OBJECTIVE: To permit the encroachment of a pool deck and planters upon County-owned maintenance and drainage easements under the terms conditions set forth in the attached Easement Use Agreement. CONSIDERATIONS: The subject property is Lot 4, L'Ermitage at Grey Oaks. As set forth in the plat, the County owns certain non-exclusive drainage easement and maintenance easement rights, a portion of which encumbers the subject property. The easements are dedicated to Collier County with no responsibility for maintenance and to La Residences at L'Ermitage Homeowner's Association, Inc. with responsibility for maintenance. Currently, a pool deck and planters encroach 4.7 feet into County's easements. The proposed Easement Use Agreement would allow the current encroachments to remain provided the County maintains its non- exclusive drainage easement and maintenance easement rights, and the property owner waives any claim of damage to the encroachments arising out of the County's maintenance activities within the easement. Further, the County retains the right to demand by written request that the encroachments be removed at the property owner's sole cost and expense. The Homeowner's Association has provided a letter of no objection to the encroachment and stated that there remains sufficient area to maintain the lake. There are no drainage facilities within the easement. Engineering Services has reviewed the Agreement and Exhibit and recommends approval. FISCAL IMPACT: There is no fiscal impact. The Easement Use Agreement will be recorded in the Public Records at the property owner's sole cost and expense. GROWTH MANAGEMENT IMPACT:None. LEGAL CONSIDERATIONS: The County Attorney prepared this Agreement, which is based on a standard form previously approved by the Board. This item is approved as to form and legality,and requires majority support for approval. -JAK RECOMMENDATIONS: That the Board of County Commissioners approves, and authorizes its Chairman to sign, the attached Easement Use Agreement with the current property owner of Lot 4 of L'Ermitage at Grey Oaks. PAGE (Ms. Page) and COLLIER COUNTY ("County"),hereinafter collectively referred to as the"Parties." WHEREAS,Ms. Page is the current fee owner of that certain real property known as Lot 4, L'Ermitage at Grey Oaks, according to the plat thereof as recorded in Nat Book 31, Page 24, of the Public Records of Collier County,Florida(hereinafter"Subject Property");and WHEREAS, as set forth in Plat Book 31, Page 24, the County is record owner of certain non-exclusive drainage easement and maintenance easement rights, as referenced in Paragraph 7 of the Plat dedications, (collectively, the "Easements"), a portion of which encumbers the Subject Property(hereinafter"Easement Area"); and WHEREAS, the Easement Area is managed and maintained by La Residences at L'Ermitage Homeowner's Association,Inc;and WHEREAS, a pool deck and planters have been constructed on the Subject Property resulting in a 4.7-foot encroachment into the Easement Area along the westerly property boundary line,as shown on the survey attached hereto as Exhibit A(the"Encroachment");and WHEREAS, the County has no present objection to the continued use of the Encroachments within the Easement Area, provided that Ms. Page agrees to the terms and conditions set forth below. NOW, THEREFORE, in consideration of the sum of$10.00 and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties do hereby agree as follows: 1. The above recitals are true and correct and are incorporated herein. 2. Ms. Page will provide both the County and the Homeowner's Association whatever access they require to continue their non-exclusive drainage easement and maintenance easement rights and further agrees to waive any claim of damage to the encroaching pool deck and planters arising out of either the County's and Homeowner's Association's maintenance activities within the Easement Area,whether such damage is intentional or unintentional. 3. The County agrees that until otherwise notified,Ms. Page may continue the use of the pool deck and planters within the Easement Area. The County retains the right, however, in its sole discretion, to demand by written request that the Encroachments be removed from the Easement Area, which Ms. Page will do at her sole cost and expense within a reasonable time from receipt of such request. 4. This Easement Use Agreement shall be recorded in the Public Records of Collier County, Florida, at Ms. Page's sole cost and expense. This Agreement is intended to bind the Parties,together with their respective successors, assigns and heirs. The Easement was dedicated to the Association pursuant to the L'Ermitage at Grey Oaks Plat, recorded in Plat Book 31, Page 24, Public Records of Collier County, Florida, with maintenance responsibility.Given the minor nature of the encroachment into the Easement(as deoicted on the Survey) and based the Association's conclusion that said encroachments have not and will not interfere with its ability to maintain said Easement, the Association hereby approves the encroachments, consents to the continued existence of the encroachments, and further grants a variance for the encroachments that is intended to run with title to the Property and inure to the benefit to Nancy C.
