EXECUTIVE SUMMARY Recommendation to approve a Joint Motion for Final Judgment in the amount of $55,000.00 for full compensation as well as $8,517.00 in statutory attorney's fees, expert fees and costs for Parcel 161RDUE in the case styled Collier County v. Tara Chapin, et al., Case No.15 -CA -319 required for improvements to Golden Gate Boulevard (Project No. 60040). Fiscal Impact: $23,822.50. OBJECTIVE: To settle full compensation owed for the taking of Parcel 161RDUE required for the road widening of Golden Gate Boulevard from Wilson Boulevard to Desoto Boulevard, Project No. 60040, hereinafter referred to as the "Project." CONSIDERATIONS: On July 9, 2015, the County condemned Parcel 161RDUE in order to construct the Project. Pursuant to the Order of Taking, the County deposited a good faith estimate of value in the amount of $39,900.00 into the Court Registry. Parcel 161RDUE is 25 feet in depth and 73 feet wide across the front of the property owned by Tara Chapin and Darren Allison. The property is currently improved with a single - family home. Through negotiations parties agreed to full compensation in the amount of $55,000.00, which includes the property taken, improvements, and severance damages resulting from the reduction in the home's setback from 90 feet to 65 feet from the right -of -way. The parties also agreed to statutory attorney's fees and expert fees totaling $8,517.00. Attached is a Joint Motion and Final Judgment memorializing the terms of the settlement. If approved, the County will be responsible for the following additional funds: Additional Compensation Owed: $15,100.00 Attorney's Fees and Expert's Fees: $8,517.00 Clerk's Deposit Fee: $170.00 Est. Recording Costs: $35.50 Total: $23,822.50 The County Attorney's Office and Staff recommend approval of this settlement since a better result at trial is not expected. Upon approval, the County Attorney's Office will file the attached Joint Motion with the Circuit Court. FISCAL IMPACT: Funds in the amount of $23,822.50 will be paid from gas taxes and /or impact fees from Golden Gate Blvd Project # 60040. The primary funding source for the acquisition of right -of -way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. — ERP RECOMMENDATION: That the Board approves the attached Joint Motion and Final Judgment and authorizes the payment of funds as stated herein.
