EXECUTIVE SUMMARY
Recommendation to waive the contract project quote procedure and approve payment in
the amount of $26,800.00 to Quality Enterprises USA, Inc. for services rendered to
correct parking conditions in Bayview Park(Project#80060).
OBJECTIVE: To approve payment of invoice for services rendered under Purchase Order
#4500145622 for exigent circumstances in the amount of$26,800.00 to correct parking
conditions in Bayview Park.
CONSIDERATION: Construction at Bayview was completed on June 2, 2013. The original
design site plan called for grass paved parking provisions to provide an array of green
landscaping conditions. The completion of the project was during the rainy season of the year
and when the park re-opened to the general public, the grass paved parking conditions were
grossly saturated with excessive water settlement. Subsequently, the impact associated with
the heavy vehicle parking caused muddy parking conditions and unsightly results. This
unforeseen site condition created an urgent concern that needed to be corrected.
Staff requested an urgent repair quote from Quality Enterprises USA, Inc., who has an existing
contract (12-5864 Annual Roadway Contractors) with the County. A purchase order was issued
and the work was completed without having requested quotes from the other vendors on
contract as required under this agreement. Purchasing staff authorized the use of Quality
Enterprises without further quotes because this contractor completed the initial Bayview Park
project and because of the urgent need to correct the parking conditions.
FISCAL IMPACT: Funds for the Bayview Park Landing improvements in the amount of
$26,800.00 are available in Fund 306, Parks Capital Improvement Projects, and Fund 346,
Comm & Reg Park Impact Fees (Project#80060). Source of funds are General Fund and Parks
Impact Fees.
GROWTH IMPACT: There is no growth impact associated with this Executive Summary.
LEGAL CONSIDERATIONS: Section 30 of the Purchasing Ordinance No. 13-69 provides that
the Board "shall have the authority to waive any and all Purchasing Ordinance provisions within
lawful guidelines and upon formal Board action." This item has been approved as to form and
legality and requires majority vote for approval. - CMG
RECOMMENDATION: That the Board of County Commissioners waives the contract project
quote procedure and approves payment in the amount of $26,800.00 to Quality Enterprises
USA, Inc. for services rendered to correct parking conditions in Bayview Park (Project#80060).
