Agenda 01/28/2014 Item #16D14n 111\ 1/28/2014 16. D .14. EXECUTIVE SUMMARY Recommendation to approve Third Amendment to Agreement with the Collier County Housing Authority, Inc. (CCHA) for a Tenant Based Rental Assistance Project to extend the project completion date OBJECTIVE: Expend HOME funds for the Tenant Based Rental Assistance program (TBRA) to provide safe, secure housing for low income individuals /families. CONSIDERATIONS: The FY2011 -2012 HUD Annual Action Plan allocated $300,000 for CCHA to implement a TBRA. The agreement for CCHA was approved at the October 25, 2011 the Board of County Commissioners (Agenda Item #I 6D2) meeting. TBRA provides rental assistance, along with utility assistance and security deposits, for low income individuals /families to have safe, secure housing. Since the initial agreement was executed there have been two other agreement amendments for this project as follows: Amendment Number Board Date Agenda Number Amendment 1 February 12, 16D2 Revise match language, match amount, and certain 2013 scrivener's error to the agreement number and the match amount 2 October 22, 16D10 Extending the project completion date, update template 2013 language and revise the match language Prior to amendment #2 being approved Housing, Human and Veteran Services identified an issue with the required match obligation. CCHA was unable to meet the required obligation and 'it became necessary to suspend the program until a resolution was achieved. HHVS met with HUD technical assistance and received • direction on other allowable options to meet the match requirement. In response, Amendment #2 as approved by the BCC removed the match requirement from the CCHA agreement and achieved match compliance through the use of the state SHIP program. An additional time extension from January 31, 2014 to July 31, 2014 is set forth in the Third Amendment to allow CCHA to fully expend all remaining grant funds and re- institute the program to meet the needs of Collier residents who need rental assistance. CCHA has performed well to date and has actually served a greater number of beneficiaries than required under the agreement. The proposed modifications are allowable under the grant and will not increase the amount of grant funds or impact the budget for this project. FISCAL EWPACT: There will be no effect on ad- valorem or general funds dollars. Funds are available within the housing Grant Fund (705) FY2011 -2012 HOME Projects (33177). LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. - JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan.
