EXECUTIVE SUMMARY
Recommendation to appoint seven members to the Immokalee Enterprise Zone
Development Agency.
OBJECTIVE: To reappoint six regular members to the Immokalee Enterprise Zone
Development Agency (IEZDA) to seats expiring on April 4, 2017, and appoint one ex-officio
non-voting member without an expiration date.
CONSIDERATIONS: The Immokalee Enterprise Zone Development Agency is a 13
member committee created on March 28, 1995, by Ordinance 95-22 to induce private investment
into distressed areas to create economic opportunities and sustainable economic development for
designated areas. To permit Collier County to participate in this program, the Board of County
Commissioners nominated the Immokalee community to be considered by the Florida
Department of Commerce for Enterprise Zone designation in Resolution No. 95-248, approved
March 28, 1995. As part of the formal application for an Enterprise Zone, the State required that
a committee consisting of a broad base of citizens be established. The committee has
representation from the Immokalee Chamber of Commerce, financial or insurance entities, local
businesses and residents, nonprofit community-based organizations operating within the
nominated area, local Workforce Development Board, local code enforcement agency, and local
law enforcement agency. This committee also serves as the Immokalee Redevelopment Board.
Terms are four years. A list of the current membership is included in the backup.
There are currently two vacancies on this committee, and seven seats expiring on April 4, 2015.

Ordinance No. 97-81 provides that the Director of the Department of Agriculture of Collier
County shall be appointed as an ex-officio member of the IEZDA, and shall be a non-voting
member. The former Agriculture and Small Farm Extension Agent with the University of Florida
IFAS Extension, Robert Halman, retired on December 4, 2014 after many years of service to
Collier County. In accordance with Ordinance No. 97-81, the new Extension Agent, Bryan
Fluech, must be appointed to replace Mr. Halman on the IEZDA as an ex-officio non-voting
member.

COMMITTEE RECOMMENDATION: That the above named applicants each be reappointed
to their seats on this committee to four year terms expiring on April 4, 2019, and that Bryan
Fluech be appointed to the IEZDA as an ex-officio non-voting member with no expiration date.

FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners adopts the Committee
Recommendation, and directs the County Attorney to prepare a resolution confirming the
appointments.

Dear Friends of Agriculture/Small farmers/Backyard sustainability folks,
It is with mixed emotions that I must tell you that I will be retiring from my position as Agriculture and Small farm
Extension Agent with the University of Florida IFAS Extension. Between my service with the University of Maryland
Cooperative Extension, Maryland Department of Agriculture and the University of Florida IFAS Extension I have racked
up some 29 and half years. My final day in the Collier County office will be December 4th.
As I look back over the many years with Extension I can truly say I have had the pleasure of developing many wonderful
staff,faculty and agricultural producer friendships. It is this part that I will miss greatly.
Of course being in extension for all these years and now a member of the southwest Florida community, I will try to
continue to volunteer in the community in any way possible. I will also stay busy with my home garden and other
lifelong projects.

SEVERABILITY; PROVIDING FOR INCLUSION IN THE COLLIER
COUNTY CODE OF LAWS AND ORDINANCES; PROVIDING FOR
EFFECTIVE DATE
WHEREAS,the Board of County Commissioners of Collier County,Florida,has adopted
Ordinance No. 95-22, Establishing the Irnmokalee Enterprise Zone Development Agency •
(EZDA) ;and
WHEREAS, Collier County Government has a policy that no Collier County employee
shall serve on Board of County Commissioners Advisory Boards or Committees;and
WHEREAS, the Director of the Department of Agriculture for Collier County has had,
and will continue to have, an integral role in the purposes and activities of the EZDA, it is
necessary to appoint the individual holding that position as liaison to the EZDA and to direct that
individual to assist the EZDA in attaining its goals pursuant to Sections 290.001 - 290.016,
Florida Statutes,and Collier County Ordinance No.95-22.
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE GOVERNING BODY,
THE BOARD OF COUNTY COMMISSIONERS,COLLIER COUNTY,FLORIDA that:
SECTION ONE: Section Two of Collier County Ordinance No. 95-22, entitled
"Appointment and Compensation of the Immokalee Enterprise Zone Development Agency" is
hereby amended by adding a new subparagraph to authorize the appointment of an ex-officio
member of the Agency,as follows:
SECTION TWO: Appointment and Compensation of the Immokalee Enterprise Zone
Development Agency
• A. The Agency shall consist of not fewer than eight (8) or more than thirteen (13)
members which shall consists of at least one representative from each of the following entities: •

