Agenda 12/08/2015 Item #11E12/8/2015 11. E. EXECUTIVE SUMMARY Recommendation to approve prorated refunds for fees paid for Vehicle for Hire licensing services in 2015 in the amount of $80,000. OBJECTIVE: To provide refunds for customers who paid fees for Vehicle for Hire licensing services in 2015 due to the repeal of the Vehicle for Hire Ordinance. CONSIDERATIONS: At its July 7, 2015 regular meeting, the Board of County Commissioners (Board) heard a Public Petition from Mr. Peternal Francois requesting that the Board regulate Uber and other transportation network companies, who do business from remote locations through apps on mobile phones and like devices, rather than the traditional taxicab business model. Following the Petition, the Board directed the County Attorney to bring back recommendations as to options with respect to this matter. The Board reviewed and discussed the options and directed the County Attorney to bring back an Ordinance to rescind the Vehicle for Hire Ordinance (Ordinance No 2009 -27). If the Ordinance to rescind the Vehicle for Hire Ordinance is approved by the Board at its December 8, 2015 meeting, staff recommends refunding those fees paid for the annual Vehicle for Hire licensing services, prorated based on the month of payment, for payments received on or after January 1, 2015. Each month remaining shall account for a credit of 1/12 of the actual payment. License revenues are collected on an ongoing basis and vary by month. FISCAL IMPACT: Total revenue collected for Vehicle for Hire licensing services in calendar year 2015 was approximately $185,000, received into 111- 100210. Prorated refunds based on the month of payment beginning on or after January 1, 2015, would be approximately $80,000. As no refunds have been budgeted in FY2016 for 111- 100210, it is necessary to process a budget amendment from Fund Ill reserves into 111- 100210. Current Fund (111) Reserves total $1,905,600. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: To approve prorated refunds for fees paid for Vehicle for Hire licensing services in 2015 and authorize the necessary budget amendment, in the event the Vehicle for Hire Ordinance is repealed.
