The parties may not assign this agreement or any right or obligation of this agreement without the written consent of the other party, except that in the event that the Ochopee Fire Control and Rescue District is merged or consolidated into another Fire District, the County may assign the Agreement to the merged or consolidated Fire District with advance notice to the Department. Item 16A16: Additional language has been added to the Developer Contribution Agreement regarding Mockingbird Crossing which reads: Developer shall maintain the portion of Massey Road from Vanderbilt Beach Road to the Development's entrance until the earlier of the completion of Tree Farm Road or three years from the date of the issuance of the first building permit for the Development. Maintenance shall include cutting the grass along the roadway. Developer shall place an overlay layer of asphalt on Massey Road from Vanderbilt Beach Road to the Development entrance as part of its maintenance of Massey Road. EXECUTIVE SUMMARY Recommendation to recognize a portion of Rock Road, from Immokalee Road to Mingo Road within the Rock Road Municipal Service Taxing Unit (MSTU), which the County has regularly maintained for more than the immediate past seven years, as having been dedicated and deeded to the County as a public road, to approve a Resolution in support thereof and to authorize the Board's Chairman and the Ex Officio Clerk to the Board to file a map with the Clerk of Court certifying ownership has vested with the County; and authorize a short -term loan in an amount up to $130,000 to the Rock Road MSTU for the purpose of paving of a portion of Rock Road, from Immokalee Road to Mingo Road and approve all necessary budget amendments. OBJECTIVE: To certify that an approximately one mile portion of Rock Road, from Immokalee Road to Mingo Road, is deemed to be dedicated and vested in the County as a public road and to advance the Rock Road Municipal Service Taxing Unit (the "MSTU ") funding for the paving of a portion of Rock Road, from Immokalee Road to Mingo Road, with a maximum four year repayment schedule. CONSIDERATION: On September 13, 2006, the Board issued a declaration of emergency for the Rock Road area, asserting that the poor condition of the then existing road created a health and safety concern by severely limiting access to emergency vehicles. At that time, the Board authorized the county's transportation division to immediately commence emergency repairs to Rock Road and the surrounding side streets to make them passable. The Road & Bridge Department executed the initial repairs over a three day period commencing on September 14, 2006. Thereafter, the Board of County Commissioners created the MSTU by enacting Ordinance No. 2006 -56 on November 28, 2006. Since the Board's initial declaration of emergency, Collier County directly and through the MSTU has been regularly maintaining Rock Road within the MSTU's defined boundaries for the immediate past seven (7) years. Following an inquiry by the MSTU's Advisory Committee about the possibility of paving Rock Road, the Growth Management Division presented a proposal in April 2013 that would involve the county carrying out the paving project by laying 2 inches of asphalt on the road. Although the asphalt paving would not be constructed to County standards, it would be an improvement over the current situation of grading the road with rock. The estimated cost to pave the road would be approximately $130,000. That cost does not include installing culverts or raising the elevation of the road but would include some grading of the adjacent ditches as required to apply the asphalt. After receiving the proposal, the MSTU Advisory Committee approved a motion to pursue the proposal and conduct a public meeting to solicit other MSTU residents' input. The MSTU Advisory Committee held a public meeting on May 29, 2013, in part, to review the paving proposal with the residents of the MSTU. There was a lot of public comment regarding the paving proposal; both in favor and opposed. Many residents spoke in favor of the proposal stating that they are tired of driving down a lime rock road. A number of residents spoke in opposition to the proposal primarily because they do not want the road to become public. The entirety of the road sought to be deemed dedicated to the County is owned by the currently dissolved corporation, Naples 846, Inc. At the last MSTU Advisory Committee meeting on November 5, 2013, the Committee approved a motion by a vote of two (2) to one (1) in favor of recommending to the Board that the County take appropriate action to make Rock Road from hmnokalee Road to Mingo Road a public road. A husband and wife, property owners in the MSTU, appeared at the meeting and voiced their opposition to making Rock Road a public road. Copies of the minutes for all meetings at which this issue addresses are attached. Florida Statutes Section 95.361(2) states, in part. that a county that regularly maintains a road constructed by a nonaovernmental entity for the immediate past seven (7) years is deemed to have been dedicated the road to the extent of the width actually maintained; and that the dedication vests all rights, title, easement and appurtenances to the road in the county, whether or not there is a record of conveyance. dedication or appropriation to the public use. Once the County files a map certified by the Chairman and the Clerk of Packet Page -1500- 4/8/2014 16.D.7. Court showing the land where the road is located, and reciting on that map that the road has vested in the county, the county is deemed the prima facie owner of the road. In response to the MSTU Advisory Committee's request, staff is bringing this item to the Board for consideration and action. Attached in support of this action is a Resolution certifying ownership has vested in the County, along with a map indicating the designated portions of Rock Road that are now deemed to be public road, which is to be filed with the Clerk of the Circuit Court as prima facie evidence of ownership of the road by the County. In order to afford the paving of the road the County would be required to implement an internal financing arrangement with the MSTU which would not