Agenda 01/28/2014 Item # 11B1/28/2014 11.B. EXECUTIVE SUMMARY Recommendation to approve a Memorandum of Understanding (MOU) with North Naples Fire Control and Rescue District (NNFD) that identifies a plan to develop an integrated building plan review and inspection platform that better serves our citizens and mutual customers. OBJECTIVE: To develop a fully integrated plan review and inspection platform between the Growth Management Division (GMD) and NNFD so that their mutual customers are served more effectively and redundant and non - essential reviews are eliminated. CONSIDERATIONS: On June 11, 2013, Item 10E, the Board authorized Commissioner Tom Henning to represent the Board and work with staff in evaluating and potentially negotiating County managed plan review and inspection services with the independent fire districts. Subsequently, staff attended fire district commission meetings and communicated with fire officials to discuss opportunities to consolidate the plan review and inspection service. In September, Commissioner Henning and staff attended an East Naples Fire Control and Rescue District (ENFD) meeting to offer a county sponsored plan review and inspection services. The ENFD declined to consolidate services under the county, but by a narrow margin voted to continue to work with the County to evaluate efficiencies. Golden Gate Fire Control and Rescue District (GGFD) Commissioners unofficially expressed the same opinion. Concurrently, Commissioner Henning and staff also contacted NNFD to inquire if they wished to consider consolidated plan review and inspection services. On November 14, 2013, the NNFD voted unanimously to direct Chief Orly Stolts to work with representatives from the GMD to evaluate the feasibility of restoring a unified plan review and inspection service. After our joint review of a unified plan review and inspection platform, NNFD and GMD identified the following benefits: • The restoration of the one stop shop concept with all services at one location would greatly improve customer service and communication • The use of common technology and communication platforms would improve service and streamline reviews • The elimination of redundant reviews and the delegation of non- essential reviews would improve customer satisfaction and reduce fees collected Based on that evaluation, Chief Stolts and staff developed several options and a draft MOU for the NNFD Board to consider. On January 9, 2014, the NNFD Commission voted 4 to 1 in favor of developing a new fire code official's office within the GMD building with direction to implement the benefits described above. Their proposal includes the following items: • The establishment of a Senior Plan Review or Inspection Chief that will have authority over plans review and inspection Packet Page -130- 1/28/2014 11. B. Imbedding their staff within the GMD using the same communication and plans review platforms Direction to streamline the process and eliminate redundant and non - essential reviews with a report back to their Board within six months after implementation documenting the improvements and cost savings Staff supports their proposal and believes it could be the first step to many additional improvements going forward. Both entities recognize that efficient and cost contained services along with the elimination of non - essential or duplicative reviews are an essential part of providing an environment conducive to economic development. We also recognize that we can be successful without sacrificing health and safety concerns. The attached MOU is nonbinding and the official agreements will be brought back to the Board for final review and approval. FISCAL IMPACT: There is no fiscal impact associated with this item at this item. The development of an updated interlocal agreement will include the revenue generated from lease operations, costs associated with implementing software, and establishing the office within the GMD. It is estimated that the lease will generate $35K to $55K annually and the initial set -up costs may run up to $55K. LEGAL CONSIDERATIONS: This item. has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. —JAK RECOMMENDATION: Recommendation that the Board approves the MOU with NNFD, authorizes the Chairman to execute it after NNFD executes it, and directs the County Manger or his designee to execute the plan identified within the MOU. Agenda Item # Agenda Packet Item To: Board of Fire Commissioners From: Fire Chief Orly Stolts Date: January 2, 2014 Subject: Request for Board Selection of Option to Pursue for the Provision of Fire Code Plan Review and New Construction Inspections Obiective: Obtain Board selection of option to pursue for the provision of fire code plan review and new construction inspections. Background Information: At the July 11, 2013 Board Meeting, the Board appointed Commissioner Hanson to work .-. with the Fire Chief and appropriate staff to meet with the representatives from the Collier County Growth Management Division to develop options for the provision of fire code plan review and inspection services. At the September 12, 2013 Board Meeting, Nick Casalanguida from the County Growth Management Division informed the Board that he has been given direction by the County Commission to determine if there is a more effective and efficient way to deliver fire code plan review and inspection service in the County, working with NNFD and East Naples Fire District. He requested Board approval to proceed with discussions to determine if a more efficient structure exists. The Board unanimously approved his request.. At the November 14, 2013 Board Meeting, staff presented the Board with four options for the provision of fire code plan review and inspection services: Make no changes to the existing structure. The Collier County Fire Code Official's office would continue to perform fire code plan review and NNFD would continue to perform the inspections related to new construction. NNFD would continue to receive revenue and absorb expenses for new construction inspections, and the Fire Code Official's Office would continue to receive revenue and absorb expenses for fire code plan review. 2. Collier County assumes both fire code plan review and inspections. Both the fire code plan reviewers and the fire inspectors would be employees of Collier County. Collier County would assume both revenue and expenses for both services. The Board must consider the statutory designation of the Fire Chief of Packet Page -176 - B7B/bb 12 -26 -13 1 1/28/2014 11.B. Agenda Item # Agenda Packet Item NNFD as the Authority Having Jurisdiction (Section 633, Florida Statutes), and whether or not the Board is willing to give up this authority. 3. NNFD assumes fire code plan review and retains fire inspection function, and co- locates the plan review service with Collier County plan review functions at the Growth Management Division offices. The fire code plan reviewers and inspectors would be employees of NNFD, and NNFD would receive revenue and absorb expenses for both services. 