EXECUTIVE SUMMARY Recommendation to adopt a resolution authorizing the condemnation of those perpetual and temporary easement interests necessary for the construction of a replacement bridge on White Boulevard over the Cypress Canal. (Transportation Bridge Replacement Program Project No. 66066.) Estimated fiscal impact: 5570,000. OBJECTIVE: To acquire easements necessary for the construction of a replacement bridge on White Boulevard over the Cypress Canal ( "the Project "), being part of the Transportation Bridge Replacement Program. (Project No. 66066). CONSIDERATIONS: The Board of County Commissioners ( "the Board ") has been advised through various communications of the need for construction of the Project. The existing bridge was built in 196 and has periodically been repaired. In its most recent biennial report, the Florida Department of Transportation classified this bridge as "Functionally Obsolete" (meaning that the bridge is built to standards no longer used today) and is "Scour Critical" (meaning the bridge is at high risk during a channel scour event, such as a storm). As a result, on July 8w, 2014 the Board found that a valid public emergency existed regarding the replacement of this bridge. Road right -of -way, drainage and utility easements are required for the treatment of stormwater run -off due to the addition of impervious surfaces (wider bridge lanes and sidewalks on both sides of the travel lanes). Provision of these stormwater treatment areas are a condition for the issuance of an Environmental Resource Permit by the South Florida Water Management District. Temporary driveway restoration easements are needed for the reconstruction of driveway aprons, and temporary construction easements are needed for the construction of both a ternporary bridge and the permanent bridge and related improvements. Project scheduling requires that authority be granted for the condemnation of these easements to ensure that construction is not delayed if the easements are not acquired in a timely manner through negotiations. The Board's professional engineering staff and consultants have considered various factors during the design of the Project, including alternative alignments, public health, safety and welfare, long range planning needs, environmental impacts and cost. The Board is referred to the attached technical memorandum prepared by Daniel W. Brundage, P.E., of Agnoli, Barber & Brundage, Inc. By its review, concurrence and approval of this executive summary, the back -up documentation, and the proposed resolution. the Board will have determined that the easements (each legal description which is attached to the resolution) represent the most feasible location and must be acquired for construction of the proposed improvements. The Board is further advised that it is necessary and in the public's best interest to acquire, by condemnation if necessary, the easements specified on each legal description attached to the resolution. In addition to the direct cost of the easements required for construction (the market value of the property rights being taken), the condemning authority must also fully compensate the property owner for all losses suffered as a result of the taking of the property or as a result of the construction of the proposed improvements. The state and federal constitutional guarantee of full and / or just compensation in exchange for the sovereign's taking of private property for public purposes extends to and includes the costs to mitigate damages to remaining properties ( "cost -to- cure" expenses) caused as a result of the loss of the part taken to construct the Project. In addition, under Florida law the condemning authority is responsible for the payment of business damages, all expenses for title work, real estate appraisals, and those expenses related to condemnation when necessary, such as property owner attorney fees and expert Packet Page -1151- 6/23/2015 16.A.23. witness fees, according to Sections 73.091 and 73.092, F.S. To the extent settlements are achieved in lieu of litigation, these costs may be reduced significantly. Recent revisions to the legal descriptions and sketches attached to the Condemnation Resolution have delayed the preparation of appraisal reports. Due to the urgency of the Project, this condemnation resolution is being brought before the Board for approval without these reports. In compliance with Section 73.015(1), F.S., appraisal reports will be obtained for each parcel before statutory offer letters are mailed and any funds are expended. All settlements will be brought back to the Board for final approval. FISCAL IMPACT: Funds in the amount of 5570,000 are available in the Transportation Bridge Replacement Project No. 66066. Source of funds is gas tax. Since the County already maintains the asset, minimal to no maintenance costs are expected to be incurred within the first 5 to 7 years for the new bridge. The expected actual useful life of the bridge is estimated to be 75 years. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - ERP GROWTH MANAGEMENT IMPACT: As part of the County's proposed 5 year transportation work program, the Transportation Bridge Program Project is an integral part of Collier County's Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners of Collier County: 1. Adopt the attached Condemnation Resolution, 2. Authorize its Chairman to execute same on behalf of the Board; and 3. Authorize any budget amendments that may be necessary to implement the collective will of the Board as evidenced by the adoption of the attached Resolution and the approval of this Executive Summary. Brundage, PE To: Anthony O. Stolts, PE A. Introduction The Florida Department of Transportation (FDOT) is required to inspect every bridge in the State of Florida at least every two years. Upon inspection of the bridges the FDOT forwards the biennial reports to the municipalities having jurisdiction for action. Collier County has initiated a Transportation Bridge Repair and Replacement Program to address the structural deficiencies that are reported by the FDOT inspection program. The Collier County Bridge program will address repairs, reconstructions and replacements of its bridge inventory through this program. The Collier County Board of County Commissioners found that a valid public emergency exists with regards to the White Boulevard Bridge based upon the following factors. • Classification by the Florida Department of Transportation of the existing bridge as "Functionally Obsolete" (meaning the bridge is built to standards no longer used today); • Classification by the Florida Department of Transportation of the existing bridge as "Scour Critical" (meaning the bridge is a "High Risk" during a channel scour event such as a storm); • Delays in the replacement of the bridge have disrupted planned continuity of the sidewalk recently constructed on the north side of White Boulevard just east and west of the bridge resulting in new public safety concerns; • Without the bridge replacement the sidewalk will remain discontinuous, which encourages through sidewalk traffic to transition to the roadway and cross the existing bridge before transitioning back to the sidewalk. This is very hazardous as the existing bridge has inadequate shoulders or approaches to safely service pedestrian traffic. Packet Page -1155- aiolzion19 i 5.A.23. PROJECT LOCATION B. Project Description White Boulevard is a two -lane undivided rural roadway located in a residential neighborhood in the northeast Golden Gate Estates Community of Collier County and is on a school bus route. The two - span existing bridge carries a tangent section of White Boulevard over the Cypress Canal. It is located 1.03 -miles east of CR 951 (Collier Boulevard). The posted speed limit on the roadway is 45 mph and there are adjacent driveways in close proximity on both approaches to the existing bridge. There is a 30 inch raw watermain supported on an aerial crossing very close to the south bridge fascia and a 2 inch conduit is attached to the bridge on the north side of the bridge that contains telephone and /or cable TV line. The project will include construction of a new bridge at the Cypress Canal using concrete components for the superstructure, intermediate bents, end bents and wingwalls. The new bridge will accommodate two 12 -foot lanes (one in each direction), 4 -foot paved shoulders, 6' -6" sidewalks /curbs and traffic railings. Approximately 327 feet of roadway to the west of the proposed bridge and 351 feet of roadway to the east of the proposed bridge will be improved. The roadway cross - section consists of two (2) 12 -foot lanes (one in each direction), 4 -foot paved shoulders and a 6 -foot sidewalk on each side of the road. C. Need for Transportation Improvement The White Boulevard Bridge was built in 1965 and has periodically been repaired. An Assessment and Recommendation Report was developed in April of 2011 for the subject bridge. The primary purpose of the study was to set forth a plan of action for immediate repair /rehabilitation or replacement of the bridge by evaluating functionality, safety and cost. The evaluation report considered three recommendations consisting of 1) maintenance repairs and upgrade railings, 2) widen the bridge and superstructure replacement, and 3) bridge replacement. The conclusion and recommendation of the report was to replace the existing bridge within 5 to 10 years. This is also our recommendation. Construction of the subject bridge at the Cypress Canal will meet the requirements of the transportation Growth Management Plan (GMP), increase safety, and calm traffic along the subject section of White Boulevard. Existing Conditions The existing White Boulevard Bridge is a two -lane undivided, two span, prestressed concrete channel beam structure with two 21 foot spans for a total length of 42 feet. Tile