be legally permissible without the formal declaration of the portion of the road in questions as a public roadway. With the Board's approval to certify that Rock Road has been deemed dedicated and deeded to the County, the financing for the pavement may move forward. Currently the Rock Road MSTU, after considering operating and ongoing maintenance costs, only generates approximately $10,000 per year that could be set aside for the pavement overlay. Waiting 13 years to accumulate sufficient funds for the pavement overlay is not viable. The major portion of the annual maintenance costs are attributed to that portion of the road that the MSTU wants to pave. Since paved roads cost much less to maintain on an annual basis than a gravel road, paving the road would allow substantially more maintenance dollars be directed to repaying the advance. This would generate enough excess funds along with those funds already set aside to pay back the advance within the four year time frame. Under these circumstances it would be prudent to monitor the property values within the MSTU to determine whether a millage increase will be needed in the future. The intent is to repay the County within a 4 year period for the funds advanced. Notice of this action was mailed to all property owners within the Rock Road MSTU on March 25, 2014. In addition a copy of the notice was posted on the Rock Road community bulletin board on the north end of Rock Road during the evening of March 20, 2014. A copy of the notification is attached. FISCAL IMPACT: The action recommended in this item is not intended to contemplate or authorize the use of general public monies for maintenance of Rock Road. Rather, because the roadway does not conform to County standards it is not eligible to be maintained with general County road maintenance monies and maintenance and improvements will continue to be the responsibility of the Rock Road MSTU. GROWTH IMPACT: There is no growth impact associated with this Executive Summary LEGAL CONSIDERATIONS: This matter has been reviewed by the County Attorney, is approved as to fonn and legality, and requires majority support for approval. With that said, the Board should be aware that Rock Road presents unique and unusual legal issues. Rock Road is a private rural road. In most circumstances, private rural roads are owned to the centerline by the adjoining property owners who share common easement rights. Based on a Title Report, it is my belief that Rock Road is in fact owned by Naples 846, Inc., a long -ago dissolved Florida corporation who was presumably the original developer of this area. The Property Appraiser shows Rock Road as a separate parcel, but with no folio number and hence no taxes were ever assessed. If taxes on Rock Road had been assessed, they would have gone unpaid long ago when Naples 846, Inc. went out of business, and this parcel would have presumably escheated to the County (as who else would have wanted to purchase it ?). Instead, the ownership of the road was left in limbo. One of the opponents to this MSTU is Mr. Mark Bell, who owns 5 lots abutting Rock Road. I. The meeting was called to order by the Chairman, Dan Wing, at 3:00 p.m. at the Big Corkscrew Island Fire Department,-13240 Immokalee Road, Naples FL. 1. Attendance Roll Call. May 29, 2013 Motion to accept the minutes of April 17 and May 29 as written was made by Dan Wing, seconded by Tom Brooks. Motion carried V. Budget Report- Harry Sells A. Budget and Outstanding POs Harry Sells, Project Manager, presented budget reports for "Ending FY 13, "FY 14 Starting" and "Nov 6, 2013 Current ". The MSTU ended FY13 under spending the budget by $18,442.64 with $19,339.64 in cash. For FY 14 Taxable value increased by $119,000 to $10,204,176, the millage rate was set to 2.7002 to achieve net budget revenue of $30,700. One major PO of $1567.50 for gravel was open with no money spent. Net operating budget for the year was $31,299.44. Operating Packet Page -1512- 4/8/2014 16.D.7. Budget plus the cash minus carry forward of $6500 left funds available for operating of approximately $44,138. VI. Old Business A. Finance Committee Report Harry Sells presented a report from the County Finance Committee concerning the request of MSTU to borrow funds to allow paving Rock Road from Immokalee Road to Mingo Road. The consensus was that "public funds" i.e. MSTU revenue, could not be used to improve a private road beyond making it passable for emergency vehicles. Also that MSTU funds could not be used to repay a loan obtained to improve (pave) Rock Road. The Finance Committee indicated that fund could be available to advance the paving of the road but the road must be designated "public" in order to utilize those funds. B. Paving Rock Road. A general discussion was held about the pros and cons of paving Rock Road, the issue of making the road public or keeping it private, the issue of ownership of Rock Road, and how to proceed. Doug Allemong made a motion to recommend to the Board of County Commissioners that the County take action to make Rock Road from Immokalee Road to Mingo Road, a public Road. Motion seconded by Tom Brooks. Motion passed 2 to 1 with Chairman Dan Wing opposing. VII. New Business No new business. VIII. C© ter CoMIty Public Services Division Alternative Transportation Modes March 20, 2014 Notice to the Rock Road Community This is to provide special notice to the Community that the Collier County Board of County Commissioners will consider for approval the following item at its regular Board meeting scheduled for April 8, 2014: Recommendation to recognize a portion of Rock Road, from Immokalee Road to Mingo Road within the Rock Road Municipal Service Taxing Unit (MSTU), which the County has regularly maintained for more than the immediate past seven years, as having been dedicated and deeded to the County as a public road; to approve a Resolution in support thereof and to authorize the Board's Chairman and the Ex Officio Clerk to the Board to file a map with the Clerk of Court certifying ownership has vested with the County; and authorize a short - term loan in the amount of $130,000 to the Rock Road MSTU for the purpose of paving of a portion of Rock Road, from Immokalee Road to Mingo Road.
