Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve Petition VAC-PL20140002166,to disclaim, renounce and vacate the County and the public interest in the 15-foot drainage easement as shown in Official Record Book 4387, Page 956 et seq, of the public records of Collier County,Florida,located in Section 11,Township 51 South,Range 26 East, Collier County, Florida and to accept Petitioner's grant of a 20-foot drainage easement to replace the vacated drainage easement. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the 15-foot drainage easement as shown in Official Record Book 4387, Page 956 et seq, of the public records of Collier County, Florida, located in Section 11, Township 51 South, Range 26 East, Collier County,Florida, being more specifically shown in Exhibit"A" and to accept Petitioner's grant of a 20-foot drainage easement to replace the vacated drainage easement. CONSIDERATIONS: Petition VAC-PL20140002166 has been received by the Development Review Division, Growth Management Department from Richard Mach, of Q. Grady Minor and Associates, P.A., as agent for the property owner, to vacate the 15-foot drainage easement as shown in Official Record Book 4387, Page 956 et seq, of the public records of Collier County, Florida, located in Section 11,Township 51 South,Range 26 East, Collier County,Florida. The proposed easement vacation is in response to the development of this site. When Copper Cove Preserve was originally developed, Unit 3 was proposed as a multi-family tract. The lakes were excavated and some of the drainage facilities were installed. An easement was recorded over one of the drainage pipe runs in 2008. The easement was granted to the Community Association with responsibility for maintenance and to Collier County with NO responsibility for maintenance. The Copper Cove Community Association has consented to this vacation. Copper Cove Preserve Unit 3 has been converted to a single family lot development (PL20120000116), the plat was recorded and the site construction has been completed. The existing easement and drainage pipe encroached into the building area of Lot 200. The drainage pipe has been relocated as part of the Unit 3 single family site construction, so the proposed vacated easement does not contain any drainage facilities. The applicant is proposing to vacate the existing easement and record a replacement easement over the relocated drainage pipe. Collier County will not have any responsibility for maintenance. There is no public detriment associated with this vacation request because the proposed drainage easement is a sufficient replacement for the vacated drainage easement. The Engineering Review Department has reviewed this petition and found no reason for objection. The replacement easement is being held by the County Attorney's office, pending the outcome of this petition. Packet Page-1257- 5/26/2015 17.C. FISCAL IMPACT: The Growth Management Department, Development Review Division staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording the Resolution and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary.
