EXECUTIVE SUMMARY
Recommendation to waive the Purchasing Ordinance for purchases to Commercial Energy
Specialists over $50,000 and as a sole source supplier for a period of five years to support the
chemical and pool filtration systems.
OBJECTIVE: To ensure the safety of the public by complying with Health Department regulations
with proper chemical control systems.
CONSIDERATIONS: When the Sun-N-Fun Lagoon Water Park was constructed the chemical control
system originally installed was Stranco-Strantrol Systems and manufactured by BECS Technologies. In
2005, BECS made the decision to distribute aquatics controllers and replacement parts to Commercial
Energy Specialists, (CES). BECS has identified CES as the sole source for sales, service and warranty
administration within the Florida and Caribbean region for the BECS chemical controllers.
Sun-N-Fun Lagoon Water Park currently has seven (7) of the BECS controllers which monitor chemicals
for every pool in the park. On May 7th, staff identified during a daily inspection that the chlorine level in
the family pool was high, yet the controller was reading normal. Staff also noticed the activity pool had
no chlorine and the controller level was high. At that point, staff recalibrated the controller. The system
returned to normal until May 11th when the family pool had no chlorine and the activity pool controller
was reading high. Staff recalibrated again and monitored the system for several days. On May 15t when
the same situation arose, staff manually balanced the pool chemicals to comply with Health Department
Regulations and called CES for a diagnostic service at no cost to the County. As a result of the diagnostic,
CES determined that the controllers were not functioning properly. Staff requested CES to provide the
County with a quote of the items required to keep the system in proper operation.
If these controllers are not repaired, staff would need to continue to manually balance pool chemicals.
This process has been identified as a potential safety issue by the County's Risk Management Division.
Similar to the chemical controllers,the EKO3 filter system, also installed at the Sun-N-Fun Lagoon Water
Park, has identified CES as the sole distributor in the State of Florida; a letter from the manufacturer is
attached.
Staff has requested a reduction/discount from CES in order to ensure the best price for the County. In
summary, CES has agreed to extend a 15% discount on all BECS and EKO3 equipment to the County for
five years. Staff will evaluate pricing and emerging market conditions on controller and filter systems
each year to determine if new products or distribution channels exists, or if pricing becomes prohibitive to
use CES.
Staff requests that the Board recognizes CES as the sole distributor for sales, service and warranty
administration of the BEC controller system and the EKO3 filter system; and grants a waiver of
competition [Purchasing Ordinance Sections 9: Formal Competitive Threshold; B2 and 4] for all
purchases, even those greater than fifty thousand ($50,000) for five (5) years from the date of this
executive summary.
CERTIFICATION BY THE PURCHASING DIRECTOR: By approval of this Executive Summary,
the Purchasing Director certifies that it is in the best financial interest of the County to authorize
Commercial Energy Specialists as the sole distributor in the State of Florida for EKO2 and BECS
chemical controller and filter system for the Parks and Recreation system.

FISCAL IMPACT: Funds are budgeted in the Parks and Recreation operating and capital budgets
which are Board approved every fiscal year.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires
majority vote for approval.—CMG
RECOMMENDATION: That the Board of County Commissioners recognizes Commercial Energy
Specialists as the sole distributor for sales, service and warranty administration of the BEC controller
system and the EKO3 filter system, and grants a waiver of competition [Purchasing Ordinance Sections
9: Formal Competitive Threshold Sections B2 and 4] for all purchases, including those greater than fifty
thousand ($50,000)for five(5)years from the date of this Executive Summary.
