EXECUTIVE SUMMARY
Recommendation to set a public hearing date of September 9, 2014 for consideration of a
Development of Regional Impact (DRI) Development Order Abandonment for The Town of Ave
Maria DRI project, Petition Number DRIABN-PL20130002016, located on the north side of Oil
Well Road, the west side of Camp Keais Road and approximately 6,000 feet south of Immokalee
Road (CR-846). The property lies within Sections 4-9 & 16-18, Township 48 South, Range 29 East
and Sections 31-33 Township 47 South,Range 29 East.
OBJECTIVE: To set a public hearing date for the Board of County Commissioners (BCC) to
consider petition number DRIABN-PL20130002016, being an application for Development of
Regional Impact (DRI) Abandonment for a project known as The Town of Ave Maria.
CONSIDERATIONS: The BCC is required by the Florida Administrative Code to set a public
hearing date for an application for DRI abandonment, as noted in the excerpt below:
Rule 73C-40.0251 Abandonment of Development Orders. (2)(b) Upon receipt of the
application, the local government shall, at its next regularly scheduled meeting,
schedule a public hearing to consider the application and provide 45 days notice of this
hearing to the Division and the appropriate regional planning agency.
The next available meeting is September 9, 20]4, to allow for the 45 day advance notice to the
Department of Economic Opportunity and the Regional Planning Council.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
STAFF RECOMMENDATION: That the BCC set a public hearing date for September 9,
2014, for consideration of the request to abandon Development of Regional Impact (DRI)
Development Order for Collier County petition number DRIABN-PL20130002016 (State of
Florida DRI #07-0304-167), The Town of Ave Maria.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for BCC approval. -HFAC
