With respect to the add-on item regarding a request to remove a relatively small amount of fill from the new Canopy subdivision in advance of their grand opening event,the County Engineer, the County Attorney and the Planning Commission Chair have jointly determined that this matter can be approved administratively. Ochs, Jr., County Manage Subject: March 25, 2014 BCC Agenda Add-On Items Commissioners, Attached please find Add-On Item(s) 16A23 and 16A24 to be included on your March 25, 2014 BCC agenda. I have attached the executive summaries and back-up material and will discuss both of them at your individual one-on-one's Monday, March 24. Titles are as follows: 16A23 — Recommendation to approve an Easement Use Agreement as it relates to Lot 4, L'Ermitage at Grey Oaks. 16A24 — Recommendation to approve the developer removing up to 20,000 cubic yards of unanticipated excess excavated material from the side of the Canopy subdivision pursuant to Chapter 22-110 (b)(2) of the Code of Laws and Ordinances. Add On Item 16A24 March 25,2014 BCC Meeting EXECUTIVE SUMMARY Recommendation to approve the developer removing up to 20,000 cubic yards of unanticipated excess excavated material from the site of the Canopy subdivision pursuant to Chapter 22-110 (b)(2)of the Codes of Laws and Ordinances. OBJECTIVE: To have the Board of County Commissioners (Board) allow the applicant to remove up to 20,000 cubic yards of excess excavated material from the site. CONSIDERATIONS: On July 9, 2013, the Board approved the final plat of Canopy which was subsequently recorded on August 28, 2013. During the course of construction, it was determined that there was up to 20,000 cubic yards in excavated excess material on the site. Pursuant to the Code of Ordinances Section 22-110(b)(2) the applicant is requesting Board approval to remove up to 20,000 cubic yards of excess excavated material from the site. The Ordinance provides for Board approval to remove up to 20,000 cubic yards of material when the excess material was not intended or foreseen at the beginning of development. The lake excavation on the site is complete and the lake cross sections have been submitted to Engineering Services for final inspection and acceptance of the lakes. The developer is having a "Grand Opening" within the next couple of weeks and the excess material is unsightly and detracts from the esthetics of the development. The Engineering Services Department has reviewed the request and recommends approval of the applicant's request to remove up to 20,000 cubic yards of excess excavated material from the site. The actual amount of fill to be removed is estimated to be 5,000 cubic yards. The proposed haul route is approximately 1.5 miles south on CR 951 to the Raffia Preserve site which is permitted and under construction.A map is attached. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327--Land Development Services Revenue generated by this project: Total: $1,100.00 LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -SAS GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary.
