EXECUTIVE SUMMARY Recommendation to authorize the expenditure of $51,425 to provide intersection control at an area outside of Delnor- Wiggins State Park during peak times during the year and authorize the Chairman to sign a Law Enforcement Special Detail Agreement for the provision of these services. OBJECTIVE: To provide funding for the Collier County Sheriff's Office to manage the intersection in front of Delnor- Wiggins State Park. CONSIDERATIONS: For many years, the intersection of Gulf Shore Drive and Bluebill Avenue has been congested during the height of tourist season. During the months of December through May, major holidays, and select weekends during the year, the intersection becomes clogged due to traffic entering Delnor- Wiggins State Park. Recent construction of a circle driveway and bathroom facility by Collier County Government have improved conditions; however, during these peak times, patrons entering the Park cause traffic to stack from the entrance to the State Park on Bluebill past the bridge that connects from Conner Park to Delnor- Wiggins State Park. Recently, a workgroup was established by the County Manager's Office to address this issue. The Collier County Sheriff's Office, Florida Fish and Wildlife Conservation Commission, Florida State Park personnel, County Transportation staff and County Parks and Recreation staff met to conceptualize solutions to this issue. The workgroup has detennined that traffic safety issues are created on Bluebill Bridge by car or pedestrians attempting to enter Delnor- Wiggins State Park when the Park opens and after the Park reaches capacity. This proposal seeks to address the problem of entering the Park at opening; the workgroup will continue to work on solutions for when the Park reaches capacity. As part of the workgroup discussions, the Collier County Sheriff's Office approached the Parks and Recreation Director regarding support for a program to pay for off -duty Deputies to direct traffic at the intersection. The Collier County Sheriff's Office has used Community Volunteers in recent years, but the challenge of the intersection requires law enforcement personnel to provide for the public's interest (see attached email from Lt. Bohannon). There are currently no funds budgeted for this expense in the Parks and Recreation Division budget. If approved the Agreement would be effective from December 19, 2015 thru September 5, 2016. FISCAL IMPACT: Funds in the amount of $51,425 are required to support the Delnor- Wiggins intersection control service discussed herein. Though not specifically budgeted the importance of this service dictates that initial funding will be provided through the Parks and Recreation Division budget. Longer term funding from other sources is under consideration and if appropriate will be brought back to the Board at a future date. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. COLLIER COUNTY SHERIFF'S OFFICE :LAW ENFORCEMENT SPECIAL DETAIL AGREEMENT THIS AGREEMENT entered into this day December 8, 2015 by and between the Collier County Sheriffs Offices, KEVIN RAMBOSK, SHERIFF of Collier County, and Naples, Florida, hereinafter referred to as "CCSO" and Collier County hereinafter referred to as "CONTRACTOR", both of whom shall be referred to as the "PARTIES ". WITNESSETH: WHEREAS, the CONTRACTOR desires to obtain special Law Enforcement Services at Delnor - Wiggins State Park for Intersection Control in Collier County Naples, Florida WHEREAS, the CCSO has agreed to render to the CONTRACTOR professional law enforcement service, and the CONTRACTOR is desirous of contracting for such services upon the terms and conditions hereinafter set forth. WHEREAS, the CONTRACTOR is desirous of providing Law Enforcement services through a contractual relationship with the CCSO. WHEREAS, the Sheriff hereby agrees to provide such security and law enforcement as provided herein. NOW, THEREFORE, in consideration of the sums hereinafter set forth and for other good and valuable considerations, the receipt and legal sufficiency of which are hereby acknowledged, it is hereby agreed as follows: 1. For the purpose above, the Sheriff shall provide to the CONTRACTOR a detail at Delnor- Wiggins State Park consisting of two (2) deputies on the below listed dates to cover the time of peak public safety concerns from 9:30am to 2:30pm each shift: Weekends of December 19`h -20th, 2015; January 2nd -3rd, 2016 and January 9th- 10`", 2016 (due to School vacation and numbers counts) = 6 total days 100 Days (every day of the week) from Friday January 15, 2016 through Sunday April 24, 2016. 5 Holiday weekends (Saturday - Monday of Mother's Day, Father's Day, July 41", Memorial Day, and Labor Day) = 15 total days 121 total detail days x 2 deputies /day x 5 hours = 1210 hours 2. Such Law Enforcement Deputies shall perform normal law enforcement duties to provide for the health and security of persons in the immediate area of the above captioned event or location(s). 3 At all times pertinent to this contract, the Law Enforcement Deputies shall be assigned by and remain under the control of the Office of the Sheriff of Collier County, Kevin Rambosk Sheriff. Ownership and maintenance of equipment used in Special Details are the responsibility of the Collier County Sheriff's Office. Equipment assigned to a Deputy for use in the regular performance of duties shall be used during this Special Detail. All equipment remains the responsibility of the assigned Deputy and the ownership rernains with the Collier County Sheriffs Office. Packet Page -1498- 12/8/2015 16.D.21. 4. The CONTRACTOR shall pay as indicated under "Financial Arrangements" to the Office of the Sheriff of Collier County the actual cost to the CCSO of $42.50 per hour per deputy. The CONTRACTOR shall pay a minimum of (3) three hours per Deputy per day. A new contract shall require a full balance deposit prior to coverage being scheduled. The detail shall be subject to a final accounting. The balance remaining, if any, shall be invoiced to the CONTRACTOR upon a final time and mileage accounting being completed by the Sheriffs Office and shall be paid by the CONTRACTOR within five (5) days of receipt of the invoice. If an account is sixty (60) days past due then all contract law enforcement services will be terminated until payment is paid in full. FINANCIAL ARRANGEMENTS: Q Full Payment in Advance ❑ 50% Deposit Required ® No Deposit required/ Total Due Upon billing (as outlined below) CCSO Finance Department will mail out a bi- weekly invoice for details services during the billing time frame. Total Detail Cost is $51,425.00 as shown below (121 total detail days x 2 deputies /day x 5 hours = 1210 hours x $42.50 per hour = $51,425.00 total detail cost.). 5. The CONTRACTOR hereby agrees to indemnify the Sheriff against any and all claims against the Sheriff or the Office of the Sheriff of Collier County arising out of the use of the certified law enforcement deputies, subject to the limits of §768.28 Florida Statute, excepting only the negligence of the Sheriff or his Deputies. 6. The parties agree that the services provided for herein are not a guarantee of the health and safety of the patrons attending the above captioned event, but is the provision of regular law enforcement services commonly supplied by the Office of the Sheriff to the citizens of Collier County according to policies established by the Sheriff. 7. The parties agree that in the event of an off -site emergency requiring the services elsewhere of the law enforcement Deputies provided herein, that the Sheriff may be required to remove the Deputies to meet any such emergency, without penalty, and such removal shall not be deemed a breach of this Agreement. 8. Law Enforcement Deputies provided according to the terms hereof shall be paid according to the regular payroll procedures of the Office of the Sheriff, and no funds shall be transferred from the CONTRACTOR to any law enforcement Deputy, but such funds shall be paid directly to the Office of the Sheriff of Collier County. 9. The previous request was established back in 2005 and covered the year of 2006. As part of the Sheriff's direction regarding the traffic congestion issues we are encountering at this location we are exploring the idea of re- establishing this detail for the up- coming year (2016) with some adjustments as we discussed. This would allow us to safely get through the up- coming season while the Wiggins Pass Work Group works on a long range plan to address this problem. The Sheriff's Office has identified specific days /times during the calendar year in which the detail would provide the greatest impact to public safety /traffic congestion.