total out to out width is 28' -8" and the curb to curb width is 24' -11 ". The superstructure consists of an asphalt wearing surface on precast, prestressed concrete panels. The panels are simply supported spans with transverse joints over each bent and longitudinal joints between the panels. The substructure consists of a concrete bent supported on piles. The existing bridge does not have sidewalks or pedestrian railings. The principal concerns with the existing bridge relate to the insufficient or substandard operational, functional, maintenance and public safety design criteria. E. Evaluation Factors 1. Alignment Several alternative alignments were studied for this project. The first alternative involved stage construction of the proposed bridge. This would consist of closing one -lane on the bridge to traffic and building the closed -half of the bridge and then shifting traffic onto the new portion of the bridge so the other half of the old bridge could be closed to traffic and rebuilt. This method is problematic since it would increase the cost and duration of the project while also presenting some safety concerns due to one -way traffic controlled with a temporary signal. The second option consisted of closing the bridge - crossing during construction and detouring the traffic around the project via Collier Boulevard, Golden Gate Boulevard and 31st Street SW. While the detour option is the cheapest solution, it would force vehicles to travel several miles out of their way. This type of detour has not garnered favorable responses from local citizens on past projects. The final alternative was the use of a temporary bridge and bypass road adjacent to the existing White Boulevard bridge location. The temporary bridge allows the existing bridge to be demolished and replaced within the same alignment while increasing the profile elevation to meet the SFWN4D requirements over the canal. Most importantly, as mentioned above, the temporary bridge maintains the existing flow of traffic in the area. The next step for the temporary bridge was to review whether it should be located on the north or south side of the existing bridge. Due to a 30" raw watermain located on the south side of the existing bridge and to reduce impacts to private residences, the best location for the temporary bridge and bypass road was on the north side of the existing bridge. This alternative, with the temporary bridge located on the north side of White Boulevard, was considered the most effective design and is the recommended alignment. 2. Proposed Typical Sections In order to meet the long term requirements of the transportation Growth Management Plan (GMP) for White Boulevard the proposed typical section calls for two 12 foot travel lanes, with 4 foot paved shoulders and two 6 foot sidewalks on each side of the roadway. This proposed typical section is also required for the proposed bridge. Ditches are also required in order to maintain the existing drainage patterns and outfall for White Boulevard. The proposed bridge will have a total length of 94 feet, a total out to out width of 50' -2 ", and a curb to curb width of 35 feet. Environmental Factors A listed plant and wildlife species survey was conducted to determine whether the proposed area of construction was being utilized by state or federally listed species. The project was surveyed for wildlife species listed by the FWCC and the U.S. Fish and Wildlife Service (USFWS) as endangered, threatened, or species of special concern; and for plant species listed by the Florida Department of Agriculture and Consumer Services (FDACS) and the USFWS as endangered, threatened, or commercially exploited. The survey was conducted by qualified ecologists walking meandering transects through all habitats to ensure that sufficient visual coverage of ground and flora was obtained. No listed animal or plant species were observed on the Project at the bridge site during the May 25, 2012, survey. 6. Costs The design for the White Boulevard Bridge over the Cypress Canal has incorporated modifications from lessons learned from the recently completed White Boulevard over Golden Gate Canal Bridge Replacement Project. The modifications will allow for a reduced time of construction and associated costs. Costs were considered in determining what right -of -way was needed for the project. F. Summary of Proposed Improvements The site generally involved the following for the bridge replacement: I . Limited site clearing, 2. General private utility relocations; 3. Relocation of the Collier County 30" raw watennain on new foundations; 4. Construction of a temporary bridge and roadway to maintain the flow of existing traffic. 