EXECUTIVE SUMMARY Recommendation to accept a status report describing the RESTORE Evaluation Committee's rankings of proposed projects submitted for possible RESTORE funds. OBJECTIVE: To provide the Board of County Commissioners (BCC) with the preliminary results of the RESTORE Evaluation Committee's rankings of proposed RESTORE projects. CONSIDERATIONS: Collier County has been identified as one of 23 Florida Gulf coastal counties to be impacted by the Deepwater Horizon oil spill of April 2010, and is therefore eligible to receive grant funding through the federal RESTORE Act. The amount of funding may be significant, but depends on civil penalties yet to be settled with parties determined responsible for the accident. The funding estimate for Collier County is between $5 million and $20 million. The Treasury Department published draft rules to implement the procedures required by the RESTORE Act on September 6, 2013, with a public comment period ending November 5, 2013. Final rules have not yet been published, but are expected by late Spring 2014. On February 26, 2013,the Board of County Commissioners (BCC) approved a process to receive and evaluate proposals that the BCC would ultimately fund with Collier County's share of the RESTORE funds. The BCC approved a RESTORE ACT information sheet (Attachment 1) and interest form (Attachment 2) to assist applicants in submitting project proposals. The BCC also established an Evaluation Committee comprised of: 1. City of Naples John Sorey III (Mike Bauer, Alternate) 2. City of Marco Island Dr. James Riviere (Bryan Milk, Alternate) 3. Everglades City Sammy Hamilton (Clarence Tears, Alternate) 4. The Conservancy of Southwest Florida Jennifer Hecker(Jeremy Franz, Alternate) 5. Rookery Bay National Estuarine Preserve Alberto Chavez 6. Big Cypress Basin Board Lisa Koehler 7. Tourism Development Council Clark Hill 8. Collier County Marine Industries Association Frank Perrucci The County received 35 proposals to evaluate by the BCC deadline of April 9, 2013. A summary of these proposals is found in Attachment 3. The actual proposals (Attachment 4) and other information have been posted on the County's RESTORE website (http://www.col1iercov.net/RESTOREAct). The Committee met on three occasions (May 17, 2013, June 21, 2013 and July 19, 2013) in publically noticed meetings to refine the process, establish the evaluation form in accordance with requirements of the RESTORE Act (Attachment 5), and rank the project proposals. In reviewing the initial proposals,the Committee found that some were lacking in completeness and allowed for supplemental information to be submitted by July 5, 2013. The Committee used this information in their scoring, finalizing the scores at their July 19, 2013 meeting. The Committee's ranking is found in Attachment 6. Packet Page-182- 3/25/2014 11 .C. The process approved by the BCC also specifies that the County Manager "will review the final list" and "the BCC will be presented with a final prioritized list of projects." On August 20, 2013, the County Manger received a briefing on the Committee's Ranked Proposals. At this time, the County Manager is supporting the Evaluation Committee's ranking to the BCC, subject to possible changes that may occur resulting from final rules from the Treasury Department. Staff had expected to have final rules from the Treasury Department by the end of 2013 in order to bring the proposed projects to the BCC knowing what may be required of the County in administering the RESTORE Grants. However, as noted above, the final rules have not been adopted as of the drafting of this Executive Summary. Without final Treasury rules, it is difficult to propose BCC approval of the Evaluation Committee's ranking. Based on the draft rules, there may be some additional information and public hearing/advertising processes that the County must follow. Moreover, the project rankings may be affected by the final Treasury rules. Once final rules are issued, staff will evaluate the requirements and assess compliance with our current process, and recommend a strategy to meet final rule requirements. At that time, if appropriate, staff would bring forward the Evaluation Committee's recommendations to the BCC for BCC approval. Currently, it is unknown as to the amount of money the County could receive, although estimates have ranged from $5 million to $20 million. For reference purposes, the projected project cost for the top-ten ranked projects is approximately $12.2 million. FISCAL IMPACT: There is no fiscal impact with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. - SAS GROWTH MANAGEMENT IMPACT: There is no growth management impact with this action. L � �b 5 .$�. ryt s[" 3.' �, e' i S 44r"am"F'.Sd ' Co Ter County RESTORE Act Following the Deepwater Horizon Oil Spill of April 2010 in which 11 workers lost their lives in the explosion and 200 million gallons of oil gushed unabated into the Gulf of Mexico for three months,the Florida Association of Counties (FAC) and a group of lobbyists advocated at the onset to assist the eight(8) most impacted"disproportionate"counties.As lobbying efforts in Washington, D.C.increased,FAC had included 15 "non-disproportionately,"or less affected, Gulf counties.Collier County is one of those 15. Since July 2012,County Commissioners and staff of Gulf coastal counties from Monroe to Escambia have been meeting monthly to address the RESTORE Act,which was sponsored by Senators Bill Nelson and Marco Rubio,and passed as an amendment in the federal Transportation Bill that was approved by the U.S.Congress,then signed by President Barack Obama in July 2012. Passage of the RESTORE Act-which means Resources and Ecosystems Sustainability,Tourist Opportunities,and Revived Economies of the Gulf Coast States Act of 2012 -may translate into millions of dollars for Gulf counties impacted by the oil tragedy and its repercussions. FAC officials have no expectations when the proceeds from the Clean Water Act penalties will benefit the Gulf Coast Restoration Trust Fund which then will be allocated to the following: • From the 35 percent"county"pot,funds will be split equally among Alabama,Florida, Louisiana,Mississippi and Texas.The funding could be anywhere from about$5 million to more than$20 million for Collier County. Local projects will be submitted and the County Commission will approve projects for allocations. • Re the 30 percent pot of money,the"federal"allocation,the Gulf Coast Ecosystem Restoration Council will implement a recovery plan. • The Consortium comprised of Commissioners directs the `state"pot of funding which is also 30 percent distribution.These funds are competitive and go to each of the 23 Gulf Coast counties based on projects reviewed by federal-state Council.