1) the Immokalee Chamber of Commerce,
2) a Financial or Insurance entity,
3) a business operating in the nominated Enterprise Zone,

6) a local private industry council,
7) a local code enforcement agency,and
8) a local law enforcement agency.
B. The importance of minority representation on the agency shall be considered in
making appointments so that the agency generally reflects the ethnic and gender composition of
the Immokalee community.
C. Members of the Agency shall be appointed by and serve at the pleasure of the
Board of County Commissioners.
D. The Director of the Department of Agriculture of Collier County shall be
appointed as an ex-officio member of the Agency and shall be a non-voting member of the
Agency,
SECTION TWO: Section Three of Collier County Ordinance No. 95-22, entitled Terms of

Office of the Immokalee Enterprise Zone Development Agency,is hereby amended by adding a
new subparagraph as follows:
SECTION THREE: Terms of Office of the Immokalee Enterprise Zone Development
Agency
The initial term of office of the Agency shall be as follows:
A) Two(2)members shall be appointed for a term of three(3)years.
B) Two(2)members shall be appointed for a term of two(2)years.
C) One(1)member shall be appointed for a term of one(1)year.
• D) The remaining initial members shall be appointed for a term of four(4)years.
Thereafter,such appointment or reappointment shall be for a term of four(4)years.

Appointments to fill any vacancies on the Agency shall be for the remainder of the
unexpired term of office.

• SECTION THREE: Section Five of Collier County Ordinance No. 95-22, entitled Officers:
Ouorum: Rules of Procedure of the irnmokalee Enterprise Zone Development Agency is hereby
amended by adding a new subparagraph as follows:
SECTION FIVE: Officers:Quorum:Rules of Procedurs of the Inimokaiee Enterprise
Zone Development Agency
A) The Board of County Commissioners shall elect a chairman and vice chairman
from among the members, exclusive of the Director of the Department of Asrriculture member,
Officers'terms shall be for one(1)year,with eligibility for reelection.
B) A majority of the voting members of the Agency constitutes a quorum for the
purposes of conducting business and exercising the powers of the Agency and for all other
purposes.
C) Action may be taken by the Agency upon a vote of a majority of the voting
members present. Copies of all Agency minutes, resolutions, reports, and exhibits shall be
• submitted to the Board of County Commissioners.
SECTION FOUR: CONFLICT AND SEVERABILITY
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law,the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction,such portion shall be deemed a
• separate,distinct,and independent provision and such holding shall not affect the validity of the
remaining portion.

This 13 member committee was created on April 4, 1995, by Ord. No. 95-22 to induce private
investment into distressed areas to create economic opportunities and sustainable economic
development for designated areas. Initial members were appointed by Resolution No. 95-249.
To permit Collier County to participate in this program,the Board of County Commissioners
nominated the Immokalee Community to be considered by the FL Dept of Commerce for
Enterprise Zone designation in Reso. No. 95-248,approved March 28, 1995. As part of the
formal app for an EZ,the State required that a committee consisting of a broad base of citizens
be established. The committee has representation from the Chamber of Commerce,financial or
insurance entities, businesses operating within the nominated area, residents, nonprofit
community-based organizations, local workforce development board, local code enforcement
agency,and local law enforcement agency. Amended by Ord. No. 97-81 Terms are 4 years.
This committee also serves as the Immokalee Redevelopment Board.
