EXECUTIVE SUMMARY Recommendation to approve a resolution that establishes the annual fees, rates, and charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees, recycling drop-off center fees, and residential multi-family and commercial waste collection fees for FY16. This resolution adopts the rates that fund the FY16 budget for solid waste collection and disposal. OBJECTIVE: To set landfill tipping fees, recycling drop-off center fees, and residential multi- family and commercial waste collection fees for FY16. CONSIDERATIONS: The Solid and Hazardous Waste Management Division's budget is primarily based on the annual mandatory solid waste collection and disposal assessments, and user fees for the Collier County Landfill, the Immokalee Transfer Station, Household Hazardous Waste Collection Center, and four recycling drop-off centers (Marco Island, Naples, North Collier and Carnestown). These fees are critical to sustaining the Board of County Commissioners (Board)-approved Enduring Guiding Principles, which provide directives toward obtaining best value solutions, preserving valuable landfill (disposal) airspace, and the proper disposal of solid waste generated in Collier County. The fees outlined in the rate resolution support the Solid and Hazardous Waste Management Division's FY16 budget. These rates provide the revenue necessary to collect, process, recycle, and/or dispose of the wide range of waste generated in the county, including municipal solid waste. biomass (yard waste), construction and demolition materials, white goods and furniture, tires, electronics, household hazardous wastes, and recyclable materials such as paint, cardboard, scrap metal, glass and plastics. The proposed rates set the correct level of funding to retire costs associated with the demand for solid waste disposal, while planning for Collier County's future recycling and solid waste management needs. In FY16, the amount of biomass and construction and demolition materials accepted from individuals at the recycling drop-off centers will be reduced to ensure the county is not competing with private businesses. Residents will be encouraged to utilize the residential curbside collection program and private disposal facilities. Residential solid waste collection services in Collier County includes twice a week trash pickup. once a week recycling pickup, on demand bulky item and electronics pickup, once a week biomass (yard) waste pickup, and guaranteed recycling services. Residential curbside rates for FY16 will increase to $188.29 per residential unit for District I (greater Collier County), and $177.34 per residential unit for District II (Immokalee and northeastern Collier County), as approved by the Board at its September 8, 2015 meeting. The solid waste disposal service costs are supported by landfill tipping fees and the volume of disposed waste. At the Board of County Commissioners (Board) September 9, 2014. meeting under agenda item 17E, the Board approved Resolution 2014-174 that included Consumer Price Index-based rate adjustments for enterprise funds in the mid-cycle years when there is no rate study. The recycling drop-off center and landfill tipping fees are proposed to increase 2.13 percent for residential and commercial customers. Packet Page -1097- 9/22/2015 16.0.1 . FISCAL IMPACT: The proposed landfill tipping fees and recycling center fees will provide estimated FY16 revenues of $11,290,800 (Collier County Landfill $9,897,200; Immokalee Transfer Station $1,293,600; recycling drop-off centers $100,000; reimbursement residential curbside tipping fees $6,141,800) for the Solid Waste Disposal Fund (470). The mandatory solid waste collection and disposal assessments will provide estimated FY16 revenues of$21,572,800 for the Mandatory Trash Collection Fund (473). LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.—SRT GROWTH MANAGEMENT IMPACT: This rate resolution is in compliance with the Growth Management Plan, which provides for increased recycling and reuse of the solid waste stream. RECOMMENDATIONS: That the Board of County Commissioners approve the annual rate resolution to establish the fees, rates, and charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees, recycling drop-off center fees, and residential multi- family and commercial waste collection fees for FY16, and authorize the Chairman to execute the Resolution. RESOLUTION NO. 2015- RESOLUTION SUPERSEDING RESOLUTION 2014-192 AND ESTABLISHING THE FEES, RATES AND CHARGES FOR USE OF COLLIER COUNTY SOLID WASTE FACILITIES PURSUANT TO COLLIER COUNTY ORDINANCE NO. 84— 31. WHEREAS, Collier County has the responsibility and power to provide for the operation of solid waste management facilities to meet the needs of all areas of the County under the authority of Florida Statutes, Section 403.706; and WHEREAS, said statutory authority grants the Board of County Commissioners the power to prescribe, fix, establish and collect fees, rentals or other charges for the use of the established solid waste disposal system, and to pledge such revenues as security for the payment of bonds issued under said statutory authority for the construction of a solid waste disposal facility; and WHEREAS, Florida Statutes, Section 125.01(k)(1) and (2) grants the Board of County Commissioners the power to provide and regulate waste collection and disposal; and WHEREAS, The Board of County Commissioners, through its adoption of County Ordinance No. 84-31, as amended, has implemented the user fee system for Solid Waste to all public and private users, and WHEREAS, these rates reflect budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the County's generated waste.
