EXECUTIVE SUMMARY Recommendation to accept an extension of the expenditure deadline on Fiscal Year 2012/2013 grant allocations from the Florida Housing Finance Corporation to December 31, 2015 for the State Housing Initiatives Partnership (SHIP) program. OBJECTIVE: Provide a housing rehabilitation program to eligible homeowners throughout Collier County. CONSIDERATIONS: On July 7, 1992, the Florida legislature enacted the William E. Sadowski Affordable Housing Act to provide additional funding to local communities to promote and advance affordable housing initiatives. Funds are generated through documentary stamp tax on real estate transactions. Under the State Housing Initiatives Partnership (SHIP) program, Collier County and the City of Naples receive funds from the State of Florida through the Florida Housing Finance Corporation to undertake eligible activities as outlined in the Board adopted Local Housing Assistance Plan. On May 13, 2015, Community and Human Services Division (CHS) requested an extension to the 12/13 allocation and this request was granted by Florida Housing Finance Corporation (FHFC) for Collier on June 8, 2015. This extension allows the County to expend the SHIP funding until December 31, 2015. FHFC does not require the Board Chairman to sign a document for the extension to take effect. However, in order to properly document the extension, staff is requesting that the Board accept the extension so that it is identified in official records. FISCAL IMPACT: The proposed action described in this executive summary has no new fiscal impact. The funding source for the grant is the Florida Housing Finance Corporation. Funds are budgeted within SHIP Grant Fund 791, Project, 33222. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. -JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners accepts an extenstion on Collier County's SHIP 2012/2013 funding granted by Florida Housing Finance Corporation. This twelve month extension will allow Collier County to expend all of FY 2011/2012 SHIP funds by June 30, 2015 extension deadline granted by your office and to expend as much FYI 3/14 allocation prior to the September 30, 2015 expenditure deadline. Collier County currently has $250,000 of our allocation ncumbered in a contract for our rehab program. According to Rule 67 -37, which governs the SHIP program, exceptions to the timeframe, are allowable under certain conditions, as detailed below: The funds deposited to the local housing assistance trust fund must be spent within twenty-four months from the end of the applicable State fiscal year. Exceptions to this time frame must be approved by a majority vote of the Review Committee on a case -by -case basis. Exceptions will only be granted for good cause. Examples of good cause are natural disasters, requirements of other State agencies, adverse market conditions, and unavoidable development delays. Adequate documentation must be presented to the Review Committee before an extension will be granted, e.g., project status, work plan and completion schedule, commitment offunds, etc. Florida Housing believes that your current situation warrants an extension based on the reasons presented in your correspondence. Therefore, your deadline to expend funds for the 2012/2013 fiscal year is extended by six (6) months. The new deadline is December 31, 2015. We do stipulate, however, as a part of this extension, when requested, the County provide the Corporation a written update outlining the status of the current spending. Please keep in mind that you are still required to submit an annual report on September 15, 2015. The Corporation commends your continuing efforts to benefit the citizens of Florida through the SHIP program.
