Agenda 02/13/2018 Item #16K302/13/2018 EXECUTIVE SUMMARY Recommendation that the Board refer the assignment of vacant seats amongst the remaining candidates to the Pelican Bay Services Division Board for recommendation to the Board at a later meeting. OBJECTIVE: For the Pelican Bay Services Division Board to recommend the assignment of vacant residential seats amongst the remaining 3 residential candidates. CONSIDERATIONS: This 11 member Board was established by Ordinance 2002-27 as amended. The Division provides landscaping services, including all public road maintenance and park areas, street lighting services, aquatic management services, beach cleaning, and the Clam Bay Restoration Project. It is the Division’s responsibility to provide the framework of long-term community planning so that residents can enjoy the benefits of Pelican Bay while ensuring both the social and financial well -being of the Pelican Bay Community. A list of the current membership is included in the backup. Mr. David Trecker’s (resident) term would have expired on March 31, 2019, but he resigned effective January 1st of this year. The terms for Gary Ventress (resident), Susan O’Brien (resident), and Peggy Pinterich (commercial/business) will expire on March 31, 2018. Swider Resident 2 Yes Susan O’Brien Resident 2 Yes There are currently 4 vacant seats on the Board, and as one of the candidates withdrew their name from the running, there are only 4 candidates. The Pelican Bay MSTBU Ordinance provides that “if the number of nominees for the position which they have been nominated (i.e., for the "residential interests" or for the "commercial/business/other interests") does not exceed the number of open members for that position, then there shall be no balloting for such position. Instead, the list of nominees for the position shall simply be forwarded to the Board of County Commissioners, who, following public hearing on the matter, will make the necessary appointments to fill said positions.” Since the number of candidates/applicants for the respective positions does not exceed the number of vacancies (residential and commercial), no election is necessary. The only order of business remaining is determining the length of term each residential candidate will be appointed to. The Residential Vacancies There are 3 candidates for 3 open seats. Two of the seats have terms which will expire March 31, 2022. Mr. Trecker’s now open seat expires March 31, 2019. The County Attorney recommends that the Board refers this matter to the Pelican Bay Services Division Board for a recommendation to this Board as to the length of term each residential candidate should be appointed to. The Commercial/Business Vacancy Since there is only one Commercial/Business vacancy, and Mr. Fabregas’s application was the only application received in that category, no balloting is required, and Mr. Fabregas’s application will be forwarded to the Board of County Commissioners at a later time for consideration to be appointed. 16.K.3 Packet Pg. 1578 02/13/2018 FISCAL IMPACT: None. Date Term DateRe-appt 2ndExpDate 2nd Term Work Phone Pelican Bay Services Division Board This 11 member Board was established by Ordinance 2002-27, as amended, to provide input to the Board of County Commissioners in carrying out the purposes of the Pelican Bay Municipal Service Taxing and Benefit Unit as set forth in the Ordinance; to recommend to the BCC an itemized budget, work programs, and priorities in accordance with the adopted budget or budget amendments. The board will exercise decision and control of the day to day operational affairs of the Unit to the maximum extent allowed by law, unless and except when there is some overriding governmental reason to do otherwise. Membership shall be 9 representatives of the residential interests within the Unit and 2 representatives of the commercial & business interests within the Unit. Terms are 4 years.
