EXECUTIVE SUMMARY Recommendation to approve a Right of Entry to the Southwest Florida Research and Education Center (SWFREC) University of Florida, Institute of Food and Agricultural Sciences (UF/IFAS) to install, maintain and monitor groundwater monitoring wells at the Pepper Ranch Preserve as part of the Lake Trafford Watershed Boundary Study. OBJECTIVE: To grant a right of entry to Southwest Florida Research and Education Center (SWFREC) University of Florida, Institute of Food and Agricultural Sciences (UF/IFAS) for access, construction, and maintenance of up to eleven (11) groundwater monitoring wells at the Pepper Ranch Preserve. CONSIDERATIONS: SWFREC- UF/IFAS is requesting permission to install 11 shallow ( <10 ft) monitoring wells at the Pepper Ranch Preserve as part of the Lake Trafford Watershed Boundary Study. Preliminary estimated coordinates and mapped locations for the wells have been determined but may be changed after a field visit during July- August 2015. SWFREC- UF/IFAS's study will enhance understanding of the water and nutrient inputs and outputs to Lake Trafford and aid in development of a robust management plan to achieve water quality goals for the lake. The study in the Lake Trafford basin includes installing groundwater monitoring wells at selected locations in the basin to develop an accurate watershed boundary map. The results from this study will help SWFREC -UF /IFAS and the County plan water quality improvement projects that will help restore Lake Trafford. In order for SWFREC -UF /IFAS to install, maintain and monitor the monitoring wells, it will be necessary to grant SWFREC- UF/IFAS access in the form of a Right of Entry. The duration of the Right of Entry is two (2) years and may be automatically renewed for one year. FISCAL IMPACT: All associated costs with this transaction will be paid by Conservation Collier, as a project partner. Funds in the amount of $100.00 for recording of the Right of Entry are available to be withdrawn from the Conservation Collier Land Management Trust Fund (174). GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. LEGAL CONSIDERATION: This item is legally sufficient and requires a majority vote for Board action. RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida: 1) Approves and authorizes the Chairman to execute the attached Right of Entry; and 2) Directs the County Manager or his designee to proceed to follow all appropriate closing procedures and to record the aforementioned document in the Public Records of Collier County, Florida. The maximum depth of the monitoring wells will be 10 ft. below the ground level and they will be screened for the entire depth. The monitoring data from these wells will be used to evaluate the flows from and to the Pepper Ranch. These flow assessments will be used to delineate the watershed boundary for the Lake Trafford under a project funded by the Big Cypress Basin office of the SFWMD. The specific locations for these will be determined after a detailed field visit during July- August 2015. Depending on the detailed field visit, no more than 11 wells will be installed (two transects of four and one transect of three). Preliminary estimated coordinates for monitoring well locations are shown below in Table 1. The locations (preliminary) of these wells are shown in Figure 1. ADDITIONALLY, the rights and interest granted hereunder are conditioned upon the reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably interfere with Grantor's use of the lands described in Exhibit "A ", and agrees to provide Grantor with advance notice when exercising its rights hereunder. Grantee shall indemnify, defend, save and hold harmless the Grantor against and from, and to reimburse the Grantor with respect to, any and all damages, claims, liabilities, laws, casts and expenses. Grantee further agrees that it shall, at the Grantee's cost, repair any damage caused to Grantor's property as a result of Grantee's exercise of its rights hereunder.
