EXECUTIVE SUMMARY
Recommendation to approve a budget amendment recognizing recovery of County funds in
connection with a claim involving a Collier Area Transit bus shelter.
OBJECTIVE: Recognize funds from a recovery of insurance proceeds in connection with an
automobile accident.
CONSIDERATIONS: On May 10, 2014, a Collier Area Transit bus shelter located on the west
side of Airport Road, just north of Ardisia Lane, was damaged as a result of an automobile
accident involving a private citizen. The shelter construction was a transportation requirement
associated with Resolution 07-63, Pine Air Lakes development and was constructed in 2008.
The transportation requirement as noted in the aforementioned resolution was limited to
construction and did not include maintenance in perpetuity. Therefore, since this is a permitted
public transit facility required by a development order, Public Transit & Neighborhood
Enhancement has assumed maintenance responsibilities. The claim in the amount of$8,968.80
represents the cost to repair the damaged bus shelter. The total sum of $8,968.80 in damages
was recovered through the subrogation efforts of the Collier County Risk Management
Department.
FISCAL IMPACT: A budget amendment is necessary to recognize recovery funds in the
amount of$8,968.80, within Collier Area Transit Fund 426, CAT Bus Shelter Project No. 60083.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires
majority vote for Board approval.—SRT
GROWTH MANAGEMENT IMPACT: Transit capital and operations supports goals and
objectives of the Transportation Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners recognizes and accepts the
recovery of$8,968.80 in County funds and authorize the necessary budget amendment.
