EXECUTIVE SUMMARY Recommendation to ratify the Certification for Reallocated Fiscal Year 2013 Entitlement Community Development Block Grant funds for $84,307, which was signed by the County Manager on March 20, 2014. Collier County will receive $80,807, and the City of Naples will receive 53,500. OBJECTIVE: To recognize a reallocation of FY2013 -2014 HUD CDBG federal funding allocated to Marco Island. CONSIDERATIONS: Collier County. along with the participating cities, Naples and Marco Island, became eligible to receive federal CDBG entitlement funds annually through an Urban County Cooperation Agreement adopted by all jurisdictions in September 2000. HUD regulations require the County to adopt a Cooperation Agreement with its participating municipalities every three years. On May 22, 2012, the Marco Island City Manager notified Housing. Human and Veteran Services (HHVS) that the City of Marco Island will not participate in the Urban County Cooperation Agreement for fiscal years 2013 -2015. HHVS consulted with HUD, which informed us that there would be no adverse effect to Collier County as a result of Marco's decision to no longer receive its entitlement funding, at least through 2015. In October 2013, HUD notified HHVS that it was reducing the County's allocation by $84,371 to allow the City of Marco Island to apply directly to HUD for its allocation of FY2013 funds. On March 19, 2014, HUD notified HHVS that Marco Island did not apply for its FY2013 allocation. HUD advised that those funds would be reallocated to the County and the City of Naples. The County's share of the FY13 Marco Island funds is $80,807, and the City of Naples' share is $3,500. To receive these funds, HUD required HHVS to have the certification signed by close of business Monday, March 24, 2014. To meet the deadline. the County Manager signed the certification. HUD advised that the reallocation will be available with FY2014 entitlement funds and will need to be incorporated in the County's FY2014 Consolidated Plan /Action Plan. An item incorporating the reallocation into the FY2014 Consolidated Plan/Action Plan will be placed on an upcoming agenda for Board consideration. HUD finds Board ratification of the County Manager's signature acceptable. FISCAL IMPACT: Funds in the amount of $84,307 will be recognized within the Housing Grants Fund (705) when the FY2014 -2015 HUD CDBG allocation is received. GROWTH MANAGEMENT IMPACT: The activity associated with this item is consistent with the goals, objectives and policies of the Housing Element of the Collier County Growth Management Plan. Thus these funds are to be reallocated to communities in the Naples - Collier metropolitan area. The purpose of this letter is to notify you that your entitlement community is eligible to receive a share of the reallocated funds as determined by the proportion of all Community Development Block Grant funds that were awarded to all entitlement communities in the metropolitan area for FY2013. Your tentative share amount is $80,807 for Collier County and $3,500 for the City of Naples. However, in order to receive these funds, you must make the required certification. By law, a community must certify that it would be adversely affected by the loss of the reallocated funds from the metropolitan area. To be acceptable for this purpose, the certification must be in writing, executed by the community's chief executive officer (or official designee), and received by this office no later than close of business Monday, March 24, 2014. Attached for your convenience, is a sample certification that contains acceptable language. In addition, please be advised that your share of reallocated funds will be made available with your FY2014 entitlement funds, when Congress appropriates funding for the FY2014 CDBG program. You will need to include these funds in your Consolidated Plan for the FY2014 entitlement grant.