4. NNFD assumes fire code plan review and co- locates the plan review service with Collier County plan review functions at the Growth Management Division offices, and the County assumes the fire inspection function. The fire code plan reviewers would be employees of NNFD, and NNFD would receive revenue and absorb expenses for this function. The fire inspectors would be employees of Collier County and the County would receive the revenue and absorb the expenses for the inspection service. At that November meeting, the Board directed staff to proceed with further detail and analysis of options #3 and #4, with a report generated by January or February of 2014. Considerations: Staff has been in regular communication with County staff to review data and discuss the options, and has prepared a power point (Attachment 1) for presentation to the Board. In addition to NNFD Options #3 and #4, Collier County has also provided an alternative option. As identified in the attached power point, the goals of restructuring the delivery of services for fire code plan review and fire inspection are: ➢ improve Customer Service — alleviate problems experienced by the building industry related to the fire plan review and inspection process; streamline permitting process by imbedding fire plan review within Growth Management offices ➢ Improve Communication — Better communication between fire plan review and County building plan review (located in same office and using same software) and between fire plan review and new construction fire inspection ➢ Improve Efficiency— Eliminate fragmentation of fire plan review and new construction fire inspection B]Blbb 12 -26-13 Packet Page -177- 1/28/2014 113. Agenda Item Agenda Packet Item Overview of options and net impact: NNFD Option #3 — NNFD Assumes Fire Plan Review and Continues New Construction Inspections: ➢ improved Customer Service: • NNFD controls both fire plan review and new construction fire inspection within the District • Fire Plan Review and County Building Plan Review both located in Growth Management offices — improved communication and coordination o Fire Plan Review and New Construction Inspection employed by same agency — improved communication and elimination of fragmentation between fire plan review and inspection ➢ New Construction Inspections — Cost fully funded by fees (based on revised revenue projection reflecting upward trend of last 13 months — see Attachments 2 and 3). o NNFD Fire Chief has statutory liability and responsibility, and NNFD employs and manages inspectors and inspection process ^ o NNFD establishes fees and provides service ➢ Fire Plan Review — Cost fully funded by fees (based on revenue provided by Collier County and projection reflecting last 14 months — see Attachments 4 and 5) o NNFD adopts fees and codes that regulate what must be reviewed; NNFD employs and manages fire code plan reviewers Option 3 improves customer service, increases communication and efficiency, and results in no financial burden to Ad Valorem. NNFD Option #4 — NNFD Assumes Fire Plan Review and Collier County Assumes New Construction Inspections Utilizing NNFD Employee to Provide Oversight to Inspections: ➢ Improved Customer Service: • NNFD controls fire plan review within the District • Fire Plan Review and County Building Plan Review both located in Growth Management offices — improved communication and coordination HOWEVER, Option #4 could hinder coordination between NNFD fire plans review and Collier County new construction fire inspections BJMb 12 -26-13 Packet Page -178- 1/28/2014 11. B. Agenda Item #Z Agenda Packet Item • Process is still fragmented in the same manner as the current process (different agencies employ fire plan reviewers and new construction fire inspectors) even if oversight is provided by NNFD employee • Increases possibility of in -field deviations made by Collier County inspectors which may not be in accordance with NNFD Plans Review ➢ New Construction Inspections — Collier County reimburses NNFD for costs of supervising Captain /Deputy Fire Marshall; Collier County collects all new construction inspection revenue — current costs allocated to Inspection Fee Fund, except one employee costs reimbursed by County, would be absorbed by General Fund (Ad Valorem) o NNFD Fire Chief has statutory liability and responsibility, and County employs inspectors and manages inspection process; oversight of supervising employee may not be sufficient to allow adequate statutory control of process o NNFD establishes fees; Collier County provides service ➢ Fire Plan Review — Cost fully funded by fees (based on revenue provided by Collier County and projection reflecting last 14 months — see Attachments 4 and 5) o NNFD adopts fees and codes that regulate what must be reviewed; NNFD employs and manages fire code plan reviewers Option 4 improves customer service somewhat by co- locating County plan reviewers and fire code plan reviewers and utilizing the same software; however, it does not solve the problem of the fragmentation of the inspection and fire plan review functions that currently exists. Option 4 also results in an increased financial burden to Ad Valorem by transferred up to $360,000 in costs currently allocated to Inspection Fee Fund to the General Fund. While some of those costs may be offset by an increase in fees received for existing building inspections, no historical data yet exists to confirm amount of offset. Collier County Provided Alternative — NNFD Continues New Construction Fire Inspections and Collier County Assumes Fire Plan Review Utilizing NNFD Employee as Senior Plan Reviewer: ➢ Improved Customer Service: o Fire Plan Review and County Building Plan Review both located in Growth Management offices and both employed by same agency (County) — improved communication and coordination o NNFD controls New Construction Fire Inspection BJB/bb 12 -26 -13 Packet Page -179- 1/28/2014 1 1 3. There is no increase in Financial burden to NNFD Ad Valorem. There are ^ potential issues related to the Collective Bargaining Agreement. The County Attorney has prepared a draft of a Memorandum of Understanding (Attachment 6) which could accompany any of the identified options, and would be presented to the Board of County Commissioners following approval of the NNFD Board. Fiscal Impact: The fiscal impact of the options is as follows: Option 3: Option 4: ✓ New Construction Fire Inspections fully funded by fees ✓ Fire Code Plan Review fully funded by fees ✓ No financial burden on General Fund (Ad Valorem) ✓ New Construction Fire Inspection revenue collected by County - only 1 NNFD employee cost funded ✓ Fire Code Plan Review fully funded by fees ✓ New financial burden on General Fund (Ad Valorem) - up to $360,000 of costs currently allocated to Inspection Fee Fund would have to be absorbed by General Fund BJB/bb 12 -26-13 Packet Page -180- 1/28/2014 11.
