EXECUTIVE SUMMARY Recommendation to approve an extension of one year for completion of site development plan improvements associated with Naples Grande Clubhouse (SDPA AR-10788) in accordance with Section 10.02.03 H of the Collier County Land Development Code. OBJECTIVE: To have the Board of County Commissioners (Board) approve a one year extension for the completion of Site Development Plan Amendment (SDPA) improvements associated with Naples Grande Clubhouse. CONSIDERATIONS: On July 26, 2007, the Engineering Services Department approved the Site Development Plan Amendment (SDPA) for the Naples Grande Clubhouse. Section 10.02.03 H of the Land Development Code requires that upon approval, a SDPA must be completed within 36 months. The developer did not request extensions to which they were entitled to and therefore the project has been expired since January 26, 2010. The Code also allows for 2, two year extensions. Additionally,the developer would have been eligible for extensions pursuant to Senate Bill 360 which allowed extensions for projects which expired between September 8, 2008 and January 12, 2012 and Senate Bill 1752 which extended the application date for such extensions from December 31, 2009, to December 31, 2010. The project stalled due to a failing economy. Since the project is technically expired, the Board must approve the request. No work has commenced on this project. The building permit will be submitted through a separate process and this approval is for site related work only. The County has approved several similar requests in the past year. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 -- Land Development Services Revenue generated by this project: Total: $1050.00 Extension Fees LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. - SAS GROWTH MANAGEMENT IMPACT: There is no growth management impact. RECOMMENDATION: 1. That the Board accept the applicant's extension request together with the appropriate fees. 2. Approve an extension for Naples Grande Clubhouse (SDPA AR-10788) to July 26, 2015, so that the developer will be in compliance with the requirements of the Land Development Code. 3. THIS IS YOUR PERMIT AND MUST BE POSTED ONSITE! Engineering Services Department has reviewed the Final Site Development Plan for the referenced project and has no objection to the construction of water, sewer, paving and drainage aspects of the project subjject to the following stipulations: 1. General Conditions a) CHANGES IN USE AND/OR DESIGN OF THESE SITE AND ACHITECTURAL PLANS ARE NOT AUTHORIZED WITHOUT WRITTEN APPROVAL BY THE COUNTY. Upon a satisfactory inspection of the improvements, a certificate of occupancy may then be issued. i) SIGNAGE RESTRICTIONS: Please be advised that any permanent sign (wall, ground, monument, directory, etc..) requires a separate building permit and must meet the provisions of the Collier County land Development Code, Section 5.06, and/or the applicable provisions of the governing Planned Unit Development (PUD) document, regardless of any sign placement, dimensions or color depicted on the site and/or architectural plans approved by this letter. 2.
