EXECUTIVE SUMMARY Recommendation that the Collier County Board of County Commissioners (BCC), acting in its capacity as the Community Redevelopment Agency (CRA), approve a budget amendment in the amount of$34,000 to complete the First Street Plaza project,and formally accept an amendment to Community Development Block Grant (CDBG) Subrecipient Agreement #B-10-UC-12-0016 between the Collier County BCC and the Collier County Community Redevelopment Agency (CRA) (Immokalee). OBJECTIVE: To receive CRA approval of a budget amendment in the amount of$34,000, and for the CRA to formally accept an amendment to Community Development Block Grant (CDBG) Subrecipient Agreement#B-10-UC- 12-0016 between the BCC and the CRA to complete the First Street Plaza project. CONSIDERATIONS: On January 24, 2012 (agenda item#16D10),the BCC approved the Subrecipient Agreement #B-10 UC-12-0016 between the Collier County BCC and the Collier County Community Redevelopment Agency (CRA) (Immokalee) to purchase two adjacent parcels, design and construct the First Street Plaza located in the downtown area of Immokalee,Florida. On May 27, 2014 (agenda item 16D13), the BCC approved amendment #3 to the subject funding agreement between the BCC and the CRA. This amendment included an extension to the agreement expiration date and the addition of$34,000 of funding to the overall grant agreement budget. FISCAL IMPACT: A budget amendment is necessary to recognize additional CDBG grant revenue in the amount of$34,000 within Immokalee CRA Grant Fund 715 Project 33192.The revised project budget will total $994,000. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raised no legal issues, and requires majority vote for approval. -JAK GROWTH MANAGEMENT IMPACT: This grant opportunity furthers the programs and projects within budgetary and policy guidance for the CRA and BCC of Policy 4.2 of the Future Land Use Element of the Growth Management Plan which reads as follows: "The Immokalee Area Master Plan addresses conservation, future land use, population, recreation, transportation, housing, and the local economy. Major purposes of the Master Plan are coordination of land uses and transportation planning, redevelopment or renewal of blighted areas and the promotion of economic development." EXECUTIVE SUMMARY Recommendation to approve Amendment No.3 to the Subrecipient Agreement with the Immokalee Community Redevelopment Agency(CRA) for the Community Development Block Grant(CDBG) First Street Plaza (aka Zocalo) project in order to extend the project completion date to July 31, 2014; increase the project budget by$34,000(grant funded)and update the project work plan. OBJECTIVE: To assist in the elimination of slum and blight in a low-income neighborhood through completion of a public facility project. CONSIDERATIONS: Collier County is the recipient of Community Development Block Grant(CDBG) Program funds from the United States Department of Housing and Urban Development (HUD). CDBG funds may be used for public facilities. On January 24,2012,the Board approved a subrecipient agreement with the Immokalee CRA for the use of CDBG funds for the purchase of land and design-build construction of the First Street Plaza in Immokalee(Agenda item 16D10). The CRA is required to pay an increased cost for labor due to a change in the HUD Wage Determination rate schedule. A HUD Wage Determination rate schedule is the listing of wage rates and fringe benefit rates for each classification of mechanics and laborers for which the Department of Labor has determined to be prevailing in a given area for a particular type of construction.As is customary, staff made an initial wage determination for the project, but HUD subsequently required use of a different rate schedule. This change necessitated restitution to some of the laborers.Additionally,more lighting is being added to the project to offer better security and protection of park visitors and the property, and a handrail will be constructed for sidewalk drop-offs,as was determined necessary during Right of Way inspection. As is required by HUD regulations and the Five Year HUD Consolidated Plan, Citizen Participation Plan, a substantial amendment is proposed to amend the project to include additional funding. The required advertisement notice was published in the Naples Daily News on May 21, 2014. The advertisement identified a 30-day public comment period from May 21,2014 to June 20, 2014. The following substantial amendment change is to the FY2010-2011 HUD Annual Action Plan: Collier County Community Redevelopment Agency - Immokalee — CDBG —First Street Plaza (Zocalo) Public Facilities—Increasing funding amount by$34,000 to $994,000 and revising the project scope to read: Land Acquisition, Design and Construction activities/items/services may include but not be limited to: closing costs, impact fees, pre-design/design, earthwork, stormwater, electric, irrigation, water lines, permitting, pedestrian walkway sidewalk, roof structure; the columns, fencing, landscaping and hardscaping (pavers), and decorative water drinking water fountain and bike racks. 2: • . Project earthwork will include site grading, a stormwater conveyance system, and the installation of utilities (Irrigation, potable waterlines and electric). The detailed project scope will be contained in the schedule of values awarded the project's construction contract. The project construction contract will include details sufficient to document the number, amount, and costs associated with all activities. Additional funds will go towards costs associated with the added wage determination classification costs,security lighting/wiring,handrails and other minor adjustments. Packet Page-1189- 6/10/201416.6.2. The substantial amendment will be brought to the June 24,2014 Board meeting to accept the substantial amendment. The First Street Plaza project was approved in the FY2010-2011 HUD Annual Action Plan on April 27, 2010. If, for any reason, the substantial amendment is not approved by the Board or HUD, the project cannot be reimbursed with grant monies. Typically, HHVS staff brings the substantial amendment and the agreement amendment together for Board's approval. However, in this instance, the existing agreement will expire before the Board can address the substantial amendment,thus requiring separate actions. Agreement modifications are needed to the subrecipient agreement to reflect the updated budget and project work plan and revise the project completion date to July 31,2014. 1. CONSIDERATIONS AND LIMITATIONS OF COSTS, Paragraph IV. $34,000 is funding is added contingent on approval of substantial amendment to Action Plan. 3. EXHIBIT A, Scope of Services, updates Project Scope funded amount, Budget and the Project Work Plan. FISCAL IMPACT: After approval of amendment 2 the award amount was$960,000.00. The budget is being increased by $34,000.00, for a total new grant award of$994,000.00. The funding source for the grant award is the Community Development Block Grant (CDBG). The funds for this project are budgeted in the Housing Grants Fund (121) for Project No. 34510, Grants Fund (705) for Project No. 33088,33176,33236(CDBG Grants). GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will further the Goals,Objectives,and Policies within the Housing Element of the Growth Management Plan.
