EXECUTIVE SUMMARY
Recommendation to direct Staff to extend the "Early Entry" bonus Transfer of Development
Rights (TDR) credit, as provided for within the Future Land Use Element (FLUE) of the Growth
Management Plan (GMP).
OBJECTIVE: To have the Board of County Commissioners (BCC) provide direction for the
extension of the Early Entry bonus TDR credit for an additional three years, until September 27,
2018 and include the extension within the staff initiated GMP-Amendment cycle.
CONSIDERATIONS: The Early Entry bonus TDR was first introduced into the Rural Fringe
Mixed Use District (RFMUD) through Ordinance 05-25, which provided for its availability for
three years from the date of the implementing Land Development Code (LDC) amendment to
September 27, 2008. Through Ordinance 08-59, the Early Entry bonus TDR was extended to a
March 27, 2012 expiration date. Finally, as part of the County's 2011 Evaluation and Appraisal
Report(EAR), Growth Management Plan (GMP) 2011 amendments, the Early Entry bonus TDR
was extended to the current date of September 27, 2015. It should be noted that corresponding
amendments to the Land Development Code, sections 2.03.07.D.4.c.iic) and 2.03.07.D.4.f.ii.b)1)
will also be needed.
Additionally, at the February 10, 2015 BCC Public Hearing, the BCC allocated additional
funding to Comprehensive Planning to provide for the initiation of the structural review of the
four sub-area plans of the GMP, east of CR951, with the Rural Fringe Mixed District being the
first area to restudy. Within that review of the RFMUD, the appropriateness of the Early Entry
bonus will be evaluated, with specific recommendations anticipated regarding the duration the
Early Entry TDR bonus should be available. Based upon this recognition, staff is seeking
direction from the BCC to extend the Early Entry TDR bonus for an additional three years, to
allow for the public planning process to arrive upon the best recommendation regarding its
availability.
FISCAL IMPACT: There are no unaccounted for cost associated with extending the Early
Entry TDR bonus an additional three years, staff time to process the request and cost associated
with advertising the Ordinance has been budgeted within the current fiscal year allocation.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: At this time there are no direct GMP
impacts associated with this Executive Summary, but the conclusion of the EAR-based
amendment process or a standalone GMP amendment will modify the GMP.
LEGAL CONSIDERATIONS: The extension of the Early Entry bonus will be effective when
the Ordinance amendments to the Growth Management Plan and Land Development Code
become effective. This item is approved as to form and legality. A majority vote is necessary for
Board action. (HFAC)
RECOMMENDATION: Staff recommends the BCC directs staff to extend the Early Entry
bonus TDR credit as part of the 2015 staff initiated GMP amendments and as part of the next
LDC amendment cycle.
