Agenda 02/13/2018 Item #16D 502/13/2018 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chair to execute Amendment No. 1 to the Parks and Recreation Outsourcing of County Marinas Agreement No. 12-5914R to allow the concessionaire to lease recreational and commercial boat docks usi ng the proposed Boat Dock Recreational/Commercial Use Agreement and approval to use the standard form Boat Dock Recreational/Commercial Use Agreement. OBJECTIVE: To provide recreational opportunities and marina services for Collier County citizens and visitors. CONSIDERATIONS: On January 8, 2013, (Item# 11E), the Board of County Commissioners (Board) approved the Parks and Recreation Division to outsource the four (4) County marinas (Caxambas, Cocohatchee, Port of the Islands, and Goodland) to Paradise Property Management Inc. Paradise Property continues to manage the four (4) marinas including Caxambas, Cocohatchee, Port of the Islands, and Goodland. This Amendment will offer clarification to the existing agreement to specify Paradise Property is authorized to lease the wet and dry boat slips for both recreational and commercial use using a standard form agreement and based on the standard rates outlined in the Parks and Recreation Fee Policy Resolution. Paradise has operated under their current agreement since it was approved by the Board; however, staff worked with the Risk Management Division and Real Estate Services Division to strengthen the previous agreement by benchmarking with other marina operations and adding language that clarified the responsibilities of both parties within the terms of the wetslip rentals. The Boat Dock Recreational/Commercial Use Agreement provides for standard fees including security deposits, restrictions on use, and insurance requirements for users. The Agreement also p rovides that no boat lifts are authorized to be installed at County owned marinas. The goal is consistency at all four (4) County owned marinas. FISCAL IMPACT: Under the existing agreement the Parks and Recreation Division receives four (4) percent of the total gross revenue of all four marinas. Annualized projected revenue is deposited through a Parks & Recreation cost center into the General Fund (001). FY18 budgeted concession revenue is $95,000. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this request. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. -CMG RECOMMENDATION: To approve and authorize the Chair to execute Amendment No. 1 to the Parks and Recreation Outsourcing of County Marinas Agreement No. 12-5914R to allow the concessionaire to lease recreational and commercial boat dock slips using the proposed standard Boat Dock Recreational/Commercial Use Agreement and authorize the County Manager or his designee to execute the Boat Dock Recreational/Commercial Use Agreement.
