EXECUTIVE SUMMARY
Recommendation to accept six Offers of Judgment by Respondents in five pending Eminent Domain cases,
relating to Project No. 60040, the expansion of Golden Gate Blvd., for total compensation, including
attorneys' fees and costs, of the County's acquisition of Parcels 151RDUE, 160RDUEA, 160RDUEB,
164RDUE, 252RDUE, and 267RDUE. (Fiscal Impact: $15,386.00)
OBJECTIVE: To settle full compensation for the taking of Parcels 151RDUE, 160RDUEA, 160RDUEB,
164RDUE, 252RDUE, and 267RDUE required for the widening of Golden Gate Boulevard from Wilson
Boulevard to 20th Street East, Project No. 60040.
CONSIDERATIONS: On July 9, 2015 and July 30, 2015, the Court entered Orders of Taking vesting title of
Parcels 151RDUE, 160RDUEA, 160RDUEB, 164RDUE, 252RDUE, and 267RDUE to the County and directed
the County to deposit funds into the Court Registry as a good faith estimate of value of compensation for these
parcels. The parcels are all road right -of -way, drainage and utility easements required as part of the road
widening of Golden Gate Boulevard. On November 24, 2015, attorney for the owners of each parcel filed Offers
of Judgment with the Court. The County has 30 days from filing to accept the offers or they are deemed rejected.
The County Attorney's Office and staff are recommending acceptance of the Offers of Judgment, the amounts of
which are as follows:

ADDITIONAL COMPENSATION:
The County will also be required to pay an additional $340.00 for Clerk's Deposit Fees and approximately
$200.00 in recording fees. Upon approval of this item, the County Attorney's Office will formally accept
Respondents' Offers of Judgment.
GROWTH MANAGEMENT IMPACT: None.
FISCAL IMPACT: Funds in the amount of $15,386.00 will be paid from gas taxes and/or impact fees from
Golden Gate Blvd Project 960040. The primary funding source for the acquisition of right -of -way is impact fees.
Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes.
RECOMMENDATION: That the Board of County Commissioners accepts the Offers of Judgment by
Respondents in five (5) pending Eminent Domain cases for total compensation including attorneys' fees and
costs, for the taking of Parcels 151RDUE, 160RDUEA, 160RDUEB, 164RDUE, 252RDUE, and 267RDUE and
authorizes the payment of funds as stated herein.
