EXECUTIVE SUMMARY Recommendation to approve a budget amendment recognizing recovery of County funds in connection with a claim involving a Collier Area Transit bus shelter. OBJECTIVE: To reinvest funds recovered from insurance proceeds back into the transit system. CONSIDERATIONS: On May 20, 2015, a Collier Area Transit local funded bus shelter located on the west side of Airport Road, just south of Immokalee Road, was damaged as a result of a commercial vehicle accidentally backing up and striking the shelter. The damage rendered the shelter obsolete and unusable. The claim in the amount of $15,128.60 represents the cost to repair the damaged bus shelter. On December 4, 2014, a Collier Area Transit grant funded bus shelter located on the east side of N 15th Street, just north of Roberts Avenue West in the Immokalee community, was damaged as a result of a fire. Staff hired a contractor to make repairs to the shelter and as a result the insurance company paid the contractor directly for the repairs made to the shelter. The bench located under the shelter was replaced by the County therefore a check in the exact amount of $1,711.00 for a new bench was issued to the Collier County. The total sum of $16,839.60 in damages was recovered through the subrogation efforts of the Collier County Risk Management Division for these 2 locations. FISCAL IMPACT: A budget amendment is necessary to recognize recovery funds in the amount of $16,839.60, within Collier Area Transit Fund 426, CAT Bus Shelter Project No. 60083. LEGAL CONSIDERATIONS: No legal issues are raised by this item which is ready for Board action and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: Transit capital and operations supports goals and objectives of the Transportation Element of the Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners recognizes and accepts the recovery of $16,839.60 in insurance proceeds as County funds and authorizes the necessary budget amendment.
