EXECUTIVE SUMMARY
Recommendation to approve a Joint Motion for Stipulated Final Judgment in the amount of
$16,000 for Parcel 452RDUE, in the lawsuit captioned Collier County v. Alex D. Randolph, et al,
Case No. 17-CA-1472, required for the Golden Gate Boulevard Expansion Project No. 60145.
(Fiscal Impact: $7,370)
OBJECTIVE: To acquire Parcel 452RDUE and settle full compensation due for the taking which is
necessary for the construction of roadway and related drainage and utility improvements for the Golden
Gate Boulevard Expansion (Project 60145).
CONSIDERATIONS: On November 13, 2017, Collier County condemned Parcel 452RDUE and
deposited $8,800 into the Court Registry as a good faith estimate of value pursuant to an Order of Taking
in the case styled Collier County v. Alex D. Randolph, et al, Case No. 17-CA-1472. Parcel 452RDUE
was required for the construction of the Project and is a 5,040-square foot right-of-way perpetual, non-
exclusive right-of-way, drainage and utility easement on the east side of Golden Gate Boulevard over a
tract of land owned by Alex D. Randolph and Carolyn E. Randolph. See attached aerial. Through
negotiation, the parties agreed to total compensation in the amount of $16,000, which includes all
attorney’s fees, expert fees, and costs. The Joint Motion for Stipulated Final Judgment also expressly
requires the County’s roadway contractor to re-grade the Randolph’s driveway to allow for smooth
transition over the new sidewalk to the new edge of pavement of the travel lanes of Gol den Gate
Boulevard. These improvements are typically made by the County and already budgeted in the capital
improvement project. If approved, the County will be required to pay an additional $7,370, which
includes the $170 clerk’s fee to deposit into the court registry.
The County Attorney’s Office and Transportation staff recommend approval of this Stipulated Final
Judgment since a better result is not anticipated at trial. Upon approval, the County Attorney’s Office
will file the Joint Motion for Stipulated Final Judgment with the Circuit Court.
FISCAL IMPACT: Funds in the amount of $7,370 will be paid from gas taxes and/or impact fees from
Golden Gate Blvd. Transportation Capital Improvement Project No. 60145. The primary funding source
for the acquisition of right-of-way is impact fees. Should impact fees not be sufficient within a particular
project, the secondary funding source will be gas taxes.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been prepared by the County Attorney’s Office, is
approved as to form and legality, and requires a majority vote for Board approval. - JAB
RECOMMENDATION: To approve a Stipulated Final Judgment in the total amount of $16,000 for the
taking of Parcel 452RDUE in the pending case styled Collier County v. Alex D. Randolph, et al, Case No.
17-CA-1472, required for the widening of Golden Gate Boulevard, Project No. 60145.
