EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners approves adding an agenda item to the September 10, 2015 legislative workshop for the Conservancy of Southwest Florida to present a ten minute informational presentation proposing environmentally responsible legislative priorities for consideration in the 2016 legislative session. OBJECTIVE: To have the Board recognize the valued input the Conservancy of Southwest Florida can provide in developing legislative priorities that can protect our natural resources. CONSIDERATIONS: Collier County has traditionally placed a high priority on preserving and protecting our natural resources. Our Growth Management Plan and Land Development Codes contain numerous regulations that protect the natural environment and focus on the preservation and safeguard of our water resources. However, our GMP and LDC are preempted from regulating oil exploration in Collier County, especially advanced techniques that are still yet poorly understood by our experts. Collier County land owners also have rights to farm, develop, and utilize the resources on their property to the greatest extent possible while balancing those rights with the impacts on the environment, their neighbors, and future generations. Collier County has a long history of traditional oil exploration and it is incumbent upon on our Board to find a balance between landowner mineral rights and regulating sustainable ecosystems and water resources. In 2014 and 2015, Collier County experienced a renewed interest in oil exploration due to the high price of fossil fuels. This interest led to the application of advanced extraction techniques known as high pressure stimulation or as more commonly known as "Fracking ". The Florida Department of Environmental Protection (FDEP) and Collier County have limited experience with Fracking and the potential negative short and long term impacts associated with this application on our water supply. The Conservancy of Southwest Florida also has long history of environmental protection and would like to participate in a meaningful review of current regulations and support our legislative delegation in developing new regulations. They have respectfully requested to participate in our legislative workshop with a short presentation that would outline their recommendations for legislative action. The recent reduction in fossil fuel prices has afforded all parties an opportunity to work together in developing sound practices for oil exploration. It is important that we as Board consider all the information available before moving forward with our 2016 legislative priorities. The Conservancy of Southwest Florida desires to be heard in an open forum and is willing to participate with Collier County, FDEP, and land owners in developing meaningful and fair regulations for future oil exploration. FISCAL IMPACT: None. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issue, and requires majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners directs the County Manager to add the Conservancy of Southwest Florida to the 2016 BCC legislative workshop agenda and provides a ten minute allocation for a presentation on oil exploration recommendations for Collier County's 2016 legislative priorities.
