EXECUTIVE SUMMARY
Recommendation to acknowledge the extinguishment of the Temporary Drainage Easement as
shown on Page 9 of the plat of Piacere — Pavia as recorded at Plat Book 48, Pages 1 through 10 of
the public records of Collier County.
OBJECTIVE: To have the Board of County Commissioners (Board) acknowledge that the
Temporary Drainage Easement as recorded on Plat Book 48, Sheet 9 on the plat of Piacere —
Pavia may now be extinguished.
CONSIDERATIONS: On December 12. 2006, the Board approved the final plat of Piacere —
Pavia for recording. Included as part of the developer's obligations were certain improvements
associated with the Lelv Area Storm -water Improvement Project ( LASIP). The plat included
Temporary Drainage Easements (TDE's) which were to be automatically vacated upon
completion of the LASIP improvements. The dedication also states that the easements will be
automatically vacated upon replatting. However, there is no need or intent to replat Lots I
through 6. A General Note on Sheet 2 of the plat states that the 40' TDE will be automatically
vacated upon approval and acceptance of the LASIP improvements. The Temporary Drainage
Easements were necessary to ensure a temporary drainage system while improvements to the
Lely, canal were being completed. The improvements associated with the LASIP project within
Treviso Bay have now been inspected and accepted. Therefore, according to the verbiage on the
plat, the Temporary Drainage Easements have been automatically vacated. The developer's title
company has requested that the County acknowledge the automatic vacation of these easements.
The easement specifically affects Lots l through 6 on Page 9 of the plat.
