EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners approves a Resolution pursuant to LDC Section 3.05.09 designating certain Java Plums located at 549 Myrtle Road,Naples,Florida,as Specimen Trees,and that staff take no further action with respect to this matter. OBJECTIVE: To declare the Java plums located at 549 Myrtle Road, Naples, Florida, as Specimen Trees that need not be removed under the Prohibited Exotic Vegetation Ordinance. CONSIDERATIONS: This item is in furtherance of a Public Petition brought by Mr. Peter J. Tierney at the May 27th Board Meeting. Briefly stated, Mr. Tierney was in the process of installing a pool at his residence located at 549 Myrtle Road, Naples, Florida. During the ordinary course of inspections, staff noted that there were 10 Java plums on the premises. Java plums are listed in LDC Section 3.05.08 as a Prohibited Exotic Vegetation. In keeping with the requirements of this section, staff requested that these trees be removed. Mr. Tierney objected to their removal, noting that in his opinion these were Specimen Trees under the Prohibited Exotic Vegetation Ordinance,and took the issue to the Board on Public Petition. LDC Section 3.05.09 provides as follows: "3.05.09 Designation of Specimen Tree By resolution of the BCC, a plant may be designated a specimen tree because of its historical significance,rarity in the County,age,or extraordinary size." As set forth in the back-up, Mr. Tierney's Java plums are at a mature age and maximum height. From a Code Enforcement standpoint,no complaints have been filed with respect to these trees. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: The County Attorney has reviewed this item and approved it as to form and legality. Majority support of the Board is required for approval. -JAK RECOMMENDATION: Based on the testimony set forth in the Public Petition, together with the information set forth in the back-up to this agenda item, that the Board of County Commissioners approves a Resolution pursuant to LDC Section 3.05.09 designating the Java plums located at 549 Myrtle Road, Naples, Florida, as Specimen Trees, and that staff take no further action with respect to this matter. RESOLUTION NO.2014- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, DESIGNATING THE JAVA PLUMS LOCATED AT 549 MYRTLE ROAD, NAPLES, FLORIDA, AS SPECIMEN TREES. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that based on the review of all testimony and evidence presented in this matter, the Board of County Commissioners hereby finds that the Java plums located at 549 Myrtle Road, Naples, Florida, meet the criteria of Specimen Trees as set forth in LDC Section 3.05.09. Due to the fast growth rate,the trees are most likely less than 30 years old due to 1)their fast growth rate and 2)the trees do not appear to be on the 1985 aerial.
