EXECUTIVE SUMMARY Recommendation to approve final acceptance of the private roadway and drainage improvements for the final plat of Sandalwood (Application Number AR-8661) with the roadway and drainage improvements being privately maintained and to authorize the Board of County Commissioners to accept the plat dedications and to release the maintenance security in the amount of$164,188.62,in the form of a Letter of Credit. OBJECTIVE: To have the Board of County Commissioners (BCC) accept final approval of the infrastructure improvements associated within the subdivision,accept the plat dedications, and to release the maintenance security in the amount of$164,188.62. CONSIDERATIONS: 1) On April 27, 2011, the Engineering Services Department granted preliminary acceptance of the roadway and drainage improvements in Sandalwood. 2) The roadway and drainage improvements will be maintained by the project's homeowners association. 3) The required improvements have been constructed in accordance with the Land Development Code. The Engineering Services Department has inspected the improvements and is recommending final acceptance of the improvements. 4) A resolution for final acceptance has been prepared and approved by the County Attorney's Office. The resolution is a requirement of Section 10.02.05 C.1 of the Land Development Code. A copy of the document is attached. 5) The Sandalw000d PUD, which encompasses the subject plat, has been found to be in substantial compliance. FISCAL IMPACT: The roadway and drainage improvements will be maintained by the project's homeowners association. The existing security in the amount of$164,188.62 will be released upon Board approval. The original security in the amount of$423,847.84 has been reduced to the current amount based on the previous work performed and completed and pursuant to the terms of the Construction and Maintenance Agreement dated November 24,2010. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for approval. -SAS GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: To have the BCC accept final acceptance of the infrastructure improvements associated within the subdivision known as Sandalwood Application Number (AR-8661), and authorize the Chairman to execute the attached resolution authorizing final acceptance of the improvements, acceptance of the plat dedications, and release of the maintenance security in the amount of$164,188.62.
