permits and applications are reviewed and approved. 7. Amendments which seek to correct or clarify scrivener's errors identified during examination of the LDC or created inadvertently during the creation of the Administrative Code for Land Development process. Throughout the cycle, County staff has worked with stakeholder groups, community members, and advisory boards to develop and publicly vet the amendments. Beginning in the late spring of 2014, amendments were presented and reviewed by the Development Services Advisory Committee — Land Development Review Subcommittee (DSAC -LDR), the Development Services Advisory Committee (DSAC), and the Collier County Planning Commission. Advisory board review of the amendments concluded on June 4, 2014. A complete list of the amendments is outlined in Attachment 1. The proposed change, the reason for the change, and relevant background information is identified on each individual amendment. The amendments also include the recommendations from each advisory board. The proposed amendments employ LDC section 10.03.06 K which requires that amendments which propose changes to the zoning atlas involving ten contiguous acres or more and which propose changes to the list of permitted, conditional, and prohibited uses of land shall be considered at two Board hearing dates, with one hearing scheduled after 5:00 p.m. At the June 10, 2014 Board meeting, the Board approved Agenda Item 16.A.21 which recommended the Board waive the after 5:00 p.m. requirement for one of the two scheduled public hearings to consider the 2014 Land Development Code Amendment Cycle - Level 1 amendments. LEGAL CONSIDERATIONS: The LDC Amendments are approved as to form and legality. An affirmative vote of four is required for approval.
