EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (ITB) #15 -6488, Courthouse First Floor Renovations, to DEC Contracting Group, the lowest responsive bidder, in the amount of $1,747,815, which includes a $100,000 allowance for unforeseen conditions. OBJECTIVE: To construct a new courtroom on the I' floor of the Collier County Courthouse in the space currently occupied by the Probations Office and to construct new offices for the Probations Office in the space previously occupied by the Clerk of Courts Traffic and Cashiering. CONSIDERATION: In accordance with Florida Law (F.S. 318.1.8(13)), Collier County Ordinance 2009 -41 provides a supplemental funding source for improvements to the State Court System that is to be utilized upon approval by the Chief Judge and by the Board. On March 15, 2011, the Court Administration Office, in collaboration with the Facilities Management Division, identified the construction of additional courtrooms, Judges' Chambers, holding cells, and support offices as priorities for the Court system. Subsequent meetings further prioritized the rooms on the first floor as those required to meet the Court's most immediate operational needs. On August 20, 2014, the County Manager's Office submitted a letter, with an estimated budget provided by Facilities Management, to the Chief Judge recommending and requesting approval to use the supplemental funds to proceed with the design, permitting, and construction of one courtroom and offices for the Probations Office on the I' floor. Chief Judge, Hon. Jay B. Rosman, approved the request on September 5, 2014, and the Board of County Commissioners approved the budget funding for the project at the FY 2015 budget adoption hearing. After the design was updated to current building code, revised to the court's preferred layouts, and completed by AECOM USA Inc (Agreement # 13- 6164), ITB # 15 -6488 was publicly advertised on July 2, 2015. Notices were sent to 1,580 vendors, sixty -nine packages were downloaded, and three bids were received. Bids were opened on August 13, 2015. The results from the attached bid tabulation are summarized below. Their low bid is $47,815, or 2.99 %, more than the Engineers $1,600,000 estimate of the costs. The total award amount will be $1,747,815, which includes an owner's allowance of $100,000. Packet Page -511- 10/13/2015 11. E. FISCAL IMPACT: Funding in the amount of $1,747,815 is budgeted and currently available in Fund 181. The Court Maintenance Fund (181) is a dedicated Special Revenue Fund which accounts for and budgets state court facility capital projects paid exclusively from the surcharge imposed on non - criminal traffic infractions as set forth in Chapter 318 Florida Statutes. GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this action. LEGAL CONSIDERATIONS; This item has been approved as to form and legality and requires majority vote for approval. —SRT RECOMMENDATION: That the Board of County Commissioners awards ITB #15 -6488, Courthouse First Floor Renovations, to DEC Contracting Group and authorizes the Chairman to sign the attached agreement after final review and approval by the County Attorney's Office. Rosman, Chief Judge Twentieth Judicial Circuit 1700 Monroe Street Fort Myers, Florida 33901 Reference: Collier County Courthouse Capital Improvements / Fund 181 Dear Judge Rosman: As you may know, Florida law (F.S. 318.18(13)) provides that local governments may impose a $30 surcharge for any infraction or violation to fund "state court facilities." In compliance with the statutes, Collier County enacted Ordinance No. 2009 -41 which provides: Additionally, Collier County enacted Ordinance No. 2009 -41 that provides that (a) every person who pays a fine or civil penalty for any violation of a non - criminal traffic infraction pursuant to Chapter 318, Florida Statutes, and every person who pleads guilty or nolo contendere or is convicted, regardless of adjudication, of those offenses enumerated in F.S. 318.17, shall be assessed a surcharge of $30. This surcharge is in addition to any penalties imposed for non - criminal traffic infraction pursuant to Chapter 318, Florida Statutes, or imposed for criminal violations listed in F.S. 318.17. The ordinance further stipulates that (b) the Court shall order payments of this surcharge in all matters subject to this section. The court shall not waive this surcharge and (c) the funds collected pursuant to this section shall be used to fund state court facilities. Funds collected pursuant to this section shall be expended as provided by the Board of County Commissioners in consultation with the Chief Judge. The County, in accordance with F.S. 318.17, is requesting to utilize these monies for the following projects: 1) First floor Courthouse renovations and relocations to include: • Construct new courtroom on 1St floor. • Relocate Probation Office. Rewire and update the Courthouse data cabling to Cat 6 cabling throughout the building and provide chase space for cable organization and expansion. The cost of this project is estimated at $502,500. 3) Update and installation of new Terrazzo flooring to replace the current stained and cracked flooring in the lobby of the Courthouse at the request of Court Administration. Cost of this project is estimated at $172,500. 4) Modernize the five (5) elevators in the Courthouse including the judges', prisoners', and passengers' elevators and bring all up to the most recent County and State safety codes. Cost of this project is estimated at $700,000. 5) Update lighting and paint Courtrooms IA and 1B. Change out pendant covers in Rooms 3A and 3B. Replace wallpaper with paint in entry area to Courtrooms IA, 1B, 2B, 2C, 3 -3, 3C, 3B, 4A, 4B. Estimated cost of the project is $71,410.