5. Bridge approach fill; 6. Canal restoration 100' up and downstream to design section; 7. Related slope stabilization; 8. Replacement of water management infrastructure to include baffle boxes. drainage inlets, mitered end sections, and outfall pipes to the canal; 9. Installation of pavement and sub - grades for the approach roadway; 10. installation of pilings, piling caps, bridge deck, sidewalk, and railing; 11. Embankment stabilization after construction to include sod and rip -rap, and; 12. Restoration of driveways and mailboxes. RESOLUTION NO. 2015- A RESOLUTION AUTHORIZING THE CONDEMNATION OF THOSE PERPETUAL AND TEMPORARY EASEMENT INTERESTS NECESSARY FOR THE CONSTRUCTION OF A REPLACEMENT BRIDGE ON WHITE BOULEVARD OVER THE CYPRESS CANAL. (TRANSPORTATION BRIDGE REPLACEMENT PROGRAM, PROJECT NO. 66066.) WHEREAS, the construction of a replacement bridge on White Boulevard over the Cypress Canal (hereinafter referred to as the "Project "), being part of the Transportation Bridge Replacement Program (Project No. 66066), is included in Collier County's Five Year Transportation Work Program; and and WHEREAS, plans and specifications have been prepared for construction of the Project; WHEREAS, construction of the Project will require the acquisition of both perpetual and temporary easement interests; and WHEREAS, the location for the construction of the proposed bridge has been fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A ", attached hereto and incorporated herein; and WHEREAS, after consideration of the availability of alternate routes and locations, the comparative costs of the Project alternatives, various impacts upon the environment, long range planning options, and public safety considerations, the Board desires to exercise its right to condemn property for public purposes. NOW, "THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that it is necessary and in the public's best interest to acquire the perpetual and temporary n9 Packet Page -1161- 6/23/2015 16.A.23. easement interests described in Exhibit "A" ( "the Property") for the purpose of constructing a replacement bridge on White Boulevard over the Cypress Canal to be used by the public, being part of the Transportation Bridge Replacement Program (Project No. 66066), in order to protect the health, safety and welfare of the citizens of Collier County. AND IT IS FURTHER RESOLVED that acquisition of the Property and construction of the Project upon the Property is an integral part of the County's long range planning effort, and is included in the Capital Improvement Element of the Collier County Growth Management Plan, as approved by the Florida Department of Economic Opportunity. AND IT IS FURTHER RESOLVED that the Board has considered the presentation and reviewed the technical report concerning alternative locations for the Project, various impacts to the environment, public health, safety and welfare considerations associated with the design and construction of the Project, and the costs associated with the design, property rights acquisition, and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A ", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that the taking of the perpetual non- exclusive road right -of -way, drainage and utility easements will provide the County with the right to place and /or excavate materials for the purpose of constructing, operating, and maintaining bridge, roadway, bikepath and sidewalk improvements, drainage structures including but not limited to canals, ditches, swales, earthen berms, rip -rap, retaining wall systems, underground pipes and various types of water control structures, and any and all manner of public and private utility facilities within the easement areas. These easements also include the right to remove and use any and all excavated material. AND IT IS FURTHER RESOLVED that the taking of the temporary driveway restoration easements will provide the County with the right to place and/or excavate materials for the purpose of reconstructing residential driveway aprons so that the existing driveways will transition from their current elevation to the elevation of the pavement immediately adjacent thereto. AND IT IS FURTHER RESOLVED that the taking of the temporary construction easements will provide the County with the right to place and /or excavate materials for the purpose of constructing temporary bridge, roadway, public and private utility improvements, and removing such improvements after the permanent bridge has been constructed, and new residential driveway aprons so that the subject properties will transition from their current elevation to the elevation of the pavement immediately adjacent thereto, all within the temporary construction easement areas, and for the purpose of constructing permanent bridge, roadway, bikepath and sidewalk improvements, drainage structures including but not limited to canals, ditches, swales, earthen berms, rip -rap, retaining wall systems, underground pipes, various types of water control structures and any and all manner of public and private utility facilities in the public right -of -way immediately adjacent thereto. -Page 3- Packet Page -1163- 6/23/2015 16.A.23.
