On behalf of the Ave Maria Stewardship Community District, I am requesting that the Collier County
Board of County Commissioners designate District roadways for golf cart use. Section 316.212, F.S.,
prohibits use of golf carts on public roads and streets except where such roadway has been designated
by a county or municipality for use by golf carts. Collier County is the appropriate governmental
body to make the designation because the District is located within the unincorporated part of Collier i!
County.

Please explain in detail the action you are asking the Commission to take (attach,
additional page if necessary):
The District requests that the County enter into a county traffic agreement with the District that provides for
the designation of District roadways for golf cart use. We believe that entering into a county
traffic agreement is the most efficient way to make the designation. Alternatively,the District requests
that the County adopt an ordinance designating District roadways for golf cart use. The District asks that

the County allow use of golf carts on District roadways during all hours,provided the golf carts meet
the additional safety requirements for nighttime use as required in Section 316.212, F.S.

RE: Public Petition Request-Ave Maria Golf Cart Road Designation '!
Dear Mr. Ochs:
Enclosed is a request to speak under public petition at the March 24, 2015,meeting of the
Board of County Commissioners on behalf of the Ave Maria Stewardship District. The District
requests that Collier County designate the district roadways (the "Roads") for golf cart use.
While the Roads are owned by the District, Collier County is the appropriate entity to make the
designation because the District is located within the unincorporated part of Collier County.
The Roads are open to the public and located within the unincorporated part of Collier
County. Therefore they fall within the Chapter 334 definition of"county road system" as "all !j
collector roads in the unincorporated areas of a county and all extensions of such collector roads Il
into and through any unincorporated areas, and all local roads in the unincorporated area." ;
Further, Section 334.03, Florida Statutes, defines "Iocal road" as "a route providing service
which is of relatively low average traffic volume, short average trip length or minimal through- '1
traffic movements, and high land access for abutting property."
Collier County has traffic control jurisdiction over the Roads. Pursuant to Section
316.640, Florida Statutes, the sheriffs office of each county has authority to enforce all of the
traffic laws of this state on all streets throughout the county wherever the public has the right to
travel by motor vehicle. As such, Collier County has traffic control jurisdiction over all of the '!
Roads which are open to the public and may designate the Roads for golf cart use. The District,
unfortunately,does not have this power pursuant to Section 316.212,Florida Statutes.
