EXECUTIVE SUMMARY
Recommendation to approve a Resolution re-affirming authorizing the closing of the acquisition of
the Real and Personal Property constituting the Golden Gate City System owned by the Florida
Governmental Utility Authority by Collier County Water Sewer District.
OBJECTIVE: To acquire the assets of the Golden Gate City System from the Florida Governmental
Utility Authority (FGUA) and to re-affirm the implementation of Collier County Water-Sewer District
(CCWSD) user rates for water, wastewater and irrigation quality water services.
CONSIDERATIONS: At the June 27, 2017 Board of County Commissioners (Board) meeting, item
11D, staff was authorized to initiate the final due diligence process to acquire the utility serving Golden
Gate City from FGUA. They found that the provision of Water and Wastewater utility services in the
Golden Gate Community by the County constitutes a public purpose and is in the best interests of the
health, safety and welfare of the County and its inhabitants.
At the November 14, 2017 meeting of the Board, agenda item 9B, the Board approved Resolution 2017-
222, finding the acquisition to be in the public interest, approving the financing for the acquisition, and to
take further steps necessary to close on the acquisition.
After due consideration of the facts and circumstances involved in this acquisition, as revealed by the
County’s due diligence and having held the required hearing and passed necessary resolution regarding
the analysis and financing of the acquisition, the Board re-affirms the authorization of the Chair, Vice-
Chair or their designees to sign all instruments reasonable and necessary to close the acquisition,
including, but not limited to, necessary financing and title conveyance documents.
At the January 23, 2018 meeting of the Board of County Commissioners, agenda item 11H, the Board
approved Resolution 2018-20 authorizing the issuance of not exceeding $43,000,000 Aggregate Principal
amount of a Collier County Water-Sewer District Water and Sewer Revenue Bond, Series 2018 to finance
the acquisition of certain Water and Wastewater Utility Facilities of the Golden Gate System.
This Resolution shall take effect immediately upon its adoption for the current FGUA utility service area
to be absorbed into and thereby expand the Collier County Water-Sewer District’s service areas.
FISCAL IMPACT: There is no fiscal impact associated with this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval.--SRT
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
RECOMMENDATION: That the Board of County Commissioners, Ex-officio as the Governing Board
of the Collier County Water-Sewer District, hereby re-affirms and authorizes the Chair, Vice-Chair or
their designees to approve the closing of the acquisition of the Real and Personal Property constituting the
Golden Gate City System currently owned by FGUA to provide Water and Wastewater services in
Golden Gate City, Collier County, Florida.